Dear Assistant Secretary Myers,

I am writing to request participation in the Delegation of Authority Program


pursuant to 287 (g) of the Immigration and Naturalization Act. Given our past
relatio;,ship with ICE, this partnership will enable us to better serve and meet the
needs of the residents of Middlesex County Massachusetts.

I have been in communication with your Qffice in Boston. Assistant


Special Agent in Charge, (b~6 b)(7 C i has been very helpful and

encouraging. With his advice, I am proposing the following:

• Establishment of an Identification Review Officer at our Middlesex County


Jail, located in Cambridge, Massachusetts. This is our pre-trial detention
facility.

• Train (6) Sheriffs Deputies assigned to the Records and Receiving


Division with a minimum of two years experience, who have passed a
security background acceptable to ICE.

• Training facilities are available at our Training Academy where Instructors


can utilize computer training aids, videos and other materials they may
need in instructions.

This program will allow us to enter into a Memorandum of Understand in!
that will enable us to participate with I.C.E. in identifying criminal illegal aliens
who pose a risk to the citizens of Middlesex County.

Authority to the Middlesex County Sheriffs

This is a memorandum of non support of the Middlesex County Sheriff s Office application for
287(g) Delegation of Authority.

On May 7,2008, Middlesex County Sheriff's Office, located in Massachusetts, submitted a formal
request for 287(g) authority to the Assistant Secretary.

The Boston Field Office lacks sufficient personnel resources, including positions associated with
supervisory oversight, docket management, custody/removal, clerical suppo~ and associated costs,
such as detention space and funding, to support a 287(g) program at this location

Without further resources, the Boston Field Office does not recommend approval of the Midd1esex
County Sheriff's Office for a 287(g) Program at this time. The Boston Field Office will contioue to
serve this facility through the ICE ACCESS components, particularly the Criminal Alien Program
(CAP). The Boston CAP Unit will continue in our law enforcement partnership with the Middlesex
County Sheriff" s Office by vetting the inmate population of this facility, and processing aliens
amenable to removal. The Boston CAP unit will also ensure that the Middlesex County Sheriffs
Office knows how to conduct NLETS Queries through NCIC, to the Law Enforcement Support
Center (LESC) for after hour apprehensions.

Although I cannot recommend Middlesex County Sheriff s Department for the 287(g) program at
this time, I would recommend that they be considered in the future expansion of the Secure
Communities Inter-Operability program.
