Insurance Subsidies at Risk in Supreme Courts King v. Burwell Case


Approximately 7.7 million people living in states with
a federally run health insurance exchange purchased
health insurance and qualified for monthly premium
tax subsidies during the 2014-15 open enrollment
period, according to newly released data.1 The
estimated annual value of those tax subsidies tops
$24 billion, according to calculations by The Council
of State Governments.
These premium subsidies are at risk in the King
v. Burwell case currently before the U.S. Supreme
Court. On March 4, the Supreme Court heard oral
arguments challenging the legality of providing tax
subsidies to individuals with incomes between 100
percent and 400 percent of the federal poverty level
in states without a state-based health insurance
exchange. The issue before the court is whether the
tax subsidy can be extended in states without an
Exchange established by the State, as stated in
one section of the Affordable Care Act. A decision
is expected in late June 2015. Thirty-four states currently have no state-based exchange.
Sixteen other states and the District of Columbia
opted to implement state-based exchanges, where,
2.45 million individuals will receive approximately
$7.6 billion in premium tax subsidies in 2015.2 The
legality of these subsidies is not in question in the
case before the Supreme Courtexcept perhaps
in Oregon, Nevada and New Mexico, where state
officials have opted for a state-based exchange but
use the federal HealthCare.gov platform.

Hawaii has the lowest enrollment at 12,625 people.

Numbers Enrolled in Health Insurance for 2015

The average enrollment for all states and the


District of Columbia is 229,000 people.

Nearly 11.7 million Americans either selected an


insurance plan or were automatically re-enrolled in
the plan they had selected during the 2014-15 open
enrollment period, according to a federal government
data report released March 10.3
Three out of four enrollees live in one of the 34
states using the federal exchange.
The five states with the largest numbers of enrollees are Florida, California, Texas, North Carolina
and Georgia. There are just over 5.3 million enrollees in these five states, or about 45 percent of the

national total. California is the only one of those


five states with a state-based exchange.
In the five states with the lowest enrollment
Alaska, Hawaii, North Dakota, South Dakota and
Wyomingan average of just less than 19,000
individuals purchased health insurance.

Premium Prices and Value of Tax Subsidies


The monthly premium for health insurance policies
selected by consumers in the 34 states served by the
federal exchange averaged $364. More than 8 of
10 individualsnearly 7.7 million or 87 percent
qualified for a tax subsidy. The monthly average
tax subsidy is $263, bringing the average monthly
premium price down to $101. In 2015:
Alaska has the highest average premium before
the tax subsidy at $639. Wyoming ($550), New

Jersey ($470), West Virginia ($448) and Wisconsin


($440) round out the top five.
Plan premiums before the subsidy are the least
expensive in Utah ($248), Arizona ($278), Oklahoma ($295), Kansas ($301) and Tennessee ($316).
After the tax subsidy, the lowest average monthly
premium for a selected plan is $52 in Mississippi.
The highest average monthly premium after the
tax subsidy is $164 in New Jersey.
In the states served by the federal exchange, tax
subsidies reduced the price of premiums by an
average of 72 percent.4 The average monthly tax
subsidy is $263.
For the 16 states with state-based exchanges,
detailed information on premium prices for
selected plans and tax subsidies is not available
in the latest federal report on health insurance
exchanges.

$101 Average Monthly Premium after Tax


Subsidy in 34 States*

The annual value of the premium tax subsidies


varies from a high of $5.2 billion in Florida to a low
of $35.6 million in Hawaii.
In addition to Florida, the states where the value of
the tax subsidies exceeds $1 billion are California,
Texas, North Carolina, Georgia and Pennsylvania.
Among the 10 states receiving the most in tax subsidies, only California and New York implemented
state-based exchanges. The other eight states opted
to use a federal exchange.
The average annual value of tax subsidies is $630
million among all states. The average is a little
higher$702 millionamong the 34 states using
the federal exchange.
In states that implemented state-based exchanges,
where detailed information on premium prices for
plans and tax subsidies was not available in the
latest federal report on health insurance exchanges,
CSG calculated annual subsidy values using the
$263 average tax subsidy in the 34 states under the
federal exchange.
