EDITOR

ou may have noticed a few changes to the masthead of the November

issue of Coatings World. Most notably is the absence of Tim Wright,
Coatings Worlds editor. Tim has left Coatings World to take a position
at another publication within our company. Tim has done a wonderful job
throughout his time at Coatings World and will certainly be missed. Longtime readers of Coatings World will probably recognize my name as the associate editor. I have spent more than a decade learning about this dynamic
industry and attending many conferences and technical events, including The
American Coatings Show, The European Coatings Show and ChinaCoat. I
look forward to providing our readers with the most relevant and up-to-date
content on the issues that matter the most to you.
This month we take a look at The Exterior Architectural Coatings Market beginning on page 32. Exterior architectural coatings manufacturers I
interviewed reported a slow but steady uptick in housing sales for 2012, resulting in a slight improvement over the prior year. Whether this trend will
continue in 2013 remains to be seen. The Adhesives and Sealants Market beginning on page 36 takes a look at the latest technologies and products being
brought to market.
As this issue goes to press, we are wrapping up the final preparations
for ChinaCoat 2012. Be sure to stop by the Coatings World booth if you are
planning on attending ChinaCoat November 28-30 in Guangzhou. The
Coatings World staff will be onsite reporting live from the Guangzhou International Convention and Exhibition Center. If you are not able to attend
this key event, be sure to sign up for our e-newsletter at www.coatingsworld.com. We will be sending out daily e-mails to bring the latest ChinaCoat news right to your desk.

Valspar announces expansion of

its R&D campus in Minneapolis

The Valspar Corporation has announced

plans to expand its research and development campus and renovate its former
headquarters building, located in downtown Minneapolis, Minnesota. This
world-class environment for developing
industry-leading coatings technologies
and applications further demonstrates
the companys commitment to growth
and innovation, the company reported.
The project will also create up to 135
full-time jobs over the next two years, including high-paying roles in the material
sciences. Valspar is investing $30 million
in the project, which will add 87,000
square feet of laboratory, meeting and office space. The project is expected to be
completed in early 2014.
Expanding our Minneapolis R&D
center is a prime example of Valspars
global leadership in coatings innovation
and technology, said Gary Hendrickson, chairman and chief executive offi-

cer of Valspar. We will devote more resources toward developing differentiated

coatings technologies to address the
changing needs of our customers. Our
scientists and researchers will have access to a best-in-class facility to more

The Minneapolis campus is the anchor of the companys research and development
network
worldwide,
collectively called the Valspar Applied
Science and Technology Centers (VAST).
The company operates a second flagship
R&D facility recently opened in
Guangzhou, China as well as more than
three dozen smaller laboratories around
the world. Together, these facilities enable
Valspars research and development

internships and equipment sharing, including the University of Minnesota.
Expansion of the VAST center affirms Valspars commitment to advance
the scientific foundation in the coatings
industry and apply technical principles to
deliver innovation and value, said Cynthia Arnold, senior vice president and
chief technology officer for Valspar. The
expanded campus will enable research
and development at the highest level as

customer and supplier collaboration for
new coatings technologies.

PPG Industries releases its

annual automotive color
popularity and trend data

While white retained the leading spot as

the most popular car color based on
2012 automotive build data, PPG forecasts that the overall use of color is on
the rise.
According to PPGs annual survey of
global color popularity, white ranked
first (22%) and silver was second
(20%), followed by black (19%),
gray (12%), red (9%), natural
(8%), blue (7%), green
(2%) and other colors
(1%).
Color is one of the
first characteristics noticed in product design,
and
it
is
increasingly
being
used in everyday
items,
from
cell
phones to large appliances, based largely
on automotive trends,
said Jane E. Harrington, PPG manager,
color styling, automotive OEM (original

equipment manufacturer) coatings. The palette being developed for the automotive
segment continues to be influenced by culture, nature, fashion, interior
design, color popularity and new pigment technology.
During this years annual Automotive
Color Trend Show held at PPGs offices
in late September, the coatings company
presented its ideas for future vehicle colors to leading global automobile manufacturers. Titled Perspective, the 2012
show presents PPGs unique viewpoint
and angle on color direction, using insight from all the companys businesses
that color items such as laptop computers, homes, buildings, airplanes, ships
and heavy equipment.
PPGs internal network of more than
20 color experts and six color styling laboratories around the world keep our
company in the vanguard with color
trends, Harrington said. This global
perspective on multiple end-use markets
gives PPG unique color expertise that is
unmatched in the industry. No coatings
company colors more types of surfaces
than PPG.
PPG presented 64 new exterior shades
to automotive designers for consideration in designs of the 2015-2016 model
years. These included colors such as: Al
Fresco, a silver metallic with fresh green
tint; Victoria Grey, a classic gray with an
iridescent highlight of gold metal; Opulence, a refined red pearl with intense
jewel tone; Glacier, an icy graphite gray
with a slight violet blue tone; Sunshine, a
bright high-sparkle intense yellow; and
Elixir, a metallic mixture of silver and
magenta.
Our consumer research has clearly
shown that color is critically important
to car buyers, Harrington said.
A 2011 survey of automotive consumers by PPG revealed that:
77% of respondents said exterior color
was a factor in their automotive purchase decision.
Owners of large luxury cars, sporty
cars and large premium SUVs place the
most value on getting the color of their
choice.
12 | Coatings World

45% of respondents said they would

prefer a wider range of color choices.
In addition to color trend forecasting,
PPG continues to develop paint technologies that offer automotive design options for enhancing appearance and
helping automobile manufacturers differentiate their brands, according to Harrington. For example, metallic flake
effects have become increasingly popular.
A classic color such as blue can be updated with a high-sparkle glass flake or
a fine bright aluminum to create more of
a liquid or silk appearance, she said.
Regional details regarding PPGs
2012 automotive color popularity data
included:
In North America, white ranks first
(21%), followed by black (19%),
silver and gray (16% each), red
(10%), blue (8%), natural (7%) and
green (3%).
In Europe, white is also most popular (23%), followed by black (21%),
gray (17%), silver (13%), blue, natural and red (7%), other colors
(3%) and green (2%).
In the Asia Pacific region, silver and
white tied for most popular (23%
each), followed by black (19%),
natural (10%), red (9%), gray (8%),
blue (7%) and green (1%).

AkzoNobel reveals Indigo

Night as 2013 Color of the Year
AkzoNobel unveiled its 2013 Color of
the Year, Indigo Night. The rich blue shade
was determined by the company through a
study of social and economic trends from
around the globe. Last year, AkzoNobel
selected a red Terra Cotta Rose as the
years signature hue, reflecting possibilities
and take-charge optimism.
The first to author a comprehensive, researched and global-based study of color
trends, AkzoNobel said Indigo Night suggests maturity and elegance. The regal,
tranquil and introspective hue also conveys a sense of trust and authority. Within
a color palette, indigo is versatile, pairing
well with bright colors of a similar saturation level, citrus colors or warmer neutrals,
as well as other blues, purples and greens.
www.coatingsworld.com

Indigo Night is a stunning color

that can be applied to many areas
within the home, said Barbara Richardson, director of North American color
marketing for AkzoNobel, makers of
Glidden paint. Even used in small
ways, Indigo Night makes a bold and
confident statement, whether its featured in an entryway, place of study, or
as a pop of color on furniture, such as
the inside of bookshelves.
AkzoNobels Color of the Year is a result of ongoing color trend research and
analysis by creative experts from around
the world. Once a year, the AkzoNobel
Global Aesthetic Center, based in Amsterdam, invites an international group of
experts in the fields of design, architecture and fashion to discuss and determine
key color trends for the coming year. Industry authorities from different parts of
the world, including Asia, North America, South America and Europe, draw on
a variety of cultural influences such as
fine art and technology, as well as social
and economic trends.
A year-long process, themes and insights from the global conference are
translated into a color forecast and
palettes, captured in the company's cornerstone ColourFutures publication.
This color trend book is distributed to
multiple audiences including home designers, artists and architectural firms.
The comprehensive guide includes the
Color of the Year, which will span across
AkzoNobel's global markets, along with
an overarching color concept for 2013
and five trends.
Richardson said the dominant concept
of 2013 is Connections, the way things
interconnect to create networks, dialogue
and innovation. There are five related
trends and color palettes highlighted in
this years ColourFutures book:
Collective Passion
This trend revolves around the power of
social media, which has created new,
spontaneous ways to connect and share
ideas. The color palette, with attentiongrabbing pastels combined with chalk
whites and warm greys, swoops from one
color cloud to the next, with distinct
groups flowing together.

The Art of Understanding

Representing a sense of curiosity and

with laid back neutrals.

Visual Solace
This theme revolves around the beauty of

Sherwin-Williams donates
paint supply certificates to
Keep America Beautifuls
graffiti prevention program
Keep America Beautiful, Inc. (KAB) has
announced the winners of the 2012 Graffiti Hurts Grant Program. This year, KAB
provided four $2,500 cash grants as well
as two $2,500 paint supply certificates
from The Sherwin-Williams Company.
Q-Star also provided a FlashCAM, valued at $6,100, to one deserving recipient.
The FlashCAM is a deterrent system effective in preventing illegal trespassing
during hours it most often occurs.
The recipients of this years Graffiti
Hurts Grant Program remind us how
powerful volunteer action can be in solving a communitys challenges, said
Matthew McKenna, president and CEO
of Keep America Beautiful. Were grateful to The Sherwin-Williams Company
for its ongoing support of the Graffiti
Hurts program, a nationwide resource
for addressing graffiti problems.
Responding to the blight of graffiti
vandalism, the Graffiti Hurts program
was developed in 1996 through a partnership between Keep America Beautiful,
the nations largest nonprofit education
and volunteer action organization, and

The Sherwin-Williams Company, maker

of Krylon paint. The Graffiti Hurts
Grant Program was initiated in 2007. According to the U.S. Department of Justice, graffiti contributes to lost revenue
associated with reduced ridership on
transit systems, reduced retail sales and
declines in the value of surrounding residential and commercial property.
The Graffiti Hurts Grant Program
provides an opportunity to raise awareness of the attendant costs of graffiti
vandalism and the creative solutions that
these local partners employ to eradicate
blight, said Harvey Sass, president and
general manager, Diversified Brands Division, The Sherwin-Williams Company.
Sherwin-Williams is very proud to lend
support for these award-winning local
initiatives.

ACA holds Marine Coatings and Additives Conferences in Baltimore

The American Coatings Association held its annual International Marine and Offshore Coatings Conference September 11-12
at the Sheraton Inner Harbor in Baltimore, Maryland. The conference featured
a variety of presentations from marine coatings manufacturers like Jotun to
suppliers such as Dow Chemical, as well as regulatory issue updates.
The Marine Conference commenced with a keynote address, Whats New
in Antifouling, presented by Mark Ingle of NAVSEA. Ingle discussed updates
in anti-fouling at NAVSEA and gave information on qualifying copper-free biocidal coatings, in-process task for advanced foul-release coatings, plans to coat propellers and determine if fuel savings can be
measured and additional changes to anti-fouling specifications.
NAVSEA is seeking ideas from the ACA for coatings and processes that will reduce total ownership costs from all sources.
Ingle said. Anti-fouling coatings need to enhance fuel economy. Underwater hull fouling results in 40% increase in drag and
10%-20% increase in fuel. He went on to discuss some environmental drivers of change and interest in second-generation products that will help NAVSEA meet its needs.
The ACA also held its Additives 2012 Conference September 12-13 at the same venue in Baltimore. This conference provided
coatings industry professionals with innovative additive technology and concepts that are commonly utilized to improve coatings performance.

Fresh Paint

The competition is being conducted by the Paint Quality Institute (PQI), an informational
entity whose mission is to educate the public about quality paints and
coatings.
The finalists are a diverse lot, including communities both large and small, located on the coasts and in the heartland,
some with long histories and others relatively new. But all have one thing in common: They have beautified themselves
with exterior paint.
For purposes of our
competition, a prettiest
painted place is a very
special town or neighborhood with exceptional
community-wide curb
appeal due to visually
appealing or very creative use of exterior paint
color, explained Debbie
Zimmer, paint and color
expert for the Paint
Quality Institute.
Curb appeal is often
defined by beautiful
color schemes on homes
or buildings, and thats
typically the case, but exquisite outdoor murals
and creative use of paint
color on statues, signage,
traffic signals, water towers and even streets and
sidewalks have elevated the appearance
of many of todays prettiest communities,
including some of our finalists she said.
PQI began its search for the prettiest
painted places by contacting state departments of tourism, convention and visitors
bureaus, chambers of commerce, historical
societies and Main Street programs in all
50 states. Eventually, nearly 200 towns and
neighborhoods were nominated in the
competition.
Judges with expertise in color selection, exterior painting and home improvement then reviewed the entries and
narrowed down the field to the 60 finalists. Later this month, after further evaluation and another round of judging,
two of the 10 finalists in each of the six
regions will be named the 12 prettiest

painted places in America.

This is the third time the Paint Quality Institute has conducted a search for
the prettiest painted places in America. It
held the first competition in the 1990s,
and another in 2000.
According to Zimmer, the purpose of
the competition is to give recognition to
places that use paint to express pride in
their communities, and highlight how an
attractive exterior paint treatment can
enhance the curb appeal of virtually any

ciency and sustainability by setting the

very highest performance and environmental standards, reducing fuel consumption and emissions thanks to
innovative on-board technology, the
company reported.

PPG Aerospace special-effect coatings bring

Virgin Atlantic Airways livery to life

Special-effect coatings by PPG Industries aerospace coatings group enabled

Virgin Atlantic Airways to have the
unique reflectivity and bright, vibrant
color the airlines design and engineering
teams wanted for its new livery, according to the company. The airline has taken
delivery of the first new aircraft an Airbus A330 painted with Desothane topcoats by PPG Aerospace colored with
Andaro special-effect pigment. The proprietary PPG pigment was used in coatings that create the red tail and engines
and the aubergine Virgin Atlantic lettering across the aircraft. The fuselage is
painted with Desothane topcoats in
high-sparkle silver mica.
Traditional mica aircraft coatings
have approximately 30% reflectivity,
while coatings with Andaro pigment reflect approximately 90% of visible light,
according to Alex Reid, PPG Aerospace
account manager at the North Europe
application support center in Shildon,
England.
Virgin Atlantics design team came to
PPG with a vision for the coloring. Reid
and the PPG Aerospace coatings team

Protective Coatings for Oil and Gas Pipelines in

Russia Thriving

There is a protective
coatings segment
coatings for oil and
gas pipeline in
Russia and the rest
of the Soviet Union
that is buoyant.

24 | Coatings World

by Sean Milmo
European Correspondent
milmocw@rodpub.com
emand for protective coatings in the European Union has been weakened by the
downturn in EU manufacturing due to
the euro crisis. But there is a protective coatings
segmentcoatings for oil and gas pipelinefurther east in Russia and the rest of the former Soviet Union (SFU) that is buoyant at the moment.
The need for piped natural gas from Russia,
which account for a large share of gas consumption in the EU has been declining in Western Europe due to its economic difficulties. But new steel
pipelines are still being built across Russia into the
EU in anticipation of a owing long-term requirement for gas.
The two strings of the Nord Stream pipeline
with a capacity to transport 55 billion cubic meters of Russian via the Baltic Sea has just been inaugurated. But already the consortium behind the
project is negotiating the construction of a third
and fourth string, one of which will be used to
transport gas direct to the UK. Furthermore,
China is seeking gas supplies from Russia and
from the Central Asian Republic like Kazakhstan
and Uzbekistan. This will necessitate the construction of more gas pipelines.
Another attraction of the Russia market is
that it needs to renew parts of its vast pipeline net-

www.coatingsworld.com

work, some of which are over 40 years old, explained Henry Tausch, senior vice president for
Europe at U.S.-based Bredero Shaw, the worlds
leading pipeline coater, which formulates its own
coatings. Also, sometime probably in the next 3 10 years Russia will need pipelines to transport
oil and gas from reservoirs in the Artic.
Russia alone is estimated to account for
more than 20% of 400,000 tons of global demand for pipeline coatings materials. Gas output from Russia and the remainder of the FSU
amounts to 40% of the worlds total.
Average growth in demand for oil and gas
pipeline coatings is approximately 5-7% at the
moment with the driving force coming from
pipeline projects, said Noru Tsalic, a consultant
at Applied Market Information (AMI), a market
research company in Bristol, England.
Some observers believe that the growth rate is
even higher because of the amounts of coatings
required for the maintenance and upgrading of
Russias extensive network of gas and oil steel
pipelines.
Gazprom, the countrys major gas producer,
has a network of approximately 170,000 kilometers of gas transmission systems and Transneft,
which is responsible for oil distribution, has approximately 50,000 km of pipelines. The Russian
government wants a more efficient gas transport
system to reduce costs by increasing gas flows.
The demand for coatings for repair and rehabilitation purposes is probably pushing the growth
rate into double digit figures, said Alexey
November 2012

Europe

Khomich, AkzoNobels Russian sales manager for protective coatings.

Pipeline coatings suppliers to the Russian market are mostly foreign multinationals with experience of the global oil
and gas industry.
There are around 4-6 major pipeline
manufacturers in Russia but they use coatings made by Western companies either in
Russia or imported, said Khomich.
Also, a large proportion of pipes are exported into Russia by Western European
pipe makers who develop their own coatings formulations or are supplied by coatings producers. In addition there are
international specialist coaters operating in
Russia who apply their own formulated
coatings to pipes, often at the location of
the pipeline. Hempel of Denmark, 3M
Corp. and PPG Industries are among multinational pipeline coatings producers active
in Russia while coatings raw material suppliers include LyondellBasell Industries,
Dow Chemical and Bayer MaterialScience.
Among the coaters Bredero Shaw has
been expanding in Russia through a JV
with a Russian offshore pipeline contractor
with the opening of a concrete coating
pipeline facility at Arkhangelsk in the
northwest of the country.
Jotun of Norway, which is already a
leader in the pipeline coatings market in the
Middle East with a 30% share, has just
started constructing a factory at Fedorovsky Industrial Park in Leningrad Region for liquid and powder coatings. The
plant, which is scheduled to be opened in
early 2014 will provide a platform for
Jotun to make inroads into the Russian
pipeline sector.
We expect sales to grow for powder
coatings applications (in Russia), particularly in the area of pipe coatings,
said Stein Petter Lunde, divisional vicepresident, Jotun Paints (Europe).
Jotun has adopted a strategy of being
a single-stop source of powder and liquid coatings for all types of pipeline requirements, including new projects and
maintenance.
AkzoNobel is aiming to add to its
portfolio of pipeline coatings a comprehensive range of liquid paints for the
Russian market, in which it is already a
provider of powder coatings.
November 2012

International Coatings Scene

We are developing or optimizing for

Russian approval a number of products like
solvent-free polyurethanes which give the
right thickness for pipeline coatings, said
Matt Fletcher, AkzoNobels European tank
linings manager.
Russian companies are being encouraged by Gazprom and Transneft to develop
new pipeline coating technologies.
Gazprom has a collaboration agreement
with Russian Corp. of Nanotechnologies
(Rusano) for the development of metallized
protective coatings for pipelines. The Russian pipelines industry needs coatings which
have proved themselves in extreme weather
conditions to be resistant to corrosion and
temperatures as low as -60 C and to provide thermal insulation, flow enhancement
and fire protection.
The oil and gas sector like much of the
industry elsewhere in the world is, however,
conservative about technological change.
So it continues to rely mainly on standard
coatings systems like fusion-bonded epoxy

www.coatingsworld.com

(FBE), 3 layer polyethylene and polypropylene and multilayer foam coats. The priority is improvements in application and
quality control, particularly through the
supply chain from the pipeline factory,
transportation, storage and installation.
Many pipeline failures have been blamed
on mechanical damage of coatings before
or during installation.
We see the need to provide mobile
coating solutions for large strategic future
onshore and offshore pipelines in the Far
East of Russia that are not currently serviced, said Tausch. Costs of pipe haul
from eastern to western Russia are (also)
prohibitively expensive.
A drawback of the Russian market is
the lengthy procedure for the testing and
approval of pipeline coatings by specifiers. To enter a high volume low margin
sector, entrants into the Russian market
need to be prepared to invest relatively
heavily in product development and
qualification. CW

in nearby Jundia. The diversified companys
existing plant in Jundia produces structural
adhesives and high performance coatings,
targeted at the automotive and industrial
sectors, among other products.
Receipts for privately-held Lord are up a
reported 10% this year, progress toward a
corporate goal of doubling sales in five years.
Lord global sales were $825 million in 2011.
The new plant, said to have double the capacity of the older facility, will provide sufficient capacity for 20 years growth, according
to Siqueira. Lord brands include: water-based
Chemlok adhesives, free of heavy metals and
low in the emission of volatile organic compounds; Autoseal coatings for synthetic rubbers used in the automotive segment; and heat
reflective coatings used in the automotive and
aeronautical industries.
Within Brazil, Lord also has technical

within expansion plans is a new office in
Colombia to serve the northern tier countries of South America. Lord now has a representative office and a distributor in
Bogota, Esquim de Colombia.
In Mexico, Lord moved into larger facilities in Queretaro, in Queretaro state, in
2009, where it serves the automotive, electronics and industrial coatings segments. It
still has offices in Toluca and Monterrey. In
Central America, Lord has a joint venture
with Terramix S.A., of San Jose, Costa Rica,
to market MetalJacket brand pipe coatings
for potable and wastewater.
Elsewhere in Latin America, Lord also
has distributorships in Buenos Aires and
Santa Fe, Argentina; Santiago, Chile; Quito,
Ecuador; Callao and Lima, Peru; Montevideo, Uruguay; and Caracas, Venezuela.
Lord Brasil won the 2011 Top of Mind
Award in the Brazilian composites industry
from the Brazilian Composite Materials Association (ABMACO), for brand quality and
recognition. And in 2005, Lord Brasil published its first health and environment sustainability report, building upon its
adoption of industrial stewardship principles of the national Brazilian chemical association, Abiquim. One of its achievements in
that report indicated a reduction of 10% in
total waste generation, compared with a
20% increase in production for the period.
According to a recent company note,
Lord CEO Rick McNeel, will retire at the
end of this year and Ed Auslander, Lords

How does your company approach decisions

and rate innovation risk?
by Phil Phillips, PhD
Contributing Editor

ules of thumb, intuition, tradition,
and simple financial analysis are
often no longer sufficient for addressing such common decisions as makeversus-buy, facility site selection, and
process redesign. In general, the forces of
competition are imposing a need for more
effective decision making at all levels in organizations.
Uncertainty is the fact of life and business; probability is the guide for a good
life and successful business. The concept of
probability occupies an important place in
the decision-making process, whether the
problem is one faced in business, in government, in the social sciences or just in
ones own everyday personal life. In very
few decision making situations is perfect information available. Most decisions are
made in the face of uncertainty. Chance enters into the process by playing the role of
a substitute for certainty - a substitute for
complete knowledge.
Business decision making is almost always accompanied by conditions of uncertainty. Clearly, the more information the

decision maker has, the better the decision

will be. Treating decisions as if they were
gambles is the basis of decision theory. We
have to trade off the value of a certain outcome against its. . . chance, odds, likelihood, etc. Humans make decisions based
on emotions, habits, tradition and convention. These sometimes pay off but most
times do not . . . .so . . . were lucky when
they do turn out in our favor.
Most decision makers rely on emotions
in making judgments concerning risky decisions. Should a pharmacist or doctor involved in developing risk regulation take the
emotions of the public seriously or not?
Even though emotions are subjective and irrational, they need to be a part of the decision making process because they show us
our preferences. The fact that we need emotions as part of our decision-making process
can lead to an alternative view about the
role of emotions in risk assessment: emotions can be a balancing guide in making
judgments about morally acceptable risks.
Often people make choices out of habit
or tradition, without going through the decision-making process steps methodically.
Decisions may be made under social pressure or time constraints that interfere with
a careful consideration of the options and
consequences. Decisions may be influenced
by ones emotional state at the time a deci-

sion is made. When people lack adequate

information or skills, they may make less
than optimal decisions. Even when they
know the statistics; they are more likely to
rely on personal experience than information about probabilities. The fundamental
concerns of decision making are combining
information about probability with information about desires and interests. For example: how much do you want to meet her,
how important is the picnic, how much is
the prize worth?
Knowledge is what we know well. Information is the communication of knowledge. In every knowledge exchange, there is
a sender and a receiver. The sender makes
common what is private, does the informing, the communicating. Information can
be classified as explicit and tacit forms. The
explicit information can be explained in
structured form, while tacit information is
inconsistent and fuzzy to explain.
Data is known to be crude information
and not knowledge by itself. The sequence
from data to knowledge is: from Data to Information, from Information to Facts, and
finally, from Facts to Knowledge. Data becomes information, when it becomes relevant to your decision problem. Information
becomes fact, when the data can support it.
Facts are what the data reveals. However the
decisive instrumental (i.e., applied) knowledge is expressed together with some
statistical degree of confidence.
Fact becomes knowledge, when
it is used in the successful completion of a decision process. Once you
have a massive amount of facts integrated as knowledge, then your
mind will be superhuman in the
same sense that mankind with writing is superhuman compared to
mankind before writing. The following figure illustrates the statistical thinking process based on data
in constructing statistical models for
decision making under uncertainties.

Engaging in unprotected business

By Beth McDaniel
Technology Litigators
nfortunately, it happens all the time.
So lets discuss completely careless
and unprotected business relations,
as uncomfortable as that may be . . .
John P. Eggseck finally meets that
special employee hes been looking for,
Miss Ima Crookshes intelligent,
charming, sophisticated, well-endowed
with experience and with a lust for
knowledge. Shes perfect! Perfect for the
position of mid-level managerial position in his coatings company, that is. In
the throes of this exciting encounter, the
parties enter into a relationship. They
pledge their trust in each other and mutual respect. No pre-employment agreements are signed, (they dont want to get
bogged down in all that negativity).
John proceeds to disclose to Ima his innermost (trade) secrets, he exposes himself (technically), he teaches her
(manufacturing) techniques she never
knew, and he spends late nights sharing
with her his hopes and dreams (proformas and projections) for the future.
All is going along well, until- BAM!!
John discovers Imas run off with another paint manufacturer. But before
she leaves, she cleans out Johns trade secret files and makes off with his latest
formulationall that he has left on a
thumbdrive in her front pocket. Now,
living off of Johns blood, sweat and
tears, the two cheaters are carrying on
together in bliss, while John beats his
head against his office wall for not having obtained a formal employment
agreement, a Non-Disclosure or NonCompete Agreements. All the while,
Miss Ima Crook is sharing Johns most
valuable trade secrets with his biggest
competitor, and capitalizing on his innovation to his competitors advantage.

30 | Coatings World

This leads us to the question

What happens when you engage in
unprotected business?
Last month, we discussed the situation where a high-level employee with
no non-compete agreement walks off
with trade secrets. In this article, we will
explore the situation where your trade
secrets have been absconded in the
hands of a mid-level employee, only to
discover that you have failed to contractually protect yourself. No Non-Disclosure Agreement (NDA) exists to set out
the limitations on disclosure of your
trade secrets and remedies for misappropriation. You have no Non-Compete
Agreement to prevent her from taking a
comparable position with your direct
competition.
Should this misfortune
befall you, are there legal remedies on
which you can rely to help protect that
which is yours?
Where there is a contract between the
parties, to the extent it is consistent with
public policy, a court will look to the
contract to govern the parties intentions.
But where there is no contract, trade secret law can offer protection by operation of law. The term by operation of
law refers to the application of legal
principles to a relationship to which the
parties have not previously contracted.
Trade secret by operation of law would
also be applied in a situation in which an
existing contract does not adequately
cover the issues between the parties or
fails for some contractual reason.
In the event there is not a contract
setting out the terms related to the protection of trade secrets, there may be independent civil liability under the
Uniform Trade Secrets Act (UTSA). All
but four states (Massachusetts, Texas,
North Carolina and New York) have
adopted the UTSA or some version of it,
and in 2012 the UTSA was introduced in
the Massachusetts state legislature, but
as of this time has not been enacted. For
www.coatingsworld.com

ease of this discussion, we will focus on

the UTSA and not the common laws of
the states who have not adopted it.
The UTSAs definition of trade secret is information, including a formula, pattern, compilation, program,
device, method, technique or process,
that has actual or potential economic
value from not being generally known to
the public or to other persons who can
obtain economic value from its disclosure or use and is the subject of efforts
that are reasonable under the circumstances to maintain its secrecy.
So, in order to prove damages for
misappropriation of a trade secret, one
must first prove there was a trade secret
in the first place. But according to the
definition, one element of a trade secret
is that its owner has taken reasonable
efforts under the circumstances to maintain its secrecy. An NDA and Non-Compete are evidence of such protective
measures.
But in the absence of such agreements,
the UTSA maintains that there are other
reasonable efforts to maintain secrecy,
such as advising employees of the existence of a trade secret, limiting access to
a trade secret on a need to know basis,
and controlling plant access.

In this article, we will explore the situation where your trade

secrets have been absconded in the hands of a mid-level
employee, only to discover that you have failed to contractually
protect yourself. No Non-Disclosure Agreement (NDA) exists to
set out the limitations on disclosure of your trade secrets and
remedies for misappropriation.
What business practices might constitute reasonable efforts to maintain
secrecy? Trade secrets physically labeled Confidential and physical barriers to secret information, such as
restricted access and locks on doors and
desks are good signs. Password restrictions on company computers and restricting the ability of employees to
print, copy, download or send files are
not only good business practices, they
provide further evidence of trade secret
protection. We have recommended before that employees should be notified
that they are subject to monitoring of
their work emails, computer usage and
phone calls in order to lower their expectation of privacy in the workplace.
Hopefully, for our friend John, under
the UTSA in his state, a court would
view some combination of these practices sufficient to be considered reasonable efforts under the circumstances.
In several previous articles, we have
referred to intellectual property audits (IP
Audits). A professional IP Audit can give
you the assurance your company is doing
what it can to protect your valuable trade
secrets, and also be an indication you are
protecting your trade secrets.
You might be asking yourself why a
Non-Disclosure Agreement, or NDA, is
even necessary if you have taken other
steps towards confidentiality. Remember, a properly drafted NDA is in and of
itself an indication that you took certain
steps reasonable under the circumstances
to protect your trade secrets. Moreover,
if you do end up in a lawsuit, you have
no action in contract, but only in tort if
you have no agreement. This may limit
November 2012

your damages. Furthermore, its easier

for an employee to make a defense that
he did not know it was a trade secret or
wasnt sure how to treat trade secrets in
the absence of an agreement setting out
these terms.
What if theres a proper NDA but no
Non-Competition Agreement? John P.
knows that the intelligence he gave Ima
Crook is so intertwined in her understanding and knowledge of her business
that she cant even avoid disclosing that
confidential information in the performance of the same job duties at the
new paint manufacturer competitor.
Thats where the Doctrine of Inevitable
Disclosure may kick in. You may recall
we discussed this doctrine in the October 2012 IPaint article titled, When
theres No Way to Stop Your Trade Secrets FromLiterallyWalking Out the
Door.
Under this Doctrine, which is recognized in some, but not all jurisdictions, a
court may prevent a former employee of
one company from working for a competitor in a similar position, if the nature
of the new position is such that it would
inevitable require the use or disclosure
of trade secrets of the former employee.
The seminal case on the Doctrine, a
7th circuit case, PepsiCo. v. Redmond, is
illustrative of the application of this doctrine. In that case, a former PepsiCo employee, (Redmond) went to work for
Quaker Oats Company, manufacturer of
Gatorade, a product in direct competition with Pepsis All Sports drink. Redmond made no actual threat of use or
disclosure, but the appellate court stated:
Again, the danger of misappropriawww.coatingsworld.com

tion in the present case is not that

Quaker threatens to use PCNAs secrets
to create distribution systems or co-opt
PCNAs advertising and marketing ideas.
Rather, PepsiCo believes that Quaker,
unfairly armed with knowledge of
PCNAs plans, will be able to anticipate
its distribution, packaging, pricing and
marketing moves. Redmond and Quaker
even concede that Redmond might be
faced with a decision that could be influenced by certain confidential information that he obtained while at
PepsiCo. In other words, PepsiCo finds
itself in the position of a coach, one of
whose players has left, playbook in
hand, to join the opposing team before
the big game.
As always, seek legal counsel to determine if this remedy is available in
your state.
In addition to civil remedies for trade
secret misappropriation, many states
provide criminal penalties, and stiff ones
at that, for misappropriation. Further,
there can also be criminal penalties for
receiving stolen information. So, in
some states, the threat of jail time might
make Ima less attractive to Casanova
Competitor, and serve to suppress its
urge to capitalize on your trade secrets
to its advantage.
The underlying lesson here is dont
get caught with your pants down. Practice protected business by routinely using
NDAs and non-competes with your employees. But, if you do discover a hole
in your prophylactic Wall of Paper, good
business practices under the UTSA may
provide you the protection you need to
avoid an unwanted theft. CW

However, certain segments of the market have improved versus

Adhesives and sealants manufacturers report on the state of the market for 2012.
by Kerry Pianoforte, Editor
dhesives and sealants are used in a diverse number of
markets, from commercial construction to DIY. While the
uncertain economy and sagging U.S. housing market has
created a difficult situation for adhesive and sealants manufacturers, certain segments such as DIY remain strong.
Current economic conditions have certainly changed the landscape of todays marketplace, said Chuck Houk, president, Tremco
Inc.s commercial sealant and waterproofing division. Commercial construction was hit hard by the economic downturn and while
the results have been devastating for many in our industry, the need
to build or restore existing structures to high performance standards has not changed. During this difficult period, we have kept
focused on product and system innovation that incorporates connectivity solutions providing documented, proven performance to
our customers that need a total envelope solution. This strategy has
positioned us well during this challenging period and our outlook
is positive for an early return to growth.
The economy has affected every segment in the home improvement industry, adhesives and sealants are no exception,
however they are necessity items for the successful completion
of a wide variety of projects, said Joseph McGraw, director of
marketing and advertising, United Gilsonite Laboratories (UGL).
The adhesives and sealants category is stable. UGL has found

that many dealers have been purchasing on an as needed basis instead of past histories of maintaining larger inventory. But we
have seen that demand has remained seasonally strong in the
construction sector.
DAP has seen a significant shift as do-it-yourself consumers
account for a much more significant share of purchases in caulks,
sealants and adhesives. This result has certainly been the byproduct of the downturn in the housing market going back to
2008, said Michael Gorman, vice president of marketing, DAP
Products Inc. We remain committed to both our trade professional and DIY consumers though as our focus on developing
innovative application solutions has not been altered by the economic conditions.
DAPs focus remains on the residential construction repair/remodel market. We are driving our message towards product solutions for energy improvements and painting projects,
said Gorman. Weatherization and energy improvements for the
home remain a major focus for our consumers as they are looking to live both more cost effectively and responsibly when it
comes to home energy use.
The use of adhesives is widespread through a number of
manufacturing sectors so drops in general economic activity inevitably reduce historic demand, said Keith Darnell, vice president of SCIGRIP sales and marketing. However, SCIGRIP is
involved in such a wide variety of market segments that the impact on our company specifically is mitigated. The specific prop-

of manufacturing for many of our customers which drives increased demand even during general downturns.
Our products are particularly popular for large scale bonding of certain plastics and composites to themselves or metal and
for exposure of the nal component to impact or vibration fatigue, added Darnell. These properties allow SCIGRIP to benet from sectors like transport, marine, sport and leisure. We also
have adhesive products that are ideal for consumer electronics

in the second quarter provided important momentum for the
solid sales increase achieved, with revenues in the regions of Eastern Europe and Africa/Middle East developing particularly well.
In Western Europe, sales were slightly below the level of the
prior-year quarter, due primarily to negative market conditions
in the countries of Southern Europe. By contrast, the strong
growth posted once again by our businesses in North America
made a signicant contribution to the rise in revenues.
Henkel reported that adhesives for consumers, craftsmen and
building business exhibited solid sales performance in the second quarter, with contributions coming from both strong sales
and with products for craftsmen and building industry, and from
products for do-it-yourselfers. The regions of Eastern Europe
and Africa/Middle East again contributed signicantly to the
growth achieved, said Elfes. Our business in North America
also performed very strongly.
Raw material issues continue to impact the adhesives and
sealants market, although some companies have reported a stabilization in prices.
Due to raw material price rises, cost of sales at all Henkel
business units increased compared to the prior-year period by
3.5 percent to 4,322 million in the rst half, said Elfes. Raw
material prices stabilized toward the end of the rst half of 2012.
We succeeded in further growing gross margin by increasing our
selling prices and maintaining our strict cost discipline. We expect the increase in prices for direct materials to decelerate compared to 2011. We will remain rmly focused on maintaining
our strict cost discipline. We also expect an increase in the prices
for raw materials, packaging, contract manufacturing and traded
goods in the low single-digit percentage range in 2012.
While we have passed along a few price increases when appropriate, we have tried to take a balanced approach to this challenge,
said Houk. From the R&D perspective, we continue to look at
ways to reduce our dependency on petroleum-based feedstocks as
well as consider renewable raw material alternatives. Also, we are
taking very real steps to reduce our internal energy consumption
and subsequently reducing our corporate carbon footprint.

chains for our customers.
In addition to raw material prices, complying with environmental regulations is a key issue for adhesives and sealants
manufacturers.
Regulatory agencies have certainly forced the industry to
think differently about the chemicals used to manufacture the
products sold into the commercial construction industry, said
Houk. At Tremco, we favor taking a proactive approach that
allows us to help the agency achieve its VOC goals without compromising our ability to deliver high performance solutions to
building owners. This strategy has resulted in a multi-pronged
innovative approach to product stewardship. We are capable of
offering a suite of products that currently meet the most stringent
laws for VOC content with compromising performance. In addition, in the Spring of 2012 Tremco became the rst building envelope solutions provider to earn Greenguard Child and Schools
certication for indoor air quality. This provides our customers
with additional assurance that volatile organic emissions from
building components used behind the facade or in the enclosure
construction will not negatively impact the quality of the interior
environment. Finally, we will continue to incorporate the use of
recycled content in our products and packaging and utilize renewable raw materials such as naturally occurring polyols, plasticizers and llers to take the place of petroleum-based raw
materials as appropriate.
SCIGRIP views regulations as an opportunity to grow its
market share against the more traditional products in use. For
instance, we have clients interested in reducing emissions by
using SCIGRIP systems, which require lower surface preparation
and cure by reaction rather than solvent evaporation, said Darnell. The two largest challenges we face are managing the complex administrative requirements of varied, global regulations
and nd suitable replacements for key raw materials that are
newly prohibited by regulatory agencies.
The impact of VOC and other environmental regulations
can be seen across the board in terms of formulations, handling,
storage and transportation, said Gorman. DAP is committed in
terms of organizational resources and research to develop and
deliver the appropriate products that meet the required regulatory requirements.

Adhesives and Sealants Market

New product offerings

Tremco has recently launched ExoAir 230 fluid-applied vaporpermeable air barrier membrane. ExoAir 203 is a monolithic,
synthetic vapor-permeable air barrier membrane designed to seal
exterior above-grade walls from air infiltration/exfiltration, while
serving as a weather-resistant barrier to keep water out. It remains permeable to the passage of water vapor to prevent moisture from being trapped within the wall which may lead to
deterioration of structural membranes and poor indoor air quality, which is particularly compromising in hospitals, schools, laboratories and other sensitive environments, said Houk. ExoAir
230 is formulated to resist temperatures up to 240F (115C),
provide unprecedented UV resistance and surpass ASTM 84 testing for flame spread and smoke development along with other
components with which it may be used.
Tremco also launched Vulkem 45 SSL semi-self-leveling
sealant. Commercial construction schedules can be dramatically
expedited with Vulkem 45SSL, which allows next-day application to joints in concrete slab pours while ensuring adhesion and
eliminating 'green cracking' as the concrete cures, said Houk.
Vulkem 45 SSL was specially developed for sealing joints in
level and/or slightly sloped surfaces up to 6 percent, such as sidewalks, swimming pool decks, terraces, parking decks and plazas.
It can be applied to fresh concrete 24 hours after concrete forms
have been pulled and uses moisture in either damp or green concrete to cure. Vulkem 24 SSL provides exceptional wear- and tearresistance required in high traffic areas and allows continuous
immersion in non-chlorinated water, according to the company.
UGL manufactures a variety of caulks and sealants for all
types of home-repair jobs. Drylok masonry crack filler seals and
waterproofs cracks in concrete sidewalks, walls, steps, floors, replaces cracked mortar joints and dries to color of concrete. UGLs
Tub and Tile caulk waterproofs around tubs, sinks and showers.
This mildew resistant, non-staining compound stays white and
provides excellent adhesion to most building materials, according to the company.

Henkel acquires Cytec's pressure sensitive

adhesives product range
Henkel recently acquired the high-performance pressure sensitive adhesives (PSA) product range from the U.S.-based specialty chemicals company Cytec Industries Inc. Pressure
sensitive adhesives are specialized adhesives used in the packaging, automotive, electronic and durable goods industries
for foils and films, tapes or labels offering high performance
adhesive characteristics. The acquisition strengthens Henkels
position in the area of high-sensitive adhesives as the acquired
product range is complementary to Henkels well established
high-performance PSA business. In fiscal 2011, Cytecs PSA
product range generated sales of $94 million. The business includes approximately 80 employees.

The most recent SCIGRIP product launch is SG100, an improved white UV resistant methacrylate adhesive. This product
is very popular in industries such as boat building and transportation where visual aesthetics are important and blue, gray
or black adhesives are unsightly, said Darnell. The most exciting news for SCIGRIP is the continued expansion of the number of products manufactured in our Washington, UK facility.
Several key structural systems that have a very successful history
in the U.S. are now being manufactured and shipped directly
from the UK plant. This dramatically shortens the lead time and
increase product shelf life for both our UK and European customers. It also provides the peace of mind to our global customers that our products can be made in two different locations
with reliable consistency.
Henkel has recently improved on a number of its adhesives.
Loctite 403, 408 and 460 have been improved and can be used
for bonding a wide variety materials. Already market leaders in
terms of health and safety, these products now offer even better
performance, according to Henkel. The three Loctite instant adhesives are suitable for bonding almost all materials, from plastic through metal to rubber. Thanks to a special formulation, they
do not irritate the skin, nor does their safety data sheet list any
hazard symbols or chemical substances that pose a risk to health.
In launching these improved products, Henkel is strengthening
its portfolio of innovative solutions with regard to occupational
health and safety. The improved formulation has higher moisture tolerance and leads to a longer lasting bond.
For the construction market DAP has launched the Spec Line,
the first full line of sealants and adhesives designed specifically to
help professionals meet industry specifications for each job by
including the required spec as part of the product name. With
numeric labels that match federal specification standards, professionals can now easily select the best product for the application and take the guesswork out of the purchasing process. The
DAP Spec Line also includes the Performance Facts on the product, mimicking the layout of a nutrition label. The Performance
Facts include the amount and coverage per cartridge, recommended use, features and specifications, among other details. The
DAP Spec Line bundle of products includes DAP Dynaflex 230,
DAP Dynaflex 800 and DAP Dynaflex 920 to seal, DAP Dynagrip 557, DAP Dynagrip 3498 and DAP Dynagrip FRP to adhere and DAP Draftstop 812 to install.
To help professionals and do-it-yourselfers weatherize and
make home improvements faster, DAP Products Inc. has introduced the newly-formulated DAP 3.0. DAP 3.0 establishes firstto-market technology with high-performance sealants that are
both paintable and water resistant in 30 minutes. DAP 3.0 is
low odor and VOC compliant, backed by a lifetime guarantee.
Designed to address a wide range of sealing applications in
kitchens and baths, around windows, doors, trim and siding, and
on concrete and masonry surfaces, the new line of project-oriented sealants includes several distinct formulations: DAP 3.0

to the development of a sustainable and highly efficient manufacturing process based on a
proprietary microorganism. The bacterium used is Basfia succiniciproducens,
which produces succinic acid through natural processes and is capable of metabolizing a variety of renewable feedstocks
into succinic acid. The new process combines high efficiency with the use of renewable raw materials and the fixation of
the greenhouse gas, carbon dioxide, in the
production of succinic acid. This makes
biobased succinic acid an economically
and ecologically attractive alternative to
petrochemical raw materials.
The demand for succinic acid is anticipated to grow strongly in the years
ahead, driven mainly by bioplastics,
chemical
intermediates,
solvents,
polyurethanes and plasticizers, according
to the company. The two companies are
currently modifying an existing fermentation facility, at Puracs Montmlo site
near Barcelona, Spain, for the production
of succinic acid. This plant will commence operations in late 2013 with an
annual capacity of 10,000 metric tons of
succinic acid. This is complemented by
plans for a second large-scale facility
with a capacity of 50,000 tons of succinic acid to enable the company to respond to the expected increase in
demand.

Aakash Chemicals is especially honored
by this years award because it is almost
impossible to sustain the year on year
growth that is required to make this list
two years in a row, the company said.
According to the company, the continued high pace growth from 20112012 came from a larger global
validation of Aakashs existing product
line (organic pigments, amide waxes, ketonic /PVB resins, specialty dyes) as sales
expanded quickly into South America,
Europe and Asia, complemented by
strong sales in North America. Aakash
Chemicals proved to be a reliable, cost
competitive and technical service oriented company that the global paint, ink,
and plastics customers identified as a
good partner and fit to their business
platform.
Their customer focus centers on both
regional and global customers. As fears
of a dismal economic outlook were announced, Aakash Chemicals went in the
opposite direction and tripled their
working capital spent towards maintaining global inventories. Finally, they
added a line of FD&C dyes (FDA approved), nylon resins and opened a new
pigment dispersion plant in Savannah,
Georgia.

launched in 2004.
Clariant has developed two new nonhalogenated FRs in Hrth-Knapsack
under the name Exolit EP specifically for
the flame retardancy of epoxy resins. Both
products are aimed at the requirements of
printed circuit boards and therefore perform vital functions such as minimizing
the impact of the FR on the glass transition temperature of the plastic, which is a
key parameter in epoxy resin chemistry in
this demanding application. In addition, it
has been shown that Exolit EP can reduce
the quantity of flame retardant required
by up to 50% compared with conventional products.
Alongside the Exolit OP and EP product families, Clariant also manufactures
the Exolit AP flame retardant, which is
based on ammonium polyphosphates

use in electrical and electronic items and
increases the fire resistance time of
steel/building structures. Further product

do. We were learning together on how to grow my company. In fact,
I tried to hire him back about twelve years ago but he was dedicated
to running his own representative firm at the time.
Steve spent a decade at Hockmeyer Equipment Corp. from September 1991 to October 2001, where he concentrated primarily on sales
into Asia and the west coast of the United States. He was a trusted
friend, an astute professional and a gentleman, said Herman Hockmeyer of Hockmeyer Equipment Corp. We send our respects to his
family and wide network of friends, all of whom shall grieve his loss.
Most recently, Steve served as sales manager at Myers Engineering.

Trust Chem names Orlowski

executive VP of marketing
and sales in the U.S.

Friends and colleagues remembered Steve for both his technical

knowledge and his wonderful personality.
Steve Guntner was one of this industrys leading experts on the
application of mixing and blending equipment, said Cary Buller, vice
president, Myers Engineering. Not only has our company lost a member who was a key team player, but the industry has been shorted his
talents. Steve left quite a mark on the industry and he will be remembered for a long time to come. Steve was an incredible team player
who worked well with customers and vendors. The people he worked
with will all miss him tremendously.
Steve Guntner was a wonderful person who was well liked throughout the entire industry, said JD Hodgson, order processing and traffic
manager at Myers Engineering. Steve was very knowledgeable and customers from around the world truly enjoyed working with him. Throughout the many years I worked with him he taught me a lot. He will be truly
missed.
I have worked with Steve in various places and times for over
twenty-five years, said Cathy Strahan of Myers Engineering. He
brought me into this industry as a rep for Hockmeyer and I brought him
to Myers as the sales manager. He was a constant source of guidance
and information. Interesting how the circle closed.
Steve is survived by his wife, Susan and two sons, Sam and Erik.

BASFs R-M automotive coatings used on

winning truck at the International Auto Show

VECO showed off its Dakar rally-winning truck at the 64th

International Auto Show (IAA) Commercial Vehicles in
Hanover, Germany. The truck was painted with Graphite HD,
a paint line produced by BASFs premium R-M brand specifically
for commercial vehicles.
The IAA Commercial Vehicles is a leading trade show for
mobility, transportation and logistics and is therefore a key platform for R-M. The brand provides a full range of paint systems
for manufacturers of commercial and transportation vehicles.

R-M announced an extension to its involvement as a technical

sponsor of the Petronas de Rooy IVECO team. The team
achieved a double victory in the 2012 Dakar rally.
The Dakar rally is an outstanding opportunity to showcase
the advantages of our commercial vehicle technologies. We have
found a very strong and professional partner in IVECO, said
Oliver Birk, head of commercial transport solutions business development, BASF. CW

The Dakar truck was coated with the R-M Graphite HD refinishing paint system. Specially developed for commercial vehicles, this system is
extremely durable and comprises more than 50,000 colors, according to BASF.
