The Indian Media and Entertainment Industry witnessed 12% growth in 2013 touching INR 920 Billion and it is expected to
double in size by 2017. Last year was a turbulent year for the Industry; with economic slowdown it faced regulatory as well as
business challenges. However, 2013 was a year in which the foundation of the industry was strengthened to position for
growth. With new government in place, industry has high expectations for a conducive environment for doing business in India
& abroad.
An aggressive industry research that Lex Witness conducted within the various stakeholders of the industry reflects a lot of
ambiguity in the understanding of the current legal & regulatory regime. The 3rd Annual Edition of Media, Advertising &
Entertainment Legal Summit 2014 promises to brainstorm on the challenges faced by the Media, Advertising & Entertainment
Industry and we shall together look forward to the possible solutions to it.
THE COPYRIGHT AMENDMENT ACT 2012 WHATS RIGHT & WHATS WRONG?
After almost 2 years of the amendment, the industry still struggles to decode its implementation. With two schools of thoughts on
royalty payments, royalty wars between artists and producers/music labels remains a topic of industry debate.
ANALYZING THE NEED OF LICENSE RAJ & FOREIGN DIRECT INVESTMENT
Current FDI & Licensing policies have staggered the industry growth and it demands for a better environment for doing business. The
FDI limit for Uplinking & Downlinking of Television Channels from India as well as Mandatory Licensing Policy are practical
challenges for a favourable business decision.
TAXATION REGIME FILM FINANCING NEW COMPANIES ACT :: BUSINESS IMPACT & WAY FORWARD SOLUTIONS
While The Companies Act has accomplished its complete awareness, niche sectors like advertising agencies continue to struggle
with its clear understanding on certain conducts. The industry expects simplification of the current tax codes as multiple & heavy
taxes are hindering the respective sectors growth scopes. Higher interest rates by banks for film financing is making difficult for the
Film Industry to look at an open ended business scenario.
DEFINING RIGHTS OF THE OWNER INDUSTRY PERSPECTIVE
WIPO treaty in respect to Digital Rights Management needs more clarity and understanding. The legal complications related to
streaming of content and Cloud Computing results in business hurdles.
REGULATORY & POLICY FRAMEWORKS CURRENT & FUTURE ANALYSIS
With the mandatory DAS roll out in phase two cities, are we ready for phase 3? The tussle between MSOs and LCOs There are other
issues like packaging, billing and agreements that still need clear indications on. The regulations related to aggregators will likely
change the style of business.
On parameters of obscenity, decency and religious sentiments; regulatory bodies have been judging content. Has industry finally
realized a need of self-regulation? Even with liberty of freedom of speech & expression, is there a need for the industry to revisit selfregulation and hygiene at home aspects?
The industry dynamics varies from highly competitive content creation to content dissemination. The uneven nature of market
trends has led to certain anti-competitive issues. The CCI & COMPAT have been fairly proactive in their enforcement endeavors in
relation to anti-competitive practices, cases of abuse of dominance and merger control.

the agenda
Contracts are an integral part at transaction. Apart from the intellectual weight of contract in place, it is imperative to realize
utmost commercial value of intellectual contribution. The session will shed light on the right contractual terms, key clauses,
due diligence and many more aspects in a high value contract.
The never ending gaps, between The Copyright Amendment, its interpretation in terms of impact and benefit continues to
be a road block for the media sector, striving towards fair and protected environment. In the interest of the sector there is a
need for a conscious approach by the sector stakeholders and the Government towards creating clarity on aspects like
royalty payments, DRM, fair use of content, digital convergence & WIPO Treaty, and issues related to beneficiary with legal
implications attached to it.
The Media & Entertainment Industry is yet to get its rightful place in the taxation regime. While exorbitant taxation norms
and policies remain an issue, to add on, the multiple taxation has been a major point of debate between industry players and
the government. The experts on the panel will discuss the need for urgent tax reform in the sector to usher in the next level of
growth.
The recent regulations passed extension for digitalization of Cable TV Phase III & IV by a year, which led to turmoil in the
industry. For the sector to grow there is a need for a consistent and stable policy framework. The expert on the panel will
focus on how postponement of digitization will ruin the market and monetization opportunity and hinder its growth
prospects.
11:00 THE NEW COMPETITION PARADIGM ENSURING A FAIR GAME FOR ALL
16:00 NETWORKING & REFRESHMENT BREAK
There has been a concerted approach by the media sector towards creating healthy and competitive environment across
value chain. However, the presences of multiple regulatory bodies are hampering the industry to follow a set of common
norms. Should there be centralized regulated bodies/societies to usher in new directions in terms of protection and
implementation of competition law/norms? The session will discuss competitive practices, steps and solutions to restrict
trade practices which are not in compliance with the competition law interplay between sectoral regulators and trade- off
between copyright - competition and ownership narratives.
Content control has been a debatable subject ever since. While the industry has taken a number of initiatives to self-regulate. The experts
will discuss and shed light on the need for defining a new approach with the participation of the stakeholders which could be given
statutory recognition.
