SB RESOLUTION NO. 033-2015

GRANTING AUTHORITY TO THE LOCAL CHIEF EXECUTIVE AND THE MUNICIPAL
TREASURER, BOTH OF GUINOBATAN, ALBAY, TO OPEN AND MAINTAIN A NEW ACCOUNT
WITH THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP), LEGAZPI CITY BRANCH,
FOR THE TWENTY PERCENT (20%) SHARE OF THE LGU FROM FIRE CODE REVENUES
PURSUANT TO DOF, DBM & DILG JOINT CIRCULAR NO. 2015-01, DATED FEBRUARY 12,
2015 AND BFP MEMORANDUM DATED FEBRUARY 26, 2015.

WHEREAS,

DOF, DBM & DILG Joint Circular No. 2015-01, dated February 12, 2015, has for
its purpose, among others, the provisions or guidelines for the release of the
twenty percent (20%) share of the LGUs in the Fire Code Revenues collected by
the Bureau of Fire Protection (BFP);

WHEREAS,

specifically under paragraph 1.2 thereof, statement of policy, it provides that the
twenty percent (20%) LGU share from all the taxes, fees and fines collected by the
BFP shall be set aside and retained for use by the city or municipal government
concerned, which shall appropriate the same exclusively for the use of the
operation and maintenance of its local fire station, including the construction and
repair of the fire station;

WHEREAS,

in consonance thereto, the Bureau of Fire Protection has issued a memorandum

dated 26 February 2015, and provides, among others, under paragraph 3 and
quoted herein in part, City/Municipal Fire Marshal should also secure the
account number of the LGU in its MDS-Authorized Government Servicing Bank for
the Authority to Debit Account (ADA);

WHEREAS,

in compliance thereto, the BFP Personnel of Guinobatan brought the matter to the
attention of the Local Officials, especially to the Municipal Accountant, wherein
after due consultation with them, a consensus was reached that instead of
downloading or transferring the LGU share to its existing account, it would be

more prudent and wiser, to open and maintain a separate and exclusive account
for this purpose;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED,

as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in

session assembled, to grant as it hereby grants authority to the Local Chief
Executive and the Municipal Treasurer, both of Guinobatan, Albay, to open and
maintain a new account with the Development Bank of the Philippines (DBP),
Legazpi City Branch, for the 20% share of the LGU from Fire Code Revenues
pursuant to DOF, DBM & DILG Joint Circular No. 2015-01, dated February 12,
2015 and BFP Memorandum dated February 26, 2015.

RESOLVED FURTHER, that in consonance with the rules enunciated by the law, its circular and
memorandum, it is hereby provided that no money shall be paid out of this
account thus created, except in pursuance of an appropriation ordinance duly
approved by the LGU of Guinobatan through its Sanggunian upon the
recommendation/proposal of the Municipal BFP Station.
RESOLVED FINALLY, that a copy of this resolution be furnished the Offices of Honorable Mayor,
Municipal Treasurer, Municipal Accountant, Municipal Fire Marshal, and such other
offices/persons concerned for their information and guidance.
APPROVED UNANIMOUSLY this 16th day of March, 2015 on motion of the lead sponsoring
Committee Chairman, Hon. Councilor Ricky S. Matza, and unanimously seconded
by the body during their 11 th Regular Session.
