JOINT MOTION FOR APPROVAL OF CONSENT DECREE
Pursuant to Federal Rules of Civil Procedure 7(b)(1) and 65(d), Plaintiff the United States
Equal Employment Opportunity Commission (EEOC) and Defendant Lakeland Eye Clinic,
P.A. (Lakeland) hereby respectfully submit this Joint Motion for Approval of Consent Decree.
As grounds for the motion for approval of the Consent Decree, EEOC and Lakeland state
as follows:
1.

EEOC is a federal agency responsible for enforcing federal laws prohibiting

employment discrimination, including Title VII of the Civil Rights Act of 1964 (Title VII).
2.

EEOC commenced this action on September 25, 2014, against Lakeland on behalf

of Brandi M. Branson, alleging that Lakeland terminated Branson, a transgender woman, on the
basis of her sex. See D.E. #1.
3.

Lakeland filed its Answer and Affirmative Defenses on November 26, 2014. See

D.E. #8. Lakeland denied all material allegations in the Complaint, including all allegations of
sex discrimination. See id.
4.

As a result of having engaged in comprehensive settlement negotiations, EEOC

and Lakeland agreed to resolve the Title VII gender discrimination claims asserted by EEOC in

its Complaint upon the terms reflected in the executed Consent Decree, attached as Joint
Exhibit One.

The attached Consent Decree reflects the terms of monetary and injunctive relief

to which EEOC and Lakeland have agreed after considering the specific facts of this case.
6.

EEOC and Lakeland request that the Court approve and execute the attached

Consent Decree. The Consent Decree conforms to Fed.R.Civ.P. 65(d) in that it states the reasons
why it is issued, provides specific terms with which the parties must comply, and describes in
detail the acts restrained and required.

The Courts entry of the Consent Decree will resolve all claims asserted by EEOC

in their entirety. 1

Each party agrees to bear its own fees and costs associated with this Action.

9.

EEOC and Lakeland, however, request that this Court retain jurisdiction to

enforce the terms of the Consent Decree.


WHEREFORE, for the foregoing reasons, the Parties respectfully request that this Court
grant this Joint Motion for Approval of Consent Decree, execute the attached Consent Decree,
enter it as an Order of this Court, deny all pending motions as moot, and administratively dismiss
this Action in its entirety subject to the Court retaining jurisdiction to enforce the Consent
Decree.

Charging Party Brandi Branson, through her attorney, Jillian Weiss, Esq., moved to intervene in the
EEOCs case on December 12, 2014. See D.E. #18. That motion remains pending before the Court and,
therefore, to date, Branson has not been granted Intervenor status. Branson, however, has also resolved
her claims against Lakeland. However, because Branson is not a party to the Consent Decree, any claims
she resolves are addressed privately between Branson and Lakeland.
