TheParties

1.
Ms. Rosa is of legal age, pregnant with the child of the defendant,
andisaresidentoftheRepublicofthePhilippines.

The Defendant, Butch Cruz2,
is likewise of legalageanda resident
oftheRepublicofthePhilippines.

StatementofFacts

TheDefendantusedtobe inarelationship withthe Plaintiff, whois

already7monthspregnantwiththeformerschild.

BothPlaintiffandDefendantleasedanapartmentwiththeagreement
thattheywillpaytheirshareoftherenteachmonth.

5.
TheDefendantlefttherelationshipandtheleasedapartment,leaving
the Plaintiff alone to shoulder the rent. By this time, the Defendant has already
failedtopaytherentforthepastthree(3)months.

6.
Pursuant to the agreement, the Plaintiff is demanding the payment
for the Defendants share for the rent of the apartment. As evidenced by the
contract, the share of the Defendant for the rent per month amounts to Php
7,000.00.Thus,theoutstandingbalanceamountstoPhp21,000.00.

Additionally,duringthecourseoftherelationship,theDefendanthas
borrowed certain items from the Plaintiff which he has failed to return upon
demand of the latter. The items aforementioned are listed as follows: an Asahi
electric fan an American Home mini refrigerator and a pair of Havaianas
slippers.ThefairmarketvalueoftheseitemsarePhp4,400.00,Php7,000.00,and
Php900.00,respectively.

ThePlaintiffdemands thattheseitemsbereturnedbytheDefendant
promptly. However,thePlaintiffisalsowillingtoacceptpaymentofthetotalfair
marketvalueoftheseitems,amountingtoPhp12,300.00.

FirstCauseofAction

Duetotheiragreementtopaytherentattheirrespectiveshares,the
Plaintiffprays foranactionofspecificperformancefortheDefendant topayhis
partoftherentdue,whichtotalstoPhp21,000.00.
SecondCauseofAction

10. ThePlaintiffrequestsfortherecoveryoftheobjectsstatedabove,
or
paymentofthetotalfairmarketvalueoftheitemstotallingtoPhp12,300.00.

RELIEF

WHEREFORE,premisesconsidered,Ms.Rosarespectfullypraysthatthis
HonorableCourtrenderjudgmentasfollows:

a.
TheDefendantshallbeorderedtopaypartofhisrentdue,whichtotalsto
Php21,000.00,pursuanttotheagreementwiththePlaintiff.

b.
TheDefendantshallbeorderedtoreturnalltheitemswhichhehas
borrowedfromthePlaintiff,orpaythetotalsumofPhp12,300.00aspaymentof
thetotalfairmarketvalueoftheitemsborrowed.

Suchotherequitableandjustreliefsunderthepremisesarelikewiseprayed
for.
