RESOLUTION NO. 01 s. 2015

Member Rodrigo S. Pagotaisidro, Housing and Homesite Regulation

OfFrcer V, Housing and Land Management,Division, presented to the Body for
deliberation the request of the Internally Displaced People (IDPs) from Sumariki
to return temporarity to Sumariki. for which they are willing to sign an Affidavit of
Undertaking (waiver),

At this juncture, Hon. Ismael I. Musa, IPMR/SPM, informed the Body that
not all of the IDPs are staying in evacuation centers or in the Transitory Sites'
He disclosed that there are about 125 families who are still living with some
other families and relatives for 15 months already since September 2013,
Fu*her, he said that many.of these IDPs are actually staying now near to their
place of origin. As a matter of fact, he continued, there are about seven houses
already temporarily constructed by the IDPs 200 meters from their place of origin
without notice, That is QpslCplly, how eqger the IDPs wish to return without the
help from any agency.
Hon. Musa, then appeqled to, the Body to help these IDPs by bringing
them back to their place or, or:[gin and allow them as well to construct their house
on stilt at their own cost.

IDPs return is temporary. First, it is a disaster prone area. Should something

happen to them, be it due to man-made or natural calamities, it should not be
blamed on the City. Second, for security reasons and sther considerations,
proper documentation inctuding :their family pictures shall be provided to the
security forces for inspection and verification purposes. On the event that a nonresident is found in the area, automatically the government has the right to evict
the same.
Member Ben M. Acana, oIC, cENRo-west, suggested to include in the
Affidavit of Undertaking that IDPs who will return to the area are prohibited to
destroy and cut the mangrove trees or bacauan plantation thereaL pursuant to
Republic Act 7161.
Col. Colina clarified the veracity relative to the manifestation of Hon. Musa
that there are already people who are building structures about 200 meters from
Sumariki East. In practical estimation, it is within the mangrove area whereby
said people are not allowed'to return. They are only' atlowed to return

At this juncture, Member ,Moh. Taha s. Arakama, City Director, DILG,

moved for the adoption of a resolution approving the request of the IDps from
Sumariki to return temporarily'to Sitio Sumariki, this City, subject, however, to
the compliance with the conditions stipulated in the Affidavit of Undertaking and
as well as the inclusion of all suggestions and recommendations in terms of
security, protection of the environment and other issues and concerns in said
After due consideration and deiiberation on the matter, on motion by
Member Moh. Taha s, Arakama duly seconded by Hon. Ismael I. Musa, it was
RESOLVED, as it is hereby resolved in its meeting today, to approve the
request of the IDPs from Sumariki to return.temporarily'to'Sitio Sumariki, this
City, subject, however, to the compliaqce with the conditions stipulated in the
Affidavit of Undertaking and as wetl as the inclusion of att suggestions and
recommendations in terms of security, protection of the environment and other
issues and concerns in said Affidavit.
