RESOLUTION
Before this Office is a complaint against herein respondent for Kidnapping for
Ransom with Murder. Based on the Joint Affidavit of Arrest made by PO1 Jefferson
Victoriano and PO1 Jeffrey Navarra, the above-named respondent was apprehended
on January 5, 2015 in a hot pursuit operation conducted by PNP members of Digos
City.
Said operation stemmed from the distress police assistance call from Michaelo
Florentino, reporting a shooting incident near Rizal Park, Digos City and the Police
Blotter made by herein complainant Miles Abil, widower of the victim Virginia Abil.
In the complaint-affidavit of Miles Abil he stated that at about 9;45 A.M. of January
5, 2015, he was informed by his helper that his wife, Virginia Abil, was being held
captive and that an unidentified man was demanding for money in exchange of
Abils safety and liberty.
In the affidavit of Michaelo Florentino, the latter recounted the events that
transpired on January 5, 2015, and stated that while he was doing his traffic duties
near Rizal Park, a taxi driver (later identified as Madriaga) informed him that his
male passenger (herein respondent) is strangling his female companion, Virginia
Abil. Thereafter, Michaelo Florentino moved towards the vehicle, but to his surprise
herein respondent pulled out a gun, and threatened Madriaga and Florentino.
Responded later transferred to the drivers seat and attempted to drove the vehicle
away, but Abil jumped out of the back door. Abil was dragged by the vehicle;
respondent halted and fired his gun twice at the back of Abil causing the latters
death.

As for the respondent, in his counter-affidavit, he vehemently denied the


accusations against him putting up denial and alibi as defenses. Respondent alleged
that Abil is indebted to him, and they agreed to meet in the morning of January 5,
2015 to settle said debt. That he never held Abil in captive and asked for ransom.
That in fact it was Abil who voluntarily accompanied him in his journey to Digos City.
That upon arriving at Digos City, a traffic enforcer in the person of Michaelo
Florentino unreasonably hailed their vehicle due to a traffic violation which he did
not commit. That on the occasion of the heated argument between the respondent
and Florentino, the latter pulled out a gun and pointed the same to the respondent.
That the respondent pushed the door of the vehicle that caused Florentino to lost
his balance while pulling the trigger, causing it to hit Abil.
Based on the set of circumstances above, there is reasonable ground that the crime
of Kidnapping for Ransom with Murder has been committed and that the accused is
probably guilty thereof; and he should be held for trial;
WHEREFORE, premises considered, the undersigned finds probable cause against
the respondent and it is hereby recommended that, upon approval of the Provincial
Prosecutor, an Information for for Ransom with Murder under Art. 267 of the RPC as
amended by RA 7659 be filed against Uriel Pieter Pabalan in the Regional Trial Court
of Digos City, Davao del Sur.
SO RESOLVED AND RESPECTFULLY SUBMITTED.
