"Atrain"meansacombinationofvehiclescomposedofatrucktractor,

"Act"meanstheCommercialTransportAct

thesametransverseplaneandthatissupportedbywheelsonwhich
orwithwhichitrevolves
"axlespread"meansthelongitudinaldistancebetweentheextreme
axlecentresoftheaxleunit
"axletrackwidth"meanstheoverallwidthofanaxleacrossthe

Permits

7.02

(1)Theminister,oranypersonauthorizedbytheminister,may,bygeneral
authorityorbytheissuanceofapermitnumberorwrittenpermit,authorize
thedrivingoroperationonahighwayofacommercialvehiclethatdoesnot
conformtotheweightanddimensionspecificationsofthisDivision,andthe
feeforthepermitisthatspecifiedintheCommercialTransportFees
Regulation.
(2)Apersonwhoisissuedapermitnumberundersubsection(1)withouta
writtenpermitmustreporttoaninspectionstationtoobtainawritten
permitatthefirstopportunity.
(3)Theministerorapersonauthorizedbyhimmay,byageneralauthority
orbyawrittenpermit,authorizethecrossingbyacommercialvehicleof
(a)ahighwayinunorganizedterritoryoranarterialhighwayin
amunicipality,or
(b)ifanofficerofthemunicipalityhasgivenwrittenapprovalto
anapplicationforcrossing,ahighway,otherthananarterial
highway,inthemunicipality,
andthefeemustbeinaccordancewiththeCommercialTransportFees
Regulation.
(4)Anydriver,operatororownerofanyvehicleorotherpersonwhoviolates
anyoftheconditionscontainedinanypermitissuedundersubsection
(1)or(3)isguiltyofanoffenceandisliable,onsummaryconviction,to
afineofnotmorethan$500ortoatermofimprisonmentnotexceeding
3months,orboth.
(5)Theministeroranypersonauthorizedbytheminister,oranypeace
officer,mayamend,varyorrescindpermitsissuedundersubsection(1)
or(3).
(6)Asaprerequisitetotheissuanceofapermitundersubsection(1)or(3),
theministermayrequiretheapplicantforthepermittodepositwiththe
ministerchargedwiththeadministrationoftheTransportationAct,ora
personactingonthatminister'sbehalf,asumofmoneyinanamount
sufficient,intheopinionofthatminister,topaythecostofrepairingany
damagethatmaybedonetothehighway,apublicstructureorabridge
byreasonofthedrivingoroperationofthevehicleonthehighway,
publicstructureorbridge.
(7)Ifthetermofthepermitissuedundersubsection(1)or(3)extends
beyondasinglejourney,theapplicantmustdeposit,onaccountofthe

feeprescribedintheCommercialTransportFeesRegulation,asumof
moneyequaltotheestimatedchargesforthepermit.
(8)Thefeetobechargedforasingletripoverloadpermitunderthe
CommercialTransportFeesRegulationmustbebasedonthetotal
numberofkilometresofoperationoftheoverloadedvehicleduringthe
termofthepermit.
(9)Anapplicantforanoversize,overloadorhighwaycrossingpermitmay
depositwiththeminister,orwithapersondesignatedbytheminister,a
sumofmoneyconsideredbytheministertobesufficienttosecurethe
paymentofthefeesforsuchpermitsasmayberequiredbythe
applicant,andtheapplicantmustpaythepermitfeeonreceiptofabill
fromtheministry.
(10)Ifanapplicantfailstopaythefeeschargedundersubsection(9),the
minister,orapersonauthorizedbytheminister,mayrefuseanyfurther
applicationsforpermits,andmaycancelanyexistingpermitsuntilthe
delinquentfeesarepaid.
(11)Apersonmustnotuseapermitforthedrivingoroperationofavehicle
otherthanthevehicleforwhichthepermitwasissued.
(12)Ifthetermofanoverloadpermitextendsbeyondasinglejourney,a
monthlyfeemustbechargedaccordingtotheCommercialTransport
FeesRegulation.
(13)ApermitorpermitnumberissuedundertheActandtheseregulations
mustbecarriedinthevehicleatalltimeswhenitisoperatingona
highway.
(14)Nopermitistransferablefromonevehicletoanother,butifavehicle
hasbeensold,destroyedorexportedfromtheProvince,asubstitute
permitcontainingthesameconditionsastheoriginalpermitmaybe
issuedwithoutfeeandvalidatedforthetermoftheoriginalpermit.
(15)Unlessexpresslypermittedbytheconditionsofapermit,apersonmust
notdriveoroperateanoversizevehicleorloadonaSundayora
generalholiday.
(16)Apersonmustnot,withoutapermitorgeneralauthorityissuedunder
subsection(1),driveoroperateavehicleorcombinationofvehicleson
ahighwayunlessthevehicleorcombinationofvehicles,includingits
load,conformstotheweight,configuration,equipmentanddimension
specificationsofthisDivision,includingAppendicesB,C,D,E,F,G,H
andI.

orbyanypersonauthorizedbytheminister,must
(a)stopthevehicleatthetimeandplacespecifiedbythe
peaceofficerorauthorizedpersonforthepurposeofweighing
thewholeorpartofthevehiclebymeansofstationaryor
portablescales,measuringthedimensionsofthevehicleand
load,measuringandinspectingthetires,inspectingtheload
carried,orforanyotherpurposeundertheActorthese
regulations,
(b)stopthevehicleifthevehicleortheloaditiscarryingis,in
theopinionofthepeaceofficerortheinspector,unsafefor
operationonthehighwaysandfixthedefectinthevehicleor
securetheload,asthecasemaybe,beforeproceeding,
(c)drivethevehicleontothenearestpublicstationaryor
portablescalesforthepurposeofweighingthevehicleand

(d)rearrangetheloadonthevehicleorremovethewholeor

(2)Thedriverofavehicleonahighway,whendirectedbyatrafficsignon
thehighwaytoreporttoscales,mustdrivethevehicleontothescales
forthepurposeofweighingthewholeorpartofthevehiclebymeansof
stationaryorportablescales,measuringthedimensionsofthevehicle
andload,measuringandinspectingthetires,inspectingtheloadcarried,
orforanyotherpurposeundertheActortheseregulations.
(3)Subsection(2)doesnotapplytothedriverofacommercialvehicleofa
licensedgrossvehicleweightnotexceeding5500kg.
(4)Ifaleaseismadeundersection13(4)oftheTransportationAct,oran
agreemententeredintoundersection66(3)oftheTransportationAct,
bytheministerchargedwiththeadministrationoftheTransportation

Nopersonshalldriveoroperateonahighwayamotorvehicleora
commercialvehicledisplayingasignindicatingthepresenceofanoversize
vehicleorloadwhen,infact,anoversizevehicleorloadisnotbeing
transportedorescorted.

(1)Apilotcarwhenescortinganoversizevehicleorloadona2laneor3
lanehighwayshallprecedetheoversizevehicleorloadatadistanceofnot
lessthan100mnormorethan500m.
(2)Whenescortinganoversizevehicleorloadona4laneordivided
highway,thepilotcarshallfollowtheoversizevehicleorloadata
distanceofnotlessthan100mnormorethan500m.
(3)Despitesubsection(1),on2,3or4lanehighwaysapilotcarrequiredfor
escorting
