Judicial developments
Ayyash et al. case

This case relates to the attack of 14


February 2005 in Beirut.
Pre-Trial Brief:
On 15 November, the Prosecution at the
Special Tribunal for Lebanon filed its PreTrial Brief, which includes as annexes the list
of witnesses it intends to call at trial, and
the list of exhibits it intends to offer into
evidence.
According to the Pre-Trial Brief, the
Prosecution intends to call 557 witnesses,
there are 13,170 exhibits on the exhibit list,
and the total time estimated for
presentation of the Prosecution's case is
457.5 hours.

The filing of the Pre-Trial Brief is in


accordance with a deadline set by the PreTrial Judge as part of the preparation for
trial.
The Prosecution's 58-page Pre-Trial Brief
elaborates on the allegations and charges in
the Indictment. It includes, for each count
charged in the Indictment, a summary of the
evidence which the Prosecution intends to
bring regarding the commission of the
alleged crime and the form of responsibility
incurred by the accused.

The Pre-Trial Brief and its associated


documents were all filed on a confidential
basis. A public redacted version is available
on the STL website.
The list of witnesses and list of exhibits will
remain fully confidential, unless the judges
decide otherwise.
Important dates:
17 December 2012 Legal Representative for the
Victims files the list of witnesses and exhibits he
would like to use for trial.
9 January 2013 Defence file their pre-trial briefs.
25 March 2013 - The tentative date for the start of
trial.

In absentia trials:
On
1
November,
the Appeals
Chamber unanimously dismissed challenges
by the Defence asking for a review of the
decision to begin an in absentia trial against
the four men accused in the 14 February
2005 attack.
The Trial Chamber decided in February to
try the four accused Salim Ayyash,
Mustafa Badreddine, Hussein Oneissi and
Assad Sabra in their absence after they
failed to appear before the Tribunal.
Upon being appointed, lawyers for the four
accused asked the Trial Chamber to
reconsider its ruling, but the judges denied
the request. Defence counsel appealed that
decision.

In the 1 November decision, the Appeals

finding that the accused were informed of
the charges and proceedings against them.

Trial preparation:
The Pre-Trial Judge held a status conference
on 27 November as part of his duties to

ensure that the proceedings are not unduly


delayed. The Pre-Trial Judge examined
Defence preparations for trial in light of the
volume of material submitted by the
Prosecution as part of its Pre-Trial Brief. He
also examined how much of the evidence
had been disclosed to the Defence already,
and what material remained to be provided
to the lawyers for the four accused.

Events and visits


Video Q&As with Tribunal officials
The STL has continued to release a series of video questions and answers addressing
relevant issues about the Tribunal. Alain Grellet, Head of the Victims Participation Unit,
discussed whether victims of the 14 February 2005 attack can still participate in proceedings
before the Tribunal, and Head of Defence Office Francois Roux discussed the time the
Defence needs to prepare for trial. All videos will be available on the STL YouTube channel in

STL President visits Lebanon
Judge Sir David Baragwanath, the STLs President, visited Lebanon from 26 to 29 November.
He met with a number of officials and journalists, and participated in an outreach event with
academics.

STL Registrar answers questions live on Twitter


The STLs Registrar, Herman von Hebel, held a live question and answer session with
Lebanese citizens and journalists on 5 November, and answered a wide range of questions
about the work of the STL.
Visits
This month, members of the International Association of Conference Interpreters (AIIC)
visited the Tribunal. The AIIC is a global association of conference interpreters.
