PROPOSED GROUND RULES FOR YUMMY RESTO BAR CBA NEGOTIATION

I. Venue:
The official venue of the CBA Negotiation shall be held inside the School Campus of Adamson
University, unless otherwise any other place has been agreed upon during the meeting.

II. Time and Day:


Meeting shall be held once a week for four (4) hours every Wednesday starting 6:00 in the evening,
but may be extended whenever necessary.

III. Recess, Deferment of Issues and Postponement:


A recess may be called at any time by either of the parties when need arises.
Deferred issues tackled during negotiations will be dealt with in the next succeeding negotiation.
In case of postponement, the requesting party must inform the other party at least 24 hours prior to
the scheduled negotiation. But a maximum of two (2) postponements shall only be allowed for the
entire negotiation period.

IV. Panel Composition:


Union Panel will be officially composed of a maximum of five (5) duly selected from its members. In
case of vacancy in union panel members seat, the replacement must come from the list of alternate
members, who shall enjoy the same rights and privileges due to regular official panel member.
Management Panel will be officially composed of a maximum of Six (6) duly selected from its
Managers, Officers, Supervisors and or duly selected management representative. In case of
vacancy in management panel members seat, the replacement must come from the list of alternate
Managers, Officers, Supervisors and or duly selected management representative, who shall enjoy
the same rights and privileges due to regular official panel member.

V. Quorum:
Each panel must be represented by at least a majority of its members of to constitute a quorum for
official business.

VI. Agenda:

The agenda for the entire negotiation shall only be limited to the following issue/s:
Political Issues:
a) Scope of Coverage
Economic Issues:
a) Wages
b) Sick Leave, Vacation Leave and Emergency Leave benefits
c) Medicine Allowance
d) Uniform Allowance
VII. Minutes of the Meeting
The following policies be adopted to wit:
The minutes of every CBA negotiation shall be taken by a management panel designated secretary
who is acceptable to the Union panel. Tape recording of each session shall be allowed.
The minutes of the meeting shall be approved by both panels after each session.

VIII. Proper Decorum:


Proper decorum shall be strictly enforced in all CBA negotiations such as:
a) No use of foul language:
b) No shouting and uncalled for remarks:
c) A member who has the floor must not be impolitely interrupted unless allowed by the Chairman.

IX. Food, Snacks and Tape Recorder


a) Food, Snacks and shall be provided by Management and Union, unless otherwise Boss Tsip will
insist to shoulder all expenses for the entire CBA Negotiation.
b) Tape Recorder shall be provided by the management.

UNION PROPOSAL on Economic Issue

LEAVE BENEFITS. - Every employees and workers of Yummy Place Restobar employees who has
rendered at least one (1) year of service shall be entitled to;

Section 1. Sick leave - is granted to every employee and worker to provide an opportunity to recover
from illness and/or injury. Each employee and worker shall be entitled of fifteen (15) days sick leave
each calendar year with pay.

Provided, That any unused portion of said sick leave shall be cumulative and convertible to cash.

Section 2. Vacation leave - is granted to all employees and workers as scheduled. Each employee
and worker shall be entitled of fifteen (15) days vacation leave each calendar year with pay.

Provided, That any unused portion of said vacation leave shall be cumulative and not convertible to
cash.

Section 3. Emergency leave- may be granted to every employee and worker in cases of flood,
storm, earquake or other natural disaster or calamity. Each employee and worker is entitled of five (5)
days emergency leave each calendar year with pay.

Provided, That any unused portion of said emergency leave shall be cumulative and convertible to
cash.

Section 4. Sick leave, Vacation leave and Emergency leave shall be based upon the
employees/workers current rate of pay.

Section 5. Whenever any employee or worker of Yummy Place Restobar shall voluntarily resign or
be separated from the work through no fault of his own, he shall be entitled to the commutation of all
accumulated vacation leave and sick leave to his credit.

Provided, That the total vacation leave and sick leave that can accumulate to the credit of any
employee or worker shall, in no case, exceed five months.

Reasonableness of Proposal:
15 days and 5 days grant of sick leave and emergency leave to rank and file employees are
reasonable based on the Net income of Yummy Resto-Bar. (Total of 20 days convertible to cash)
20 days X 451 = Php 9,020.00/per Rank and File employees each year.
Assuming that all current rank and file employees had successfully rendered one year service.
Php 9,020.00 X 28 rank and file = Php 252, 560/year or Php 21, 046.67/mo.
For Vacation Leave, accumulation will not exceed 5 months but not convertible to cash.
