PURPOSE

ThroughtheNursesAct,thenursingprofessionisgrantedtheauthoritytosetstandardsfor
educationandpracticeofitsmembers,withanobligationtoprotectthepublicandservethe
publicinterest.
Guidelinessupportprofessionaljudgementandpromoteappropriatedecisionmakingin
practice.Thepurposeofthispracticeguidelineistohelpregisterednurses1(RNs)protectthe
privacyandconfidentialityofpersonalandhealthinformationoftheclientandtoreiteratethe
importanceofmaintainingtheboundariesestablishedwithinthetherapeuticnurseclient
relationshipwhenusingsocialmediatechnologyintheirpractice.Thepracticeguidelinefurther
interpretsNANBsstandardsandtheCodeofEthics(CNA)andprovidesrecommendationsto
registerednurses,employersandnursingeducationprograms.

INTRODUCTION

Socialmediarepresentsmuchmorethanatoolforcommunication.Itchangeshowpeoplework
andinteract,howrelationshipsareformedandhowpeoplecomplain,
celebrate,discoverandcreate.(ScotishGovernment,2012)2.

Whenwecombine
theuseoftechnology
withsocial
connections,theline
betweenwhatwe
thinkofasprivate
andpublicis
blurred.(CNA,2012)

TheNursesAssociationofNewBrunswick(NANB)doesnotregulatetheuseof
socialmedia;itdoeshowever,regulatethepracticeofRNswithinan
environmentwheresocialmediaiseverpresent.Communicationtechnologies
suchasFacebook,YouTube,MySpace,blogsandmobilephonecamerashave
madeitincreasinglycommonfornursestosharedetailsoftheirworkinglives
online(Livsey,2010).InJuly2012,Twitterreportedpassing500million
accounts3withCanadain8thplacefromthetop20countriesintermsof
Twitteraccounts.WorldStatsreported17,987,900FacebookusersinCanada4,
makingitCanadasmostpopularsocialnetworksite.

TheCanadianNursesAssociation(CNA)definesthetermsocialmediaasagroupofInternet
based applications and technologies that allow users to have the same kind of realtime
conversationthattheymighthavewithfriendsorneighbourswithvirtualfriendsfromaround

the globe. Social media technologies allow users to interact and collaborate with each other
onlineinthecreationandsharingofinformation,ideas,andopinions(CNA,2012).
Social media can benefit health care in a variety of ways such as strengthening professional
relationships, providing valuable information to health care recipients, providing timely
communication with clients and family members and educating and informing health care
professionals.However,whenwecombinetheuseoftechnologywithsocialconnections,the
linebetweenwhatwethinkofasprivateandpublicisblurred(CNA,2012).Table1offersalist
ofbenefitsandrisksassociatedwiththeuseofsocialmediainthenursingprofession.

Registerednursesareheldtoahighstandardofconfidentialitywithrespecttoclient
information.EthicalconsiderationsshouldbealwayskeptfirstandforemostinRNsmindsinall
communicationmodalities.Tounderstandthelimitsofappropriateuseofsocialmedia
technologiesoranyinformationtechnology,itisimportantforRNstounderstandtheconcepts
ofconfidentialityandprivacyinthehealthcarecontextandtouseNANBsstandardsandthe
CodeofEthicsasaguidingframeworkwhenmakingdecisionsabouttheiruseofsocialmedia.
ETHICALCONCERNS:CONFIDENTIALITYANDPRIVACY

TheCodeofEthicsforRegisteredNurses(2008)setsRNsethicalresponsibilitiesregarding
maintainingprivacyandconfidentiality.Confidentialityandprivacyarerelated,butdistinct
concepts.TheCodeofEthicsdefinesconfidentialityastheethicalobligationtokeep
someonespersonalandprivateinformationsecretorprivate(p.23).TheRNmustsafeguard
informationobtainedduringthecourseoftreatment/careandmayonlybedisclosedtoother
membersofthehealthcareteamforhealthcarepurposes.Confidentialinformationshouldbe
sharedonlywiththeclientsinformedconsent,whenlegallyrequired,orwherefailureto
disclosetheinformationcouldresultinsignificantharm.Beyondtheseverylimitedexceptions
theRNsobligationtosafeguardsuchconfidentialinformationisuniversal.RNsmustbeaware
thatsharingclienthealthinformationthatwascollectedthroughtheprovisionofcareisa
breachofconfidentialityintentionalorinadvertentwhenpostedonapublicWebsite,asitis
outsidethescopeoftheintendeduseandpurposesforwhichtheinformationwascollected.
Privacyrelatestotherightofclientstokeepinformationaboutthemfrombeingdisclosedto
anyone.8TheCodeofEthicsdefinesinformationalprivacyastherightofindividualsto
determinehow,when,withwhom,andforwhatpurposesanyoftheirpersonalinformation
willbeshared(p.27).
PROFESSIONALCONCERNS:

Inappropriatesharingofclientpersonalhealthinformationviasocialmediaisabreachofthe
StandardsforthePracticeofRegisteredNurses9(2012).Whenusingsocialmediawhetherfor
personalorprofessionalpurposes,RNsareresponsiblefortheiractionsandaccountabletothe
client,employer,theprofession,andthepublic.Somestandardindicatorswhichareapplicable
totheuseofsocialmediaare:

PERSONALANDLIABILITYCONCERNS

Understandingtherisksinvolvedinusingsocialmediamaypreventpotentialadversepersonal
andprofessionalconsequences.AccordingtotheCanadianNursesProtectiveSociety(CNPS)
InfoLAW(2012),failuretoabidebythese(professionalstandards)canleadtoseriouslegal
consequences.TheCNPScautionsRNstorespectandenforceprofessionalboundariesandnot
toelectronicallyfriendorcommunicatewithclientsthroughsocialmediasites,asitmay
extendthescopeofprofessionalresponsibility.Thefactthatinformationinelectronicformis
easilydistributed,archived,anddownloadedleaveslittlecontroloverwhoseestheinformation
postedonsocialmediasites.Also,onemustaddthefactthatpostingstosocialmediasitesare
generallypermanentrecordsthatcannoteasilybedeleted.Postingsmaycomebacktohaunt
thepersonwhopostedtheinformationonapersonalorprofessionallevel(CNPS,2012).There
existsanecdotalevidencethatanincreasingnumberofemployerschecksocialnetworking
profilesofcurrentandprospectiveemployeeslookingforinformationthatcouldbeinterpreted
asreflectingnegativelyontheorganizationorasmisconductorinappropriatebehaviouronthe
partofemployees.

TheNBPersonalHealthInformationPrivacyandAccessAct(2009)protects

persontowhomitbelongsbysettingrulesaboutthecollection,use,
disclosure,retentionandsecuredestructionofpersonalhealthinformation.

RoleoftheIndividualRN

Registerednurseshaveaprofessional,ethical,andlegalresponsibilitytounderstandtheimpact
ofsocialmediaonhealthcareandmorespecifically,onnursingpractice.

Theregisterednurseshould:

Buildownsocialmediacompetence;knowthetechnology;andhavetheskillsand
judgmenttouseitappropriatelyandethically(CRNBC,2012);

Recognizeethicalandlegalobligationstomaintainclientprivacyandconfidentialityat
alltimes;

Notshareorpostinformation,includingimages,aboutaclientorinformationgainedin
thenurseclientrelationshipwithanyoneunlessthereisaclientcarerelatedneedto
disclosetheinformationorotherlegalobligationtodoso;

Notidentifyclientsbynameorpostorpublishinformationthatmayleadtothe
identificationofaclient;

Nottakephotosorvideosofclientsonpersonaldevices,includingcellphones.TheRN
shouldfollowemployerpoliciesfortakingphotographsorvideoofclientfortreatment
orotherlegitimatepurposesusingemployerprovideddevices;

Abstainfrommakingdisparagingremarksaboutemployerorcoworkers(e.g.,
threatening,harassing,profane,obscene,sexuallyexplicit,raciallyderogatory,
homophobic,orotheroffensivecomments);

Maintainprofessionalboundariesintheuseofelectronicmediabyrefrainingtoaccept
afriendrequestfromaclientonFacebookormakingacommentonaclientsblog;

Beawareofandfolloworganizationalpoliciesconcerningpersonalandprofessional
socialmediatoolswhenatwork,includinghowtomanageaprivacybreach;

Notpostcontentorotherwisespeakonbehalfoftheemployerunlessauthorizedtodo
so,andmustfollowallapplicablepoliciesoftheemployer;

Protectandvaluehis/herprofessionalimage.

NOTE:IfanRNbecomesawareofabreachofprivacyonasocialnetworkingsite,the
CodeofEthicsstates,Nursesinterveneifothersinappropriatelyaccessordisclose
personalorhealthinformationofpersonsreceivingcare(CNA,2008,p.16).Thiscan
involvediscussingyourconcernwithacoworker,manager/supervisor,PrivacyOfficer,
andanNANBPracticeConsultant.

RoleoftheEmployer

Eachorganizationneedstocreateprivacypoliciesandproceduresthatclearlyoutlinethe
expectationsofemployersinregardtotheuseofsocialmediatechnologiesintheworksetting.
Theemployershould:

Ensurethatelectronic/socialmediapolicyisconsistentwiththeorganizationsvalues,in
additiontobeingrelevanttotheevolvingchallengesandcomplexityoftodaysglobal
village(Harned,2009);

Addresshowcertainbehavioursassociatedwiththeuseofsocialmediacanaffectthe
organization,employees,clients,andotherstakeholders;

Definethecircumstancesunderwhichtheuseofemployerownedcomputers,cameras,
otherelectronicdevices,andpersonaldevicesintheworkplaceisallowed;

Ensureclientpersonalhealthinformationsentbyemailissecureandencryptedtoavoid
interception;

CommunicateexpectationstoemployeesbyincorporatingintoorientationfornewRNs;

Identifywhoisauthorizedtopostinformationontheorganizationswebsitesandhowto
obtainpermissionfortheuseofsocialmediasitesforspecificprojectsorprograms
(CRNNS,2012);

Determinewhoisauthorizedtomakepublicstatementsonbehalfofthe
employer/organization;

Communicatethestepsthatwillbetakentomonitorandenforcecompliancewiththe
policyandestablishsupportfornursemanagershavingtodealwithinappropriateuseof
socialmediabyRNstaff;

Considerhavingeveryemployeesignaconfidentialityoathregardingthepersonalhealth
informationintheircustody(PrivacyCommissioner,2012)

Setlimitationsaroundtheuseofpersonalcellphonesandsocialmediatoolsinclinical
settingswithemphasisonthecentralimportanceofmaintainingprivacyandconfidentiality
ofclientinformation.

RoleoftheNurseEducator

Nursingprogramsshouldhavesocialmediapoliciesandguidelinesinplaceandshouldensure
thatstudentsarenotonlyawareofthembutalsounderstandtheimplications,iftheyignore
them.

Thenurseeducatorshould:

Teachstudentsaboutappropriatepersonalandprofessionaluseofsocialmediaearlyinthe
programandshouldincorporatethisinformationthroughoutthecurriculum,especially
duringdiscussionsrelatedtoprofessionalism,privacy,andconfidentiality(CRNNS,2012);

Engagestudentsinethicaldiscussionsaroundeducational/learninguseofsocialmediatools.
Studentsmustunderstandthattheyareresponsibleforwhattheypostinanysocialmedia
platform;

Engage students in ethics discussions around the need to protect the trust established as
partofthetherapeuticnurseclientrelationshipandthepropermaintenanceofprofessional
boundaries;

CONCLUSION

Registerednursesareexpectedtopractiseandbehaveinamannerthatprotectsclientsby
exercisingreasonablejudgmentwhenusingsocialmediatechnologieswhetherintheir
personallifeorintheirprofessionallife.Socialmediacanmakeapersonspoorjudgment
publicandpermanentandcanraiseconcernsaboutclientspersonalandhealthinformation
privacyandconfidentiality,boundarycrossingswithinthetherapeuticnurseclientrelationship,
andprofessionalism.
