to be my Last W i l l and Testament, hereby revoking any and a l l wjill

or w i l l s by me at any time heretofore executed.

I f i r s t d i r e c t that my executor as h e r e i n a f t e r named
s h a l l pay a l l of my j u s t debts, i n c l u d i n g the expenses of my l a s t
sickness and f u n e r a l .

Item I I I
I give and devise to my two sons, share and share
a l i k e , the remainder fee t i t l e to a l l of my r e a l e s t a t e , a f t e r the
death of my husband. My sons being Richard E. Thayer & Roger D. Thayer.
Item IV
In the event that my s a i d husband does not survive
me, or i n the event that we both should die i n a common d i s a s t e r
so that i t i s not p o s s i b l e to a s c e r t a i n which of us predeceased
the other, the above bequest to my husband i s hereby c a n c e l l e d ,

and i n that event, I g i v e , d i v i s e and bequeath a l l of s a i d residue

of my estate,, share and share a l i k e , to my two c h i l d r e n who are
Richard E. Thayer and Roger D. Thayer.
Item V
To carry out the terms of t h i s , my Last W i l l and
Testament, I hereby nominate as executor, my husband, Berhie E.
Thayer, and I request that he be appointed and permitted to
q u a l i f y and serve without being required to post any bond.

testament of Marjorie M. Thayer, deceased, was filed with the clerk. No petition
for the probate of this purported will has been filed and the Court is advised that
more than 30 days have passed since the death of Marjorie M. Thayer. The
Court FINDS that an order should issue pursuant to Section 633.289 of the Iowa
Code.
IT IS THEREFORE ORDERED:
1. The clerk is directed to publicly open the purported will of Marjorie M.
Thayer.
2. The clerk shall notify the executor named in the purported will and all
