1.0

Terms of Tender and Tender Overview

1.1

Definitions

1.1.1

In this Invitation to Tender words and expressions shall have the meanings set out in Sections
T1, T2, C1, C2, C3 and C4

1.2

Terms of Tender

1.2.1

The terms and conditions applicable to this Tender Process are detailed in Sections T1, T2, T3.

1.2.2

In receiving the Tender Documents, Tenderer is deemed aware of and confirms acceptance and
adherence to Section T2 including the confidentiality agreement included therein. If only T1 has
been issued to Tenderer, this provision shall only apply as of Tenderer receipt of Section T2.

1.3

Contract Objective & Period

1.3.1

The objective of this Tender Process is to award a Contract for a period of 22 months Amal
Heat Recovery System Generator (HRSG)-1 Project.

1.4

Scope Description

1.4.1

Contractor shall carry out Engineering, Bulk Procurement, Construction and Commissioning for
the completion of Amal Heat Recovery Steam Generator (HRSG)-1 project.

1.4.2

Brief description of scope of work is as below:

Install a new HRSG at the back of Amal Power station gas turbine. The HRSG will have
capability of producing 6000 tons of steam per day (annual average steam). The HRSG,
Pumps and DCS will be procured and free-issued by PDO.

Install high pressure feed water pumps, instrument air compressors and associated
electrical switchgears systems.

Construct utility building to house the electrical switchgears and controls systems (DCS,
IPS, etc.). Switchgears, UPS, Intrument Air compressors & piping shall be procured by EpC
contractor.

Civil and mechanical work associated with the above.

1.4.3

Details of Scope of Work is described in Section C-4 of this tender document.

1.5

Pricing Mechanism

1.5.1

The Tender is issued based on All-Inclusive Lump Sum Rates for the defined scope of work with
Rate structure, milestones and key penalties and incentives.

1.6

Company Provisions

1.6.1

Company shall provide Contractor with only those Materials specifically stated as such in Section
C4, Scope of Work. Contractor shall include in the Contract Price for supply of all other
temporary and permanent Materials required to complete the Work.

1.7

Technical Requirements

1.7.1

Bidders shall refer to Section T3 for the Technical Requirements.

2.0

2.1.1

All Clarification Requests shall be in writing and shall be addressed to the Company Contract
Engineer [Mohd. Farid Ibrahim, FPO39, Email : Mohd.MI.Ibrahim@pdo.co.om]. No
Clarification Requests shall be entertained after the Clarification Request Closing Date included
in the table in Article 3 below.

2.1.2

In order to correctly identify Tenderer and Tenderers point of contact for this Tender Process,
Tenderer shall complete Appendix 1 herein and return this Appendix to the Company Contract
Engineer at the e-mail address included above within seven (7) days from receipt of this
Invitation To Tender.

3.0

Outline Tender Process and Submission of Tender

3.1.1

Tenderers Technical and Commercial Tenders shall be submitted together, but in individually
sealed separate packages. The opening of the Technical Tender shall be subject to Tenderer
submitting the lowest Commercial Tender. If the lowest Tender is technically disqualified, the
second lowest Commercial Tender shall be technically evaluated, and so on.

3.1.2

3.1.3

Tenders shall be delivered no later than 11:30 a.m. on the Tender Submission Date.

3.1.4

All Clarification Requests regarding this Tender shall be submitted by Tenderer in the format as
included in Appendix 2 herein. The Clarification Requests as well as the Clarifications and
Addenda will be confirmed by Company to all Tenderers in writing using the same file.

4.0

Tender Collection

4.1

Collection of Tender documents

4.1.1

Once the Tenderer Data Sheet requested in Article 2.1.2 has been received, the Tender
Documents (in CD format) can be collected from Company's Mina-Al-Fahal offices, Contracting
& Procurement building, room 038. A gate pass may be obtained by sending an e-mail to
the Company Contract Engineer at least 24 hours prior to the intended visit, stating Tenderers
name, name of the personnel and the date/time of the required entry.

4.1.2

Tenderer shall confirm receipt of all the Tender Documents by return e-mail within 5
working days from receipt.

5.0

Site Visit/ Bid Clarification Meeting

5.1.1

It is mandatory that Tenderer attends the Site visit/ Tender Documents clarification meeting
with a maximum of 3 representatives on the date given in the table in Article 4 above. Details
of the attendees must be submitted to the Company Contract Engineer by 01.11.2011. All
visitors must provide and wear required safety equipment during the Site visit.

6.0

Tender Award

6.1.1

In the event that Company considers Tenderer to be commercially a potentially successful

competitor for the award of the Contract, Company may subject Tenderer to a further technical
and financial evaluation. Only when a Tenderer satisfies Companys technical, financial and
commercial requirements will a Contract be awarded.
