We, the undersigned Overseas Filipino Workers (OFWs) in South Korea respectfully
request the Department of Labor and Employment (DOLE) Secretary Marianito D.
Roque to grant an extension of tenure to Labor Attache’ Atty. Delmer R. Cruz’s term
until June 30, 2010. During this period, there are urgent labor issues in South Korea
affecting OFWs that could be better addressed by an incumbent Labor Attache’ in view
of his familiarity with the developments here.
Atty. Delmer R. Cruz is currently based in Seoul, South Korea and his term will end on
January 28, 2010. He assumed the office in July of 2007. Since then, he has served the
Filipino workers for a total of 18 months.
For the past several years, the Filipino overseas workers in South Korea have truly
suffered from the inconsistencies of the provisions and implementation of labor laws,
and the ineffective handling of migrant issues and problems. Consequently, the gap
between the overseas workers and Philippine Embassy officials increased. Filipino
communities, organizations, and churches have lost confidence in the Philippine
Embassy.
There had been a need for somebody who could truly understand the reality of the
overseas Filipino workers, who are forced by economic circumstances to seek work far
away from home to save their families from poverty and starvation; somebody who
could bridge the gap between the Korean employers and the overseas Filipino workers,
as well as negotiate with the Korean government offices; and somebody who could
contribute to the development of new policies and regulations benefiting both the
overseas workers and the government.
We, the OFWs in Korea, started to see some hope, when the Philippine government sent
a new Labor Attache’ to South Korea in the person of Atty. Delmer R. Cruz. Upon
assuming the office, he began a series of meetings and consultations with the different
groups and leaders who represented the multitude of overseas Filipino workers in South
Korea, and studied the tenets of Korean Labor laws and reviewed the existing labor
policies and regulations of both countries. Thus, before the end of his term, he
accomplished the following: a) he resolved selected Korean labor-related problems;
b) bridged the gap and improved relationship between the Filipino overseas workers and
the Philippine Embassy; c) established better working relationships with the Korean
Ministry of Labor, Ministry of Justice, National Labor Consultation Center, Law
Enforcers, and other related government offices; d) lobbied to improve policies and
regulations particularly on the entertainment industry; e) worked on the extension of
RP-ROK MOU on EPS and the extension of sojourn to five (5) years; f) established
services to uphold the welfare of artists/performers; g) is instrumental in the
preparations for the celebration of the 15th Filipino Migrant Workers’ Day to be held in
early June 2010; h) continuously created programs and activities to improve labor
relations between Filipino overseas workers and their employers.
Moreover, we hope for the implementation of Labor Attache’ Cruz’s other important
plans for the Filipino workers. Among such plans are: a) Korean Language Test (KLT),
a plan that has not yet been implemented as it is still in the process of negotiation; b) an
effective policy against the trafficking of Filipino women by marriage agencies, c)
nationwide information campaign on New EPS Revised Bill. However, if his term will
end soon, we fear that these will not be properly and efficiently carried out.
We, the petitioners, have witnessed the outstanding performance of Labor Attache’ Cruz
in pursuing the welfare of the Filipino migrant workers in South Korea. We needed his
services for some more time so that the momentum of the positive developments that he
spearheaded would not be lost but sustained. We believe that his one-year-and-a-half
term of office is not enough, and that, if given another chance, there is much more that
he can do to improve the situation of the Filipino overseas workers in South Korea. We
have faith in his ability to deliver the goods in our favor. Thus, we are strongly
motivated to request for the extension of his term.
For the reasons we have stated above, we, hereby, reiterate our collective appeal to the
Department of Labor and Employment Secretary, Marianito Roque, to grant an
extension of tenure until June 30, 2010 to Labor Attache, Atty. Delmer R. Cruz, who
truly deserves to be reinstated to the aforementioned post in South Korea.
