MEMORANDUM OF AGREEMENT TO BE ENTERED INTO BY AND AMONG
THE DEPARTMENT OF TOURISM XI, THE DEPARTMENT OF PUBLIC
WORKS AND HIGHWAYS-XI AND THE CITY GOVERNMENT OF DAVAO
RELATIVE TO DOT-DPWH CONVERGENCE PROGRAM FOR THE PROJECTS
TO BE IMPLEMENTED BY DPWH REGIONAL OFFICE XI INCLUDED UNDER
FY 2014 GAA.
Background
1. This pertains to the memorandum of agreement to be entered into by and among the
Department Of Tourism XI, the Department Of Public Works And Highways-XI And the City
Government Of Davao relative to DOT-DPWH Convergence Program for the projects to be
implemented by DPWH Regional Office XI included under FY 2014 GAA.

Highlights
2. This is a tripartite agreement to be entered into among the Department of Tourism XI (the DOT
Regional Office XI, for brevity), the Department of Public Works and Highways-XI (the DPWHRegional Office XI, for brevity) and the Local Government Unit of the City of Davao (Office of the
City Mayor, for brevity.)
3. The DOT and the DPWH are currently implementing the DOT-DPWH Convergence Program for
Tourism Road Infrastructure Project Prioritization (TRIPP), also known as the Tourism Road
Convergence Program a Joint undertaking of the identification, evaluation, prioritization, and
provision of tourism infrastructure which includes local road projects in priority tourist
destination areas in the Philippines in support of the goals and targets of the National Tourism
Development Plan (NTDP) and the Philippine Development Plan (PDP.)
4.
The MOA covers the hereunder local road projects within the jurisdiction of the LGU and
included in the DOT-DPWH Convergence Program for Fiscal Year 2014.

The parties have agreed cooperate with respect to the following areas in undertaking
the local road projects:
A. Implementation of the local road projects, including pre-construction and
construction/improvement works/activities.
B. Maintenance of the completed

C. Monitoring and evaluation (M&E) of the local road projects, covering their outputs
(physical works) and outcomes (impact).

6. During the committee hearing, Lisette Marquez from the City Tourism Office clarified
that its role deals more on the initial planning in the monitoring and evaluation of the
local roads. It is tasked to endorse and validate the roads to be included in the program.
Thus far, it has validated and endorsed twenty-three (23) roads. (see attachment for the
list of the validated roads)
7. Alfredo Caballero of the DPWH District Office stated that the DPWH is the
implementing agency. However, after the construction of the road is done, it must issue
a Certificate of Turnover and Acceptance to the local government unit.
8. This project is on-going. The different government agencies have been collaborating
since they started the project.

Recommendations
In lieu of the aforementioned facts, this Committee recommends the approval of this
legislative item. The Committee further recommends the passage of a resolution entitled
A Resolution To Enact An Ordinance Granting Legislative Authority To City Mayor Rodrigo
R. Duterte To Sign For And In Behalf Of The City Government Of Davao the Memorandum
of Agreement to be Entered into among the Department Of Tourism XI, the Department
Of Public Works And Highways-XI And the City Government Of Davao relative to DOTDPWH Convergence Program for Tourism Road Infrastructure Project Prioritization
(TRIPP)

AND THE CITY GOVERNMENT OF DAVAO RELATIVE TO DOT-DPWH

WHEREAS, this pertains to the resolution to enact an ordinance granting
legislative authority to the City Mayor to and sign for and in behalf of the City
Government of Davao the Memorandum of Agreement to be Entered into among
the Department Of Tourism XI, the Department Of Public Works And Highways-XI
And the City Government Of Davao relative to DOT-DPWH Convergence Program
for Tourism Road Infrastructure Project Prioritization (TRIPP);
WHEREAS, this is a tripartite agreement to be entered into among the
Department of Tourism XI (the DOT Regional Office XI, for brevity), the
Department of Public Works and Highways-XI (the DPWH-Regional Office XI, for
brevity) and the Local Government Unit of the City of Davao (Office of the City
Mayor, for brevity);
WHEREAS, the DOT and the DPWH are currently implementing the DOT-DPWH

WHEREAS, the parties have agreed cooperate with respect to the following areas

C.
Monitoring and evaluation (M&E) of the local road projects,

WHEREAS, the City Tourism Office clarified that its role deals more on the initial
planning in the monitoring and evaluation of the local roads. It is tasked to
endorse and validate the roads to be included in the program. Thus far, it has
validated and endorsed twenty-three (23) roads;
WHEREAS, the funds on road concreting shall be released after the title being
transferred in the name of City Government of Davao;

WHEREAS, the DPWH is the implementing agency.


However, after the
construction of the road is done, it must issue a Certificate of Turnover and
Acceptance to the local government unit;
WHEREAS, this is an on-going project. The different government agencies have
been collaborating since they started the project.
WHEREAS, there is a need that a Resolution be passed to enact an Ordinance
authorizing the City Mayor to sign for and in behalf of the City Government of
Davao, the Memorandum of Agreement to be Entered into among the Department
Of Tourism XI, the Department Of Public Works And Highways-XI And the City
Government Of Davao relative to DOT-DPWH Convergence Program for Tourism
Road Infrastructure Project Prioritization (TRIPP);
NOW THEREFORE, be it resolved as it is hereby resolved to enact an ordinance
granting legislative authority to the City Mayor Rodrigo R. Duterte to sign for and
in behalf of the City Government of Davao the Memorandum of Agreement to be
Entered into among the Department Of Tourism XI, the Department Of Public
Works And Highways-XI And the City Government Of Davao relative to DOT-DPWH
Convergence Program for Tourism Road Infrastructure Project Prioritization
(TRIPP);
RESOLVED FURTHER, that copies of these resolutions to be enacted be
furnished to the Office of the Secretary to the Sangguniang Panlungsod, City
Mayors Office, the DPWH, the DOT and all other offices/departments concerned,
for their information and guidance.

AN ORDINANCE GRANTING LEGISLATIVE AUTHORITY TO THE CITY MAYOR


RODRIGO R. DUTERTE TO SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT
OF DAVAO THE MEMORANDUM OF AGREEMENT TO BE ENTERED INTO AMONG
THE DEPARTMENT OF TOURISM XI, THE DEPARTMENT OF PUBLIC WORKS AND
HIGHWAYS-XI AND THE CITY GOVERNMENT OF DAVAO RELATIVE TO DOT-DPWH
CONVERGENCE PROGRAM FOR TOURISM ROAD INFRASTRUCTURE PROJECT
PRIORITIZATION (TRIPP.)
Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled
that:
SECTION 1. TITLE This ordinance shall be known as AN ORDINANCE GRANTING
LEGISLATIVE AUTHORITY TO CITY MAYOR RODRIGO R. DUTERTE TO SIGN FOR AND IN
BEHALF OF THE CITY GOVERNMENT OF DAVAO THE MEMORANDUM OF AGREEMENT TO BE
ENTERED INTO AMONG THE DEPARTMENT OF TOURISM XI, THE DEPARTMENT OF PUBLIC
WORKS AND HIGHWAYS-XI AND THE CITY GOVERNMENT OF DAVAO RELATIVE TO DOTDPWH CONVERGENCE PROGRAM FOR TOURISM ROAD INFRASTRUCTURE PROJECT
PRIORITIZATION (TRIPP.)
SECTION 2. DECLARATION OF POLICY - Section 455, (b) (1) (vi) of the Local
Government Code provides, to wit:
For efficient, effective and economical governance the purpose of
which
is the general welfare of the city and its inhabitants pursuant to Section 16
of this Code, the city mayor shall represent the city in all its
business
transactions and sign in its behalf all bonds, contracts, and
obligations,
and such other documents upon authority of the
Sangguniang Panlungsod
or pursuant to law or ordinance;
SECTION 3. MEMORANDUM OF AGREEMENT This is a tripartite agreement to
be entered into among the Department of Tourism XI, the Department of Public Works
and Highways-XI and the Local Government Unit of the City of Davao. The DOT-DPWH
Convergence Program for Tourism Road Infrastructure Project Prioritization (TRIPP), also
known as the Tourism Road Convergence Program is a joint undertaking of the
identification, evaluation, prioritization, and provision of tourism infrastructure which
includes local road projects in priority tourist destination areas in the Philippines in
support of the goals and targets of the National Tourism Development Plan (NTDP) and
the Philippine Development Plan (PDP.)
SECTION 4. AUTHORITY The City Mayor Rodrigo R. Duterte is hereby granted
legislative authority to sign, for and in behalf of the City Government of Davao the
memorandum of agreement to be entered into among the Department Of Tourism Xi, The
Department Of Public Works And Highways-XI and the City Government Of Davao relative
to the DOT-DPWH CONVERGENCE PROGRAM for TOURISM ROAD INFRASTRUCTURE
PROJECT PRIORITIZATION (TRIPP.)
SECTION 5. SEPARABILITY CLAUSE If for any reason, any section or provision
of this ordinance is declared unconstitutional or invalid, other sections or provisions
hereof not affected by such declaration shall continue to be in full force and effect;
SECTION 6. EFFECTIVITY
immediately upon approval.
