HeatTreatingofMetal(SIC3398)
FabricatingofMetalProducts(SIC34)
ManufacturingofIndustrialandCommercialMachinery(SIC35)
ManufacturingofElectronicEquipment(SIC36)
ManufacturingofTransportationEquipment(SIC37)
ManufacturingofMeasuringandAnalyzingInstruments(SIC38))
StormwaterpointsourcedischargesfromlikeindustrialactivitiesdeemedbyDWQtobesimilartothese

SECTIONA:GENERALPERMITCOVERAGE
AllpersonsdesiringtohavefacilitiescoveredbythisGeneralPermitmustregisterwiththeDivision
ofWaterQuality(DWQ)bythefilingofaNoticeofIntent(NOI)andapplicablefees.TheNOIshallbe
submittedandacertificateofcoverageissuedpriortoanypointsourcedischargeofstormwater
associatedwithindustrialactivitytothesurfacewatersofthestate.
AnyowneroroperatornotwishingtobecoveredorlimitedbythisGeneralPermitmaymake
applicationforanindividualNPDESpermitinaccordancewithNPDESproceduresin15ANCAC2H
.0100,statingthereasonssupportingtherequest.Anyapplicationforanindividualpermitshould
bemadeatleast180dayspriortocommencementofdischarge.
ThisGeneralPermitdoesnotcoveractivitiesordischargescoveredbyanindividualNPDESpermit
untiltheindividualpermithasexpiredorhasbeenrevoked.Anypersonconductinganactivity
coveredbyanindividualpermitbutwhichcouldbecoveredbythisGeneralPermitmayrequest
thattheindividualpermitberevokedandcoverageunderthisGeneralPermitbeprovided.
Ifindustrialmaterialsandactivitiesarenotexposedtoprecipitationorrunoffasdescribedin40
CFR122.26(g),thefacilitymayqualifyforaNoExposureExclusionfromNPDESstormwater
dischargepermitrequirements.AnyowneroroperatorwishingtoobtainaNoExposureExclusion
mustsubmitaNoExposureCertificationNoticeofIntent(NOI)formtotheDivision;mustreceive
approvalbytheDivision;mustmaintainnoexposureconditionsunlessauthorizedtodischarge
underavalidNPDESstormwaterpermit;andmustrecertifytheNoExposureExclusionannually.
AnyfacilitymayapplyforneworcontinuedcoverageunderthispermituntilaTotalMaximum
DailyLoad(TMDL)forpollutantsforstormwaterisestablished.ATMDLsetsapollutantloading
limitthataffectsawatershed,orportionofawatershed,drainingtoaspecificimpairedwater.For
dischargestowatershedsaffectedbyaTMDL,coverageunderthispermitmaydependonthe
facilitydemonstratingitdoesnothavereasonablepotentialtoviolateapplicablewater
qualitystandardsforthosepollutantsasaresultofdischarges.IfDWQdeterminesthat
dischargeshavereasonablepotentialtocausewaterqualitystandardviolations,thefacilityshall
applyforanindividualpermit180dayspriortotheexpirationdateofthisGeneralPermit.Once
thatindividualpermitiseffective,thefacilitywillnolongerhavecoverageunderthisGeneral
Permit.Notethatthepermitteemustidentifyimpairedwaters(scheduledforTMDLdevelopment)
andwatersalreadysubjecttoaTMDLintheSiteOverview,asoutlinedintheStormwaterPollution
PreventionPlan,PartII,SectionA.
Duringtheperiodbeginningontheeffectivedateofthepermitandlastinguntilexpiration,the
permitteeisauthorizedtodischargestormwaterassociatedwithindustrialactivity.Such
dischargesshallbecontrolled,limitedandmonitoredasspecifiedinthispermit.

Untilcoverageunderthispermitexpiresorismodifiedorrevoked,thepermitteeisauthorizedto
dischargestormwatertothesurfacewatersofNorthCarolina,ortoaseparatestormsewersystem,
whichhasbeenadequatelytreatedandmanagedinaccordancewiththetermsandconditionsof
thisGeneralPermit.
Anyotherpointsourcedischargetosurfacewatersofthestateisprohibitedunlessitisan
allowablenonstormwaterdischargeoriscoveredbyanotherpermit,authorization,orapproval.
ThedischargesallowedbythisGeneralPermitshallnotcauseorcontributetoviolationsof
WaterQualityStandards.
Dischargesauthorizedbythispermitandsiteoperationsmustmeetapplicablewetlandstandards,
asrecordedin15ANCAC2B.0230and.0231,andwaterqualitycertificationrequirementsas
outlinedin15ANCAC2H.0500.
Thispermitdoesnotrelievethepermitteesresponsibilityforcompliancewithanyotherapplicable
federal,state,orlocallaw,rule,standard,ordinance,order,ordecree.

PARTIIMONITORING,CONTROLS,ANDLIMITATIONSFORPERMITTED
DISCHARGES
SECTIONA:STORMWATERPOLLUTIONPREVENTIONPLAN
ThepermitteeshalldevelopandimplementaStormwaterPollutionPreventionPlan(SPPP).The
SPPPshallbemaintainedonsiteunlessexemptedfromthisrequirementbytheDivision.TheSPPP
ispublicinformationinaccordancewithPartIII,StandardConditions,SectionE,paragraph3ofthis
permit.TheSPPPshallinclude,ataminimum,thefollowingitems:
1. SiteOverview.TheSiteOverviewshallprovideadescriptionofthephysicalfacilityandthe
potentialpollutantsourcesthatmaybeexpectedtocontributetocontaminationofstormwater
discharges.TheSiteOverviewshallcontainthefollowing:
(a) Agenerallocationmap(USGSquadranglemaporappropriatelydraftedequivalentmap),
showingthefacility'slocationinrelationtotransportationroutesandsurfacewaters;the
nameofthereceivingwaterstowhichthestormwateroutfallsdischarge,orifthedischarge
istoamunicipalseparatestormsewersystem,thenameofthemunicipalityandthe
ultimatereceivingwaters;andaccuratelatitudeandlongitudeofthepointsofstormwater
dischargeassociatedwithindustrialactivity.Thegenerallocationmap(oralternativelythe
sitemap)shallidentifywhetheranyreceivingwatersareimpaired(onthestates303(d)
listofimpairedwaters)orifthesiteislocatedinawatershedforwhichaTMDLhasbeen
established,andwhattheparametersofconcernare.
(b) Anarrativedescriptionofstoragepractices,loadingandunloadingactivities,outdoor
processareas,dustorparticulategeneratingorcontrolprocesses,andwastedisposal
practices.Anarrativedescriptionofthepotentialpollutantsthatcouldbeexpectedtobe
presentinthestormwaterdischargefromeachoutfall.
(c) Asitemapdrawnatascalesufficienttoclearlydepict:thesitepropertyboundary;the
stormwaterdischargeoutfalls;allonsiteandadjacentsurfacewatersandwetlands;
industrialactivityareas(includingstorageofmaterials,disposalareas,processareas,
loadingandunloadingareas,andhaulroads);sitetopographyandfinishedgrade;all
drainagefeaturesandstructures;drainageareaboundariesandtotalcontributingareafor
eachoutfall;directionofflowineachdrainagearea;industrialactivitiesoccurringineach
drainagearea;buildings;stormwaterBestManagementPractices(BMPs);andimpervious
surfaces.Thesitemapmustindicatethepercentageofeachdrainageareathatis
impervious,andthesitemapmustincludeagraphicscaleindicationandnortharrow.
(d) Alistofsignificantspillsorleaksofpollutantsduringthepreviousthree(3)yearsand
anycorrectiveactionstakentomitigatespillimpacts.
(e) Certificationthatthestormwateroutfallshavebeenevaluatedforthepresenceofnon
stormwaterdischarges.Thepermitteeshallrecertifyannuallythatthestormwater
outfallshavebeenevaluatedforthepresenceofnonstormwaterdischarges.The
certificationstatementwillbesignedinaccordancewiththerequirementsfoundinPartIII,
StandardConditions,SectionB,Paragraph3.

2. StormwaterManagementStrategy.TheStormwaterManagementStrategyshallcontaina
narrativedescriptionofthematerialsmanagementpracticesemployedwhichcontrolor
minimizethestormwaterexposureofsignificantmaterials,includingstructuraland
nonstructuralmeasures.TheStormwaterManagementStrategy,ataminimum,shall
incorporatethefollowing:
(a) FeasibilityStudy.Anannualreviewofthetechnicalandeconomicfeasibilityofchanging
themethodsofoperationsand/orstoragepracticestoeliminateorreduceexposureof
materialsandprocessestorainfallandrunonflows.Whereverpractical,thepermittee
shallpreventexposureofallstorageareas,materialhandlingoperations,and
manufacturingorfuelingoperations.Inareaswhereeliminationofexposureisnot
practical,thisreviewshalldocumentthefeasibilityofdivertingthestormwaterrunon
awayfromareasofpotentialcontamination.
(b) SecondaryContainmentRequirementsandRecords.Secondarycontainmentis
requiredfor:bulkstorageofliquidmaterialsincludingpetroleumproducts;storageinany
amountofSection313ofTitleIIIoftheSuperfundAmendmentsandReauthorizationAct
(SARA)waterprioritychemicals;andstorageinanyamountofhazardoussubstances,in
ordertopreventleaksandspillsfromcontaminatingstormwaterrunoff.Atableor
summaryofallsuchtanksandstoredmaterialsandtheirassociatedsecondarycontainment
areasshallbemaintained.Ifthesecondarycontainmentdevicesareconnectedto
stormwaterconveyancesystems,theconnectionshallbecontrolledbymanuallyactivated
valvesorothersimilardeviceswhichshallbesecuredclosedwithalockingmechanism.
Anystormwaterthataccumulatesinthecontainmentareashallbeataminimumvisually
observedforcolor,foam,outfallstaining,visiblesheens,anddryweatherflow,priorto
releaseoftheaccumulatedstormwater.Accumulatedstormwatershallbereleasediffound
tobeuncontaminatedbyanymaterial.Recordsdocumentingtheindividualmakingthe
observation,thedescriptionoftheaccumulatedstormwater,andthedateandtimeofthe
releaseshallbekeptforaperiodoffive(5)years.
(c) BMPSummary.AlistingofsitestructuralandnonstructuralBestManagementPractices
(BMPs)shallbeprovided.TheinstallationandimplementationofBMPsshallbebasedon
theassessmentofthepotentialforsourcestocontributesignificantquantitiesofpollutants
tostormwaterdischargesandondatacollectedthroughmonitoringofstormwater
discharges.TheBMPSummaryshallincludeawrittenrecordofthespecificrationalefor
installationandimplementationoftheselectedsiteBMPs.TheBMPSummaryshallbe
reviewedandupdatedannually.
3. SpillPreventionandResponseProcedures.TheSpillPreventionandResponseProcedures
(SPRP)shallincorporateanassessmentofpotentialpollutantsourcesbasedonamaterials
inventoryofthefacility.FacilitypersonnelresponsibleforimplementingtheSPRPshallbe
identifiedinawrittenlistincorporatedintotheSPRPandsignedanddatedbyeachindividual
acknowledgingtheirresponsibilitiesfortheplan.Aresponsiblepersonshallbeonsiteatall
timesduringfacilityoperationsthathavethepotentialtocontaminatestormwaterrunoff
throughspillsorexposureofmaterialsassociatedwiththefacilityoperations.TheSPRPmust
besitestormwaterspecific.Therefore,anoilSpillPreventionControlandCountermeasure
plan(SPCC)maybeacomponentoftheSPRP,butmaynotbesufficienttocompletelyaddress
thestormwateraspectsoftheSPRP.ThecommonelementsoftheSPCCwiththeSPRPmaybe
incorporatedbyreferenceintotheSPRP.

4. PreventativeMaintenanceandGoodHousekeepingProgram.Apreventativemaintenance
andgoodhousekeepingprogramshallbedevelopedandimplemented.Theprogramshall
addressallstormwatercontrolsystems(ifapplicable),stormwaterdischargeoutfalls,allonsite
andadjacentsurfacewatersandwetlands,industrialactivityareas(includingmaterialstorage
areas,materialhandlingareas,disposalareas,processareas,loadingandunloadingareas,and
haulroads),alldrainagefeaturesandstructures,andexistingstructuralBMPs.Theprogram
shallestablishschedulesofinspections,maintenance,andhousekeepingactivitiesof
stormwatercontrolsystems,aswellasfacilityequipment,facilityareas,andfacilitysystems
thatpresentapotentialforstormwaterexposureorstormwaterpollutionwherenotalready
addressedunderanotherelementoftheSPPP.Inspectionofmaterialhandlingareasand
regularcleaningschedulesoftheseareasshallbeincorporatedintotheprogram.Timely
compliancewiththeestablishedschedulesforinspections,maintenance,andhousekeeping
shallberecordedandmaintainedintheSPPP.
5. FacilityInspections.Inspectionsofthefacilityandallstormwatersystemsshalloccuraspart
ofthePreventativeMaintenanceandGoodHousekeepingProgramataminimumonasemi
annualschedule,onceduringthefirsthalfoftheyear(JanuarytoJune),andonceduringthe
secondhalf(JulytoDecember),withatleast60daysseparatinginspectiondates(unless
performedmorefrequentlythansemiannually).Thesefacilityinspectionsaredifferentfrom,
andinadditionto,thestormwaterdischargecharacteristicmonitoringattheoutfallsrequired
inPartIIB,C,andDofthispermit.
6. EmployeeTraining.Trainingprogramsshallbedevelopedandtrainingprovidedata
minimumonanannualbasisforfacilitypersonnelwithresponsibilitiesfor:spillresponseand
cleanup,preventativemaintenanceactivities,andforanyofthefacility'soperationsthathave
thepotentialtocontaminatestormwaterrunoff.Thefacilitypersonnelresponsiblefor
implementingthetrainingshallbeidentified,andtheirannualtrainingshallbedocumentedby
thesignatureofeachemployeetrained.
7. ResponsibleParty.TheSPPPshallidentifyaspecificperson(s)orposition(s)responsiblefor
theoverallcoordination,development,implementation,andrevisionoftheSPPP.
ResponsibilitiesforallcomponentsoftheSPPPshallbedocumentedandpositionassignments
provided.
8. SPPPAmendmentandAnnualUpdate.ThepermitteeshallamendtheSPPPwheneverthere
isachangeindesign,construction,operation,sitedrainage,maintenance,orconfigurationof
thephysicalfeatureswhichmayhaveasignificanteffectonthepotentialforthedischargeof
pollutantstosurfacewaters.AllaspectsoftheSPPPshallbereviewedandupdatedonan
annualbasis.Theannualupdateshallinclude:
(a)
anupdatedlistofsignificantspillsorleaksofpollutantsforthepreviousthree(3)
years,orthenotationthatnospillshaveoccurred(elementoftheSiteOverview);
(b)
awrittenrecertificationthatthestormwateroutfallshavebeenevaluatedforthe
presenceofnonstormwaterdischarges(elementoftheSiteOverview);
(c)
adocumentedreevaluationoftheeffectivenessoftheonsitestormwaterBMPs
(BMPSummaryelementoftheStormwaterManagementStrategy).
(d)
astatementthatannualtrainingrequirementsweremetintheyearpast;
(e)
areviewandcomparisonofsampleanalyticaldatatobenchmarkvalues(if
applicable)overthepastyear,includingadiscussionaboutTieredResponsestatus.
ThepermitteeshallusetheDivisionsAnnualSummaryDataMonitoringReport
(DMR)form,availablefromtheStormwaterPermittingUnitswebsite(See
MonitoringFormshere:http://portal.ncdenr.org/web/wq/ws/su/npdessw).

TheDirectormaynotifythepermitteewhentheSPPPdoesnotmeetoneormoreofthe
minimumrequirementsofthepermit.Within30daysofsuchnotice,thepermitteeshallsubmit
atimescheduletotheDirectorformodifyingtheSPPPtomeetminimumrequirements.The
permitteeshallprovidecertificationinwriting(inaccordancewithPartIII,Standard
Conditions,SectionB,Paragraph3)totheDirectorthatthechangeshavebeenmade.
9. SPPPImplementation.ThepermitteeshallimplementtheStormwaterPollutionPrevention
PlanandallappropriateBMPstopreventcontaminantsfromenteringsurfacewatersvia
stormwater.ImplementationoftheSPPPshallincludedocumentationofallmonitoring,
measurements,inspections,maintenanceactivities,andtrainingprovidedtoemployees,
includingthelogofthesamplingdataandofactionstakentoimplementBMPsassociatedwith
theindustrialactivities,includingvehiclemaintenanceactivities.Suchdocumentationshallbe
keptonsiteforaperiodoffive(5)yearsandmadeavailabletotheDirectorortheDirectors
authorizedrepresentativeimmediatelyuponrequest.
10. SolventManagementPlan.FacilitiesthatimplementaSolventManagementPlanmayso
certify,andtherequirementforTotalToxicOrganics(TTO)monitoringinPartII,SectionB.
maybewaived.TheSolventManagementPlanshallinclude:
(a)
anannuallyupdatedandquantifiedinventoryofthetotaltoxicorganiccompounds
presentonsiteduringthepreviousthreeyears;
(b)
anarrativedescriptionoftheinplantlocationsandusesofthetoxicorganic
compounds,themethodofdisposalincludingquantitiesdisposedonandoffsite;
(c)
themanagementproceduresandengineeringmeasuresforassuringthattoxic
organicsdonotspillorleakintostormwater.
DWQmayatitsdiscretionrequiresubmittal,review,andapprovaloftheSolventManagement
PlanasaconditionofcontinuingtheTTOsamplingwaiver.Forthosefacilitieselectingto
employtheTTOsamplingwaiver,thepermitteeshallincludethefollowingsignedcertification
statementoneachdischargemonitoringreport:"Baseduponmyinquiryofthepersonorpersons
directlyresponsibleformanagingcompliancewiththepermitmonitoringrequirementfortotal
toxicorganics(TTO),Icertifythattothebestofmyknowledgeandbelief,noleak,spill,or
dumpingofconcentratedtoxicorganicsintothestormwaterorontoareaswhichareexposedto
rainfallorstormwaterrunoffhasoccurredsincefilingthelastdischargemonitoringreport.I
furthercertifythatthisfacilityisimplementingalltheprovisionsoftheSolventManagementPlan
includedintheStormwaterPollutionPreventionPlan.

SECTIONB:ANALYTICALMONITORINGREQUIREMENTS
AnalyticalmonitoringofstormwaterdischargesshallbeperformedasspecifiedinTable1.All
analyticalmonitoringshallbeperformedduringameasureablestormeventateachstormwater
dischargeoutfall(SDO).OnlySDOsdischargingstormwaterassociatedwithindustrialactivitymust
besampled(SeeDefinitions).
Ameasurablestormeventisastormeventthatresultsinanactualdischargefromthe
permittedsiteoutfall.Thepreviousmeasurablestormeventmusthavebeenatleast72hours
prior.The72hourstormintervaldoesnotapplyifthepermitteeisabletodocumentthatashorter
intervalisrepresentativeforlocalstormeventsduringthesamplingperiod,andthepermittee
obtainsapprovalfromthelocalDWQRegionalOffice.SeeDefinitions.

significantstormwatercontaminationispresent,thepermitteeshallinvestigatepotentialcauses,evaluate
thefeasibilityofcorrectiveactions,andimplementthosecorrectiveactionswithin60days,perthe
QualitativeMonitoringResponse,below.Awrittenrecordofthepermitteesinvestigation,evaluation,
andresponseactionsshallbekeptintheSPPP.
QualitativeMonitoringResponse
Qualitative monitoring is for the purposes of evaluating the effectiveness of the perjittees
implenetaionoftheSPPP,andforassessingnewsourcesofstormwaterpollution,andforprompting
the permittees response to pollution. If the permittee repeatedly fails to respond effectively to
correctproblemsidentifiedbyqualitativemonitoring,orifthedischargecausesorcontributestoa
waterqualitystandardviolation,DWQmaybutisnotlimitedto:
requirethatthepermitteerevise,increase,ordecreasemonitoringfrequencyforsomeor
allparameters(analyticalorqualitative);
requirethepermitteetoinstallstructuralstormwatercontrols;
requirethepermitteetoimplementotherstormwatercontrolmeasures;
requirethepermitteetoperformupstreamanddownstreammonitoringtocharacterize
impactsonreceivingwaters;or
requirethepermitteeimplementsitemodificationstoqualifyforaNoExposureExclusion.

PARTIIISTANDARDCONDITIONSFORNPDESSTORMWATERGENERALPERMITS
SECTIONA:COMPLIANCEANDLIABILITY
1.
ComplianceSchedule
ThepermitteeshallcomplywithLimitationsandControlsspecifiedforstormwaterdischargesin
accordancewiththefollowingschedule:
ExistingFacilitiesalreadyoperatingbutapplyingforpermitcoverageforthefirsttime:The
StormwaterPollutionPreventionPlanshallbedevelopedandimplementedwithin12monthsofthe
effectivedateoftheCertificateofCoverageandupdatedthereafteronanannualbasis.Secondary
containment,asspecifiedinPartII,SectionA,Paragraph2(b)ofthisgeneralpermit,shallbe
accomplishedwithin12monthsoftheeffectivedateoftheissuanceoftheCertificateofCoverage.
NewFacilitiesapplyingforcoverageforthefirsttime:TheStormwaterPollutionPreventionPlan
shallbedevelopedandimplementedpriortothebeginningofdischargesfromtheoperationofthe
industrialactivityandbeupdatedthereafteronanannualbasis.Secondarycontainment,asspecified
inPartII,SectionA,Paragraph2(b)ofthisgeneralpermitshallbeaccomplishedpriortothe
beginningofdischargesfromtheoperationoftheindustrialactivity.
ExistingfacilitiespreviouslypermittedandapplyingforrenewalunderthisGeneralPermit:
Allrequirements,conditions,limitations,andcontrolscontainedinthispermit(exceptnewSPPP
elementsinthispermitrenewal)shallbecomeeffectiveimmediatelyuponissuanceoftheCertificate
ofCoverage.NewelementsoftheStormwaterPollutionPreventionPlanforthispermitrenewal
shallbedevelopedandimplementedwithin6monthsoftheeffectivedateofthisgeneralpermitand
updatedthereafteronanannualbasis.Secondarycontainment,asspecifiedinPartIII,Paragraph
2(b)ofthisgeneralpermitshallbeaccomplishedpriortothebeginningofdischargesfromthe
operationoftheindustrialactivity.
2.
DutytoComply
Thepermitteemustcomplywithallconditionsofthisgeneralpermit.Anypermitnoncompliance
constitutesaviolationoftheCleanWaterAct(CWA)andisgroundsforenforcementaction;for
permittermination,revocationandreissuance,ormodification;ordenialofapermituponrenewal
application[40CFR122.41].
a. Thepermitteeshallcomplywithstandardsorprohibitionsestablishedundersection307(a)of
theCWAfortoxicpollutantswithinthetimeprovidedintheregulationsthatestablishthese
standardsorprohibitions,evenifthegeneralpermithasnotyetbeenmodifiedtoincorporate
therequirement.
b. TheCWAprovidesthatanypersonwhoviolatessection[s]301,302,306,307,308,318or405of
theAct,oranypermitconditionorlimitationimplementinganysuchsectionsinapermitissued
undersection402,oranyrequirementimposedinapretreatmentprogramapprovedunder
sections402(a)(3)or402(b)(8)oftheAct,issubjecttoacivilpenaltynottoexceed$37,500per

imminentdangerofdeathorseriousbodilyinjury,shall,uponconviction,besubjecttoafineof
notmorethan$250,000orimprisonmentofnotmorethan15years,orboth.Inthecaseofa
secondorsubsequentconvictionforaknowingendangermentviolation,apersonshallbe
subjecttoafineofnotmorethan$500,000orbyimprisonmentofnotmorethan30years,or
both.Anorganization,asdefinedinsection309(c)(3)(B)(iii)oftheCWA,shall,uponconviction
ofviolatingtheimminentdangerprovision,besubjecttoafineofnotmorethan$1,000,000and

Understatelaw,acivilpenaltyofnotmorethan$25,000perviolationmaybeassessedagainst
anypersonwhoviolatesorfailstoactinaccordancewiththeterms,conditions,orrequirements

Thepermitteeshalltakeallreasonablestepstominimizeorpreventanydischargeinviolationofthis
generalpermitwhichhasareasonablelikelihoodofadverselyaffectinghumanhealthorthe
environment[40CFR122.41(d)].
CivilandCriminalLiability
ExceptasprovidedinPartIII,SectionCofthisgeneralpermitregardingbypassingofstormwater
controlfacilities,nothinginthispermitshallbeconstruedtorelievethepermitteefromany
responsibilities,liabilities,orpenaltiesfornoncompliancepursuanttoNCGSl432l5.3,l432l5.6,or
Section309oftheFederalAct,33USC1319.Furthermore,thepermitteeisresponsiblefor
consequentialdamages,suchasfishkills,eventhoughtheresponsibilityforeffectivecompliancemay
betemporarilysuspended.
OilandHazardousSubstanceLiability
Nothinginthisgeneralpermitshallbeconstruedtoprecludetheinstitutionofanylegalactionor
relievethepermitteefromanyresponsibilities,liabilities,orpenaltiestowhichthepermitteeisor
maybesubjecttounderNCGSl432l5.75etseq.orSection311oftheFederalAct,33USC1321.
PropertyRights
Theissuanceofthisgeneralpermitdoesnotconveyanypropertyrightsineitherrealorpersonal
property,oranyexclusiveprivileges,nordoesitauthorizeanyinjurytoprivatepropertyorany

Severability
Theprovisionsofthisgeneralpermitareseverable,andifanyprovisionofthisgeneralpermit,orthe
applicationofanyprovisionofthisgeneralpermittoanycircumstances,isheldinvalid,the
applicationofsuchprovisiontoothercircumstances,andtheremainderofthisgeneralpermit,shall
notbeaffectedthereby[NCGS150B23].
DutytoProvideInformation
ThepermitteeshallfurnishtothePermitIssuingAuthority,withinareasonabletime,any
informationwhichthePermitIssuingAuthoritymayrequesttodeterminewhethercauseexistsfor
modifying,revokingandreissuing,orterminatingthegeneralpermitissuedpursuanttothisgeneral
permitortodeterminecompliancewiththisgeneralpermit.Thepermitteeshallalsofurnishtothe
PermitIssuingAuthorityuponrequest,copiesofrecordsrequiredtobekeptbythisgeneralpermit
[40CFR122.41(h)].
PenaltiesforTampering
TheCleanWaterActprovidesthatanypersonwhofalsifies,tamperswith,orknowinglyrenders
inaccurate,anymonitoringdeviceormethodrequiredtobemaintainedunderthisgeneralpermit
shall,uponconviction,bepunishedbyafineofnotmorethan$l0,000perviolation,orby
imprisonmentfornotmorethantwoyearsperviolation,orbyboth.Ifaconvictionofapersonisfor
aviolationcommittedafterafirstconvictionofsuchpersonunderthisparagraph,punishmentisa

SECTIONC:OPERATIONANDMAINTENANCEOFPOLLUTIONCONTROLS

ProperOperationandMaintenance
Thepermitteeshallatalltimesproperlyoperateandmaintainallfacilitiesandsystemsoftreatment
andcontrol(andrelatedappurtenances)whichareinstalledorusedbythepermitteetoachieve
compliancewiththeconditionsofthispermit.Properoperationandmaintenancealsoincludes
adequatelaboratorycontrolsandappropriatequalityassuranceprocedures.Thisprovisionrequires
theoperationofbackuporauxiliaryfacilitiesorsimilarsystemswhichareinstalledbyapermittee
onlywhentheoperationisnecessarytoachievecompliancewiththeconditionsofthispermit[40
CFR122.41(e)].
2.
NeedtoHaltorReduceNotaDefense
Itshallnotbeadefenseforapermitteeinanenforcementactionthatitwouldhavebeennecessary
tohaltorreducethepermittedactivityinordertomaintaincompliancewiththeconditionofthis
generalpermit[40CFR122.41(c)].
3.
BypassingofStormwaterControlFacilities
BypassisprohibitedandtheDirectormaytakeenforcementactionagainstapermitteeforbypass
unless:
a. Bypasswasunavoidabletopreventlossoflife,personalinjuryorseverepropertydamage;and
b. Therewerenofeasiblealternativestothebypass,suchastheuseofauxiliarycontrolfacilities,
retentionofstormwaterormaintenanceduringnormalperiodsofequipmentdowntimeordry
weather.Thisconditionisnotsatisfiedifadequatebackupcontrolsshouldhavebeeninstalledin
theexerciseofreasonableengineeringjudgmenttopreventabypasswhichoccurredduring
normalperiodsofequipmentdowntimeorpreventivemaintenance;and
c. Thepermitteesubmittednoticesasrequiredunder,PartIII,SectionEofthisgeneralpermit.
IftheDirectordeterminesthatitwillmeetthethreeconditionslistedabove,theDirectormay
approveananticipatedbypassafterconsideringitsadverseeffects.
SECTIOND:MONITORINGANDRECORDS

RepresentativeSampling
Samplescollectedandmeasurementstaken,asrequiredherein,shallbecharacteristicofthevolume
andnatureofthepermitteddischarge.Analyticalsamplingshallbeperformedduringameasureable
stormevent.Samplesshallbetakenonadayandtimethatischaracteristicofthedischarge.All
samplesshallbetakenbeforethedischargejoinsorisdilutedbyanyotherwastestream,bodyof
water,orsubstance.Monitoringpointsasspecifiedinthisgeneralpermitshallnotbechanged
withoutnotificationtoandapprovalofthePermitIssuingAuthority[40CFR122.41(j)].

Tomeettheintentofthemonitoringrequiredbythisgeneralpermit,alltestproceduresmust
produceminimumdetectionandreportinglevelsandalldatageneratedmustbereporteddownto
theminimumdetectionorlowerreportingleveloftheprocedure.Ifnoapprovedmethodsare
determinedcapableofachievingminimumdetectionandreportinglevelsbelowgeneralpermit
dischargerequirements,thenthemostsensitive(methodwiththelowestpossibledetectionand
reportinglevel)approvedmethodmustbeused.
RepresentativeOutfall
Ifafacilityhasmultipledischargelocationswithsubstantiallyidenticalstormwaterdischargesthat
arerequiredtobesampled,thepermitteemaypetitiontheDirectorforrepresentativeoutfallstatus.
Ifitisestablishedthatthestormwaterdischargesaresubstantiallyidenticalandthepermitteeis
grantedrepresentativeoutfallstatus,thensamplingrequirementsmaybeperformedatareduced
numberofoutfalls.
RecordsRetention
Qualitativemonitoringshallbedocumentedandrecordsmaintainedatthefacilityalongwiththe
StormwaterPollutionPreventionPlan(SPPP).Copiesofanalyticalmonitoringresultsshallalsobe
maintainedonsite.Thepermitteeshallretainrecordsofallmonitoringinformation,including
o allcalibrationandmaintenancerecords,
o alloriginalstripchartrecordingsforcontinuousmonitoringinstrumentation,
o copiesofallreportsrequiredbythisgeneralpermit,
o copiesofalldatausedtocompletetheNoticeofIntenttobecoveredbythisgeneralpermit.
Theserecordsorcopiesshallbemaintainedforaperiodofatleast5yearsfromthedateofthe
sample,measurement,reportorNoticeofIntentapplication.Thisperiodmaybeextendedby
requestoftheDirectoratanytime[40CFR122.41].Ifthisvolumeofrecordscannotbemaintained
onsite,thedocumentsmustbemadeavailabletoaninspectoruponrequestasimmediatelyas
possible.
InspectionandEntry
ThepermitteeshallallowtheDirector,oranauthorizedrepresentative(includinganauthorized
contractoractingasarepresentativeoftheDirector),orinthecaseofafacilitywhichdischarges
throughamunicipalseparatestormsewersystem,anauthorizedrepresentativeofamunicipal
operatorortheseparatestormsewersystemreceivingthedischarge,uponthepresentationof
