CONTRACT OF SERVICES

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Services is entered into by and between:
COASTLAND CONSTRUCTION AND DEVELOPMENT CORPORATION, a
corporation duly organized and existing under and by virtue of the laws of the Republic of
the Philippines with principal place of business located at 9 Voyager St., Doa Vicenta
Village, Davao City, herein represented by its President, MANUEL S. GONZALEZ, hereinafter
referred to as the FIRST PARTY;
- and
NR EUSTAQUIO ENTERPRISES, INC., a corporation duly organized and existing
under and by virtue of the laws of the Republic of the Philippines with principal place of
business located at __________________________________, herein represented by its
President, ___________________________, hereinafter referred to as the SECOND
PARTY;
WITNESSETH:
WHEREAS, FIRST PARTY is a company engaged in the construction business;
WHEREAS, FIRST PARTY is in need of the services of a surveyor to conduct
construction staking for its project located at Lavigan, Davao Oriental;
WHEREAS, SECOND PARTY has licensed surveyors and the capacity to perform the
services needed by FIRST PARTY;
WHEREAS, FIRST PARTY desires to engage the SECOND PARTY to perform the
survey and construction staking and SECOND PARTY is willing to perform such services;
NOW, THEREFORE, in consideration of the above recitals and the mutual promises
and conditions contained in this Contract, the Parties agree as follows:
I.

SCOPE OF WORK
Surveying and staking of the entire length of the project traversing from KO
1821+222.104 to KO 1827+914.00 to produce an as-staked plan based on the plans
prepared and approved by the Department of Public Works and Highways (DPWH).

II.

DELIVERABLES
1. As-staked plan, per format and scheme of the original plans prepared and
approved by the DPWH for easy comparison. As-staked plan shall be based on
the data gathered on the conduct of survey. 1 set of As-staked plan shall include
traverse, plan details & profile, and cross sections. 1-set of complete As-staked
plan must be plotted on tracing paper. Also, a soft copy (editable AutoCAD file) of
the As-staked plan shall be produced by the Second Party for the First Party.
2. Computations of data with clear comparison to the computed data in the plans
prepared and approved by the DPWH. Computations shall be based on the data
gathered on the conduct of survey. 1-set of Computations must be printed on
paper. Also, a soft copy (editable MS-Excel file) of the Computations shall be
produced by the Second Party for the First Party.
3. Physical staking of the project indicating markers including but not limited to blue
top markers and other vertical and horizontal controls, including centerlines of
Road only (at 20-meter Stations) within Project Limits.

III.

COMPENSATION
The SECOND PARTY shall be entitled to compensation in the amount of ONE
HUNDRED SEVEN THOUSAND PESOS (107,000.00) and shall be paid according
to the following terms, to wit:
A. A down payment of 20% of the contract price or 21,400.00 shall be paid upon
engagement of work;

B. Balance of 85,600 shall be paid upon completion of the following deliverables:

WORK PROGRESS/TIME TABLE

SECOND PARTY must accomplish the deliverables within the following periods, to wit:

11 days after 1st Mobilization

B. Deliverable 3

4 days after 2nd Mobilization

REASONABLE DILIGENCE
SECOND PARTY shall use reasonable diligence to promptly perform the services
described herein and to meet any delivery dates or project deadlines agreed to by
the Parties and to provide services that are in compliance with agreed specifications
and project parameters. All services shall be provided in a professional and
competent manner and in compliance with industry standards and by qualified and
experienced personnel.
SECOND PARTY represents and warrants that it has no current commitments or
obligations that will conflict with or otherwise interfere with or impede the
performance of the services called for under this Contract.

VI.

GOVERNING LAW
Any controversy or dispute between the Parties involving the application or breach of
any of the provisions of this Contract shall be governed by the applicable laws of the
Republic of the Philippines and shall be brought to appropriate tribunals or offices
exclusively within the City of Davao.

IN WITNESS WHEREOF, the parties hereto set their hands this _____ day of
