POLICE REPORTS
MURDER
The killing of Filipino transgender woman Jennifer Laude was a "crime of hatred," according to
the investigation report of Olongapo police.
The report dated Tuesday, October 14, sought to determine the cause of death of the 26-year-old
Laude. The principal suspect behind the death is a US Marine, identified by witnesses as Private
First Class Joseph Scott Pemberton.
According to the report prepared by investigator-on-case SPO3 Tyrone DP Tecson, the suspect
engaged Laude for "sex service."
His discovery that Laude was "gay," the report said, "prompted him to kill the victim."
On Saturday, October 11, Laude was found dead at Celzone Lodge in Olongapo City. An earlier
police report said her head "was leaning" against the toilet bowl while her "lower body was
partially covered with a color cream blanket."
Police said they saw injuries on Laude's neck. An autopsy report later said Laude died due to
"asphyxia by drowning."
Witness Mark Clarence Gelviro told police that Laude met a "white male foreigner" at Ambyanz
disco bar located along Magsaysay Drive East Tapinac.
After accompanying Laude and the suspect to check in at the Celzone Lodge, Gelviro said he
was asked by Laude to leave "before the suspect [could] discover that they are gays."
The crime was reported to the police by the lodge's cashier, 24-year-old Elias Galamos, who said
that he found a dead body in Room No. 1 of the lodge.
The investigation report said the suspect "passionately check in (sic) transgender Jeffrey Laude y
Serdoncillo at Celzone Lodge for sex service."
"[Later the] suspect discovered that his sex partner was...gay that prompted him to kill the
victim," it added.
The report also recommended "that a murder case be filed against PFC Joseph Scott Pemberton."
The 19-year-old Pemberton is assigned to the 2nd Battalion, 9th Marines, onboard US warship
West Pacific Express. He is currently under US custody, following a provision in the Visiting
Forces Agreement (VFA) signed between the Philippines and the United States.
Under the VFA, the Philippines can seek custody of a US soldier accused of committing a crime
in its territory under "extraordinary circumstances."
The Philippines has already said that it wants to get the American soldier under custody, a
request that the US can opt to deny.
On Wednesday, October 15, Laude's family filed a murder complaint against Pemberton before
the prosecutor's office in Olongapo City.
The city prosecutor will determine if there's enough prima facie evidence to file murder charges
against Pemberton in court.
ESTAFA
A cousin of former First Gentleman Jose Miguel Arroyo, who has an outstanding warrant for
syndicated estafa, was arrested at his home in a posh subdivision in Muntinlupa City on Tuesday.
Arrested was Benito Ramon Araneta, one of those accused of misappropriating nearly P230
million from a bank that went bankrupt in 2011, the Philippine National Police (PNP) announced
on Wednesday.
Araneta is facing 15 counts of estafa for allegedly colluding with former LBC Development
Bank president Ma. Eliza Berenguer to defraud the bank.
The case, earlier lodged in the Department of Justice (DOJ) by the Philippine Deposit Insurance
Corp. (PDIC) on behalf of bank depositors, is being heard at the Makati Regional Trial Court
Branch 143.
Presiding Judge Maximo M. de Leon released a warrant for Aranetas arrest on Aug. 1.
Araneta was arrested at his home on Acacia Avenue in Ayala Alabang subdivision at 4:10 p.m on
Aug. 12.
A statement, posted in 2013 on the PDIC website, said the PDIC complaint in the DOJ accused
Berenguer of directly instructing the principal officers of LBC Bank to divert funds of the bank
to deposit accounts owned by Araneta and five other borrowers from October 2006 to January
2008.
Araneta was able to borrow money totaling P229,469,505.10. In collusion with Ms Berenguer,
they were able to appropriate the money for personal use. During the stint of Ms Berenguer as
president, it was shown that Mr. Araneta already paid, but in fact, he never paid the money he
borrowed from LBC Bank, Sindac said, quoting the results of the PDIC probe when it took over
the bank upon its closure on Sept. 9, 2011.
Sindac said the unsafe and unsound banking practices resulted in damage [to] an
undeterminable number of depositors and [to] their hard-earned money.
Araneta is now detained with the Intelligence Group.
Senior Supt. Allan Nobleza, Muntinlupa Citys chief of police, said the court did not recommend
bail for Araneta.
Nobleza said members of the PNP Intelligence Group of the National Capital Region
spearheaded the operation while the city police acted as support.
Roselyn Sato, who is in charge of criminal cases in Branch 143, said that as of 4:03 p.m.
Wednesday, the court had yet to receive the report that Araneta had been arrested.
She said that upon the submission of a report by arresting authorities, a commitment order
specifying where Araneta should be detained would be issued by the court.
RAPE
Another female student of the University of the Philippines Los Baos (UPLB) was raped almost
on the same spot where UPLB student Given Grace Cebanico was raped and killed almost at the
same time three years ago.
Dr. Enrique Tolentino Jr., the UPLB Vice Chancellor for Community Affairs, confirmed on
Thursday, that the rape of a 17-year-old female college student has been reported to the police,
but he requested that all information regarding the identity of the victim be withheld.
The victim, now in the care of the Los Baos police, is still suffering from trauma, Tolentino
said.
Supt. Ricardo Dalmacia, Los Baos police chief, declined to give details as requested by the
family but gave an assurance that police investigation has started.
Tolentino said probers have learned that the victim left the UPLB campus, after attending a
student event, around 9 p.m. on Wednesday.
The victim took a tricycle in Barangay (village) Maahas, an adjacent village to the campus, in
going home to Barangay Paciano Rizal, also referred to as Barangay Mainit.
Ronald Oate, barangay chief of Putho-Tuntungin, said the victim was able to send her mother a
text message around 11 p.m. that she was already in Sitio Buot of Mainit.
But before reaching her residence, the tricycle driver stopped in the guise of running out
gasoline, both Oate and Tolentino said in separate phone interviews.
The driver then took the victim to a dim portion along the IPB Road, also in Putho-Tuntungin,
with a weapon held against her. It was still unclear what kind of weapon was used.
University officials were closely working with the local police and the Criminal Investigation
and Detection Group in the Calabarzon (Cavite, Laguna, Batangas, Rizal, Quezon region) to
solve the case.
Oate said they were tracing the color of the tricycle to see if it belonged to any drivers
association here.
On Oct. 11, 2011, Cebanico, a 19-year-old junior Computer Science student, was raped and
killed, prompting unrest in the university and local community. A group of UPLB students, in
fact, had just commemorated Cebanicos third death anniversary.
Tricycle driver Percival de Guzman, who reportedly picked up Cebanico on the night she went
missing, and bank security guard Lester Ivan Lopez were arrested for the rape and murder of
Cebanico. The court trial is still ongoing.
After Givens (death), lamp posts were immediately put up along that (IPB) road. I just dont
know what happened why the lights were gone (in recent months). That place had always been
our problem because it was really dark at night, Oate said.
