General Terms and Conditions

for courses and seminars
General
All services rendered as part of our suitability tests, courses and seminars are subject to the General Terms and
Conditions for courses and seminars at the Air Navigation Services Academy (the Academy).
Enrolment and contract

The content of courses and seminars is defined in the Academys information sheets and offers.
To enrol, applicants complete the enrolment form or confirm in writing by post or facsimile that they accept our offer. DFS will
promptly send the applicants confirmation of their enrolment. A contract shall only be deemed formed when DFS confirms the
enrolment in writing.
In the case of discrepancies between the information sheet and the enrolment form, the provisions of the enrolment form shall
prevail.
Given the fact that there are only a limited number of places on courses and seminars, the Academy allocates places on a firstcome, first-served basis and endeavours to arrange alternative dates for any unsuccessful applicants.
Applicants details will be stored electronically for the duration of the process. They will be deleted when they are no longer
required.
Cancellation
The contract may be cancelled free of charge up to four (4) weeks before the course or seminar begins. In the event of
cancellation at a later stage or non-attendance, the full course and/or seminar fee shall be paid. In such a case, the contract
partner is entitled to prove that the Academy did not incur any damages or that the damages did not amount to the full fee.
Partial attendance of courses and seminars does not entitle participants to a reduction in fees.
The Academy reserves the right to cancel courses or seminars if the minimum number of participants is not achieved or if the
teaching staff is sick. In such cases, contract partners shall be informed immediately and the Academy will try to arrange
alternative dates for the participants if they agree to this. Otherwise, the Academy will reimburse the participants with the fees
they have already paid; there shall be no further claims.
Terms of payment
The fee stated in the offer or enrolment form shall be due upon receipt of the invoice in any case before the course or seminar
commences.
Copyright
All rights reserved (including rights relating to translations, reprinting and reproduction of course and seminar materials or parts
thereof). It shall not be permitted without the written consent of the Academy to reproduce, process, duplicate, distribute or
publicly broadcast (especially using electronic systems) any part or excerpt of the course and seminar materials, not even for
the purpose of preparing the lesson.
Liability
DFS shall only be liable for damages resulting from violations against life, the body or ones health if DFS is found to be in
breach of its obligations and for other damages caused by malice aforethought or gross negligence.
DFS shall be responsible for any negligence of its legal representatives or persons employed in the performance of its
obligations in the same way as for its own negligence.
DFS shall not assume any liability over and above the foregoing.
Success of the training
DFS cannot guarantee the successful participation in or successful completion of the course or seminar by the participants.
Safety
The participants shall undertake to observe the safety regulations valid at the place of performance.
Place of performance
Langen, near Frankfurt, shall be the place of performance.
Legal basis, supplementary agreements and place of jurisdiction
The contract is solely governed by the law of the Federal Republic of Germany. All supplementary agreements shall be made in
writing. If the contract partner is a registered trader, a legal person under public law or a separate fund under public law, the
place of jurisdiction shall be Langen/Hessen.
