County for calendar year 2014
With the work performed in 2014 Resurrection believes that it has completed the Black Cloud

mine reclamation As required in the Consent Decree over the next 4 years Resurrection will
perform general monitoring maintenance and repair activities as necessary

One minor modification was applied for in 2014 consisting of a change in final topography of

the tailing surface Seven other minor modifications s were applied for and approved from 2008
to 2013 and are contained in Appendix C

In 2014 Resurrection completed all reclamation requirements under the Consent Decree with the
exception of

ongoing

general

monitoring

maintenance

and repair activities

Figures 1 and 2 at

the end of this report show the reclaimed tailing storage facility and Black Cloud mill area final
contours and sections

Pursuant to Section 6 1 of Appendix E to the Consent Decree Black Cloud Mine Reclamation
Plan and Schedule Leadville Colorado the schedule for reclamation activities were prescribed

for years 1 through 5 with unique requirements for each year Reclamation activities for years 6

performed

Mobilize reclamation equipment and personnel to the Black Cloud Mine

chemicals and any trash and debris unsuitable for onsite burial

Associates Russell surveyed the 2013 tailing and borrow area

surfaces on June 12 2014 and Advanced Environmental Consultants Inc updated the
tailing

Russell performed a survey of the reclaimed tailing and Black Cloud mine area surfaces
for incorporation into the as built documentation

Obtained Class V Injection Well Permitfrom the United States Environmental Protection

Agency EPA for subsurface drainage of Fortuna water into the reclaimed tailing
storage facility

Finished installing aligning and reinforcing stormwater channels around the Black
Cloud mine area and tailing facility A permanent sediment pond and temporary

sediment retention structures i e hay bales were installed

The following summarizes major reclamation activities performed for 2008 and 2009 Year 1
through 2013

Daily inspections and maintenance of the property


Continuous operation of the Black Cloud tailing pumpback system
Installation of 3 pumpline from the Black Cloud tailing pumpback sump to the Yak
Tunnel blockage pipeline

Removal disposal or recycling of various wastes

Excavation and cleaning of the up gradient Black Cloud tailing facility diversion culvert
to prevent up gradient spring season snow melt drainage run on to the tailing facility

A new electrical system and larger dewatering pump were installed as part of the Iowa
Gulch tailing impoundment dewatering system
Removal of 2 feet of surface material from the Black Cloud mine building area and
placement on the tailing storage facility
Additional rock from the talus borrow area were excavated and placed as part of the cap
of the tailing storage facility
The IG 1 and IG 2 sediments and dams were removed and placed in the tailing storage
facility under a United States Corp of Engineers 404 permit
Sprayed noxious weed populations

Additional rock from the talus borrow area were excavated and placed as part of the cap

amendment 1 to the Black Cloud Reclamation Plan As we discussed during your recent site
visit we propose this minor amendment to the Reclamation Plan such further research can be

conducted prior to making a connection with the Yak Water Treatment pipeline as proposed in
the Black Cloud Reclamation Plan

The further research determined necessary primarily focuses on flow rates local climatic
conditions and alternate management technologies
As indicated this summer a young intern
did a preliminary characterization of the adit chemistry and flows The water quality data to date
does

not suggest a

direct discharge

of

this

water

but the flow

rates measured

June

July 4 97 gpm August 5 36 gpm suggest alternative long term water management methods
might be possible depending upon further characterization of flows and climatic conditions In
addition due to the low flow rates observed and the climatic conditions known at the site

plumbing piping from the adit to the Yak Black Cloud pipeline requires more research and
engineering to determine the gradients and pipeline burial depths necessary to prevent this low
adit flow from freezing during winter conditions
Therefore we propose a work plan for this research be completed and submitted to the Division

by February 15 2010 for their review and comments the research be conducted during the 2010
field season and a final engineered plan submitted to the Division on or before February 15
2011

Schedule and the enclosed 1 000 check for processing this request Resurrection Mining
Company Resurrection requests that the Reclamation Schedule be amended for the
demolition and removal of the Black Cloud Mine scale house in 2011 rather than 2010

allowing the scale house to be used during 2011 for weighing demolition materials being
shipped off site during the Black Cloud mill crusher and support buildings demolition
With this request Resurrection agrees the scale house will be demolished and removed in

2011 prior to encumbering the advancement of the Black Cloud waste pile removals
In addition Resurrection request the Division consider modifying the Reclamation

Schedule to allow the Black Cloud Mine roadway to remain following completion of the
reclamation program to allow access to the Black Cloud shaft and the Yak Blockage

pumping equipment which will require periodic access and service beyond the
reclamation program

Per our recent conversation concerning the Black Cloud Mine Reclamation Plan Resurrection

Mining Company Resurrection submits this minor amendment application for modifications to
the reclamation plan pertaining to capping the Helena mine shaft and the removal of the Black
Cloud mine shaft head frame and hoist house

As we discussed Resurrection is proposing to modify the Helena Shaft reclamation cap to allow
continued access to monitor groundwater elevations contained within the Black Cloud Mine
workings and the Yak Tunnel blockage As part of the California Gulch Superfund Yak Tunnel

contingency plan there is a continued need to monitor the Helena Shaft groundwater elevations
Besides accommodating these monitoring activities the proposed cap revision will allow

possible future access to the shaft for groundwater pumping activities if necessary The
modified shaft cap installation will consist of the placement of a heavy duty steel plate covering
the shaft opening The steel plate will contain access ports to allow the installation of monitoring
equipment probes down the shaft in a similar manner to what was completed at the Irene Shaft

In addition as we discussed the other day Resurrection has been actively demolishing the Black
Cloud Mine surface structures over the course of this summer and has approached the point of

determining what to do with the Black Cloud mine shaft head frame and hoist house When the
consent decree and reclamation plan were finalized in 2008 it was felt these structures would be

needed to support the Yak Tunnel blockage submersible pumping equipment but since this time

the pump equipment has been changed to a surface mounted turbine pump installation which
precludes the previous necessity of accessing the shaft to service the submersible pumps Since
completion of the turbine pump installation several pump removal and replacements have been
conducted and completed and these maintenance episodes have identified that the head frame

structure is more a detriment than a benefit in maintaining the pump The hoist house serves no
useful purpose or role with removing or replacing the pump equipment

Currently to the remove and or replace the pump and or pump casings from the shaft a snatch
block assembly has been retro fitted on the head frame above the pump motor and a drill truck
and a mine timber hoist are required to move the pump assemblies to and from the shaft The
lifting cable on the drill truck cable drum is extended horizontally out and away from the drill
truck to the snatch block such that the pump assemblies can be either lifted or lowered into place
while a second cable from a mine timber hoist adjacent to the head frame is used to pull the

equipment away from the head frame This process is quite cumbersome and exposes personnel
to multiple lifting cables being stretched and stressed in a fairly confined area should a cable
break or separate personnel could be injured Each of these pieces of equipment are designed to

lift vertically not horizontally and such uses as described above tends to stress the lifting
cables and doesn t take advantage of the equipment s specific design

Should the head frame be removed a drill truck or a pump service truck could be positioned

directly over the pump motor with the truck mast raised into place and the pump equipment used
as designed that is lifting vertically from the shaft in the same manner as any routine pump
removal from a well Being able to utilize the truck lifting equipment in this manner would make
the process more productive will take less time to service the pump will result in safer
maintenance with more open space and less equipment cables and will result in less expense any
time the pump needs to serviced

Per our recent conversation concerning the Black Cloud Mine Reclamation Plan Resurrection
Mining Company Resurrection submits this minor amendment application for modifications to
the reclamation plan pertaining to changing the grading of the Iowa Gulch tailing reclamation
cap

Under the existing reclamation plan in excess of 600 000 yd of material will be needed for final
reclamation Based on current information there may not be enough material at the Black Cloud
Mine site and scree hill combined to meet the required fill volumes

The Homer placer can

provide the remaining fill but requires a haul of several miles using either dirt roads or paved
County roads both which run along portions of streams In addition the existing reclamation
plan would require that the north side of the tailing be built up approximately 12 feet from the
current surface

As we discussed onsite several weeks ago Resurrection is proposing to install a subsurface


spillway and reduce the volume of fill used for reclamation This proposed modification would
reduce environmental considerations e g greenhouse gasses dust additional land disturbance
etc
time and costs Under the proposed cover approximately 250 000 cubic yards of material
will be needed grading will vary between approximately 1 4 to 2 percent a subsurface spillway
would be installed at the south side of the dam and surface water will drain to the east and west

sides of the tailings before being channeled to Iowa Gulch The subsurface spillway would be
approximately 80 feet long and 30 inches in diameter

For this minor

amendment application to the Reclamation Plan Resurrection Mining Company Resurrection


proposes to obtain a tailing growth medium from the area where the Black Cloud surface

facilities were located which is approximately Z mile to the north of the tailing impoundment
Resurrection feels that using the proposed local growth medium source would reduce the impact
on county roads and stormwater quality reduce fugitive dust reduce costs and still meet the
conditions for growth medium as outlined in the Reclamation Plan

Under the current Reclamation Plan the soil cover will include material from the following a
stockpile located to the east of the tailing pond

imported growth medium from the

Robinson Chapman placer near Leadville imported compost or other locally available and
approved soil growth medium source

The growth medium will consist of 18 inches of cover on

the tailing impoundment Based on volume calculations for the tailing cover growth medium
will need to be hauled from the Robinson Chapman Placer or other locally available sources in
order to complete reclamation
Under

the

current

Reclamation

Plan

growth

medium

can

be

obtained

from

the

Robinson Chapman placer but this source will require a one way haul of over 5 miles on
unpaved county roads adjacent to Iowa Gulch require dust suppressant applications road
improvements

and

the

installation

of stormwater management controls

As discussed above

Resurrection is requesting approval to use another locally available soil growth medium source
consisting of the growth medium under the previous waste rock piles which is located on the hill

between the tailing impoundment and the Black Cloud shaft and debris cell area

The current topography of the Black Cloud shaft area is shown on Figure 1 The existing surface

topography is at an approximate 3 1 horizontal vertical slope with a flat portion surrounding

the Black Cloud shaft and debris cell Under the proposed amendment the growth material
would be generated by removing material from the slope and flat areas with the exception of

buffers

around

the

debris

cell

and

final topography after the growth medium is removed is shown on Figure 2 The proposed cut

Six samples were collected from the proposed tailing cover material source and analyzed by the
Colorado State University Soil Water and Plant Testing Laboratory CSU for suitability as a

The results of the analysis are enclosed with this letter The Soil Water and
Plant Testing Laboratory recommends that 40 pounds of nitrogen per acre be added and for one
of the six areas 40 lbs of phosphorous per acre be added to the proposed growth medium The
CSU results were reviewed by Mr Victor Meyer a restoration ecologist Based on Mr Meyer s
recommendations Resurrection plans to amend the growth medium with 40 pounds per acre of
nitrogen phosphorus and potassium which will be incorporated into the top 6 inches of
growth medium

The Reclamation Plan states Section 4 1 p 10 that the surface of the Black Cloud tailing
facility in Iowa Gulch will be covered by waste rock other natural fill material and vegetated
growth medium
Thin lifts of the subgrade fill will be compacted to reduce the permeability and
the surface will be graded for drainage The fill will then be covered by a geotextile The
geotextile will be overlain by 6 inches of natural borrow material and 18 inches of revegetated
growth medium The purpose of the geotextile is to maintain separation and prevent

commingling of the revegetated cover the mine waste rock and the tailing subgrade This would
require approximately 29 acres of geotextile covering

As anticipated in the Reclamation Plan the tailing has continued to dewater and consolidate In
2011 and 2012 several feet of waste rock and talus fill material were placed over most of the

tailing impoundment in order to develop and maintain an appropriate surface grade that will
drain water off the final reclaimed tailing In 2013 additional natural fill material will be added
to the tailing substrate As a result of these activities a minimum of 2 feet of subgrade fill has
been or will be emplaced over most of the tailing surface An additional 6 inches of natural
borrow material scree rock and 18 inches of revegetated growth medium will be placed on the

subgrade fill in accord with the Reclamation Plan resulting in at least 4 feet of natural cover
material over the majority of the tailing surface Resurrection Mining Company Resurrection
believes that this substantial thickness of subgrade fill material will provide adequate separation

between the substrate tailing and the growth medium without the necessity of additional
separation by the woven geotextile In fact the absence of the geotextile layer may enhance
plant growth and evapotranspiration in the surface layer of vegetated growth medium

Resurrection therefore requests approval to reduce the area to be covered by geotextile to those
portions of the tailing surface that are not covered by at least 4 feet of compacted fill and
revegetated growth medium or area s of the tailing that have not had to time to consolidate from
previous placement of subgrade material This would represent a reduction in the area to be

covered by geotextile from approximately 29 acres to approximately 4 acres In addition to

improved root growth Resurrection believes that reduction of the area of geotextile will simplify
final reclamation minimize impacts to the existing tailing facility grading and schedule and
reduce the cost of reclamation while still fully meeting all of the goals listed in the Reclamation

Plan for the surface of the Black Cloud tailing facility


The approximate area to be covered by geotextile is shown in enclosed Figure 1 Final selection
of the area involved will be determined in the field by the Colorado Division of Reclamation
Mining and Safety Project Manager

This new treatment system will be capable of treating the toe drain water for short durations of
time in the event that the pipeline to the Yak were to become unusable

For this proposed minor amendment Resurrection requests that a depression be left on the South
edge of the

tailing impoundment

and

the pump back system be

left in

place

The depression

would be used as a secondary or emergency option if the pipeline to the Yak were unusable and
if the new water treatment plant were inoperable
The depression would be approximately
14 400 square feet If this depression is used in the future pump back water would be monitored
and in no case would the water level be allowed to rise above the top of the depression
