MUNICIPAL ORDINANCE NO. 04 - 2015


AN ORDINANCE PRESCRIBING NEW FEES AND CHARGES IN THE OPERATION AND
MANAGEMENT OF THE PLARIDEL PUBLIC SLAUGHTERHOUSE
On motion of SB Member Charlito T. Tan, duly seconded by SB Member Marilou V. Yap,
and favorably supported by all the SB Members present
Be it ordained by the Sangguniang Bayan of the Municipality of Plaridel, Misamis
Occidental, in session assembled.
SECTION 1. TITLE This ordinance shall be known as the AN ORDINANCE
PRESCRIBING NEW FEES AND CHARGES IN THE OPERATION AND MANAGEMENT OF
THE PLARIDEL PUBLIC SLAUGHTERHOUSE.
SECTION 2. SCOPE This ordinance shall govern the desired fees and charges in the
Public Slaughterhouse operation.
SECTION 3. DEFINITION OF TERMS As used in this ordinance, the following terms
shall mean and interpreted as indicated hereunder.
a.) CARCASS refers to the body of any slaughtered animal after bleeding and
dressing.
b.) BRANDED CATTLE refers to the cattle that are labelled which as safe for
consumption.
c.) AUTHORIZED BUTCHER refers to the licensed slaughterers.
d.) CORRAL is a cage in the slaughterhouse where animals are kept or deposited
before they are slaughtered.
e.) SLAUGHTERHOUSE refers to the premises that are approved and registered by
the controlling authority in which food animals are slaughtered and dressed for
human consumption.
f.) INSPECTION refers to an examination by an official inspector to ensure
compliance with rules and regulations including but not limited to humane handling of
slaughter animals, ante- and post-mortem inspection, quality assurance program,
hygiene and sanitation program, good manufacturing program, sanitation standard

operating procedures, hazard analysis critical point program, residence control program
on any meat product, meat establishment facilities, transport vehicles and conveyance.
g.) INSPECTOR refers to a professionally qualified and properly trained officer, duly
appointed by the local government unit for meat inspection and control of hygiene
under the supervision of a veterinary inspector.
SECTION 4. SLAUGHTERHOUSE FEES. There shall be collected fees for the slaughter
of animals and the use of corrals in accordance with the provisions of this chapter at the
slaughterhouse operated by the Municipal Government.
SECTION 5. PERMIT FEE. Before any animal be slaughtered for public consumption, a
permit shall be secured from the Municipal Meat Inspector or his duly authorized representative
and the corresponding fee as follows:
Large Cattle/Carabao, Hog, Goat, Sheep

SECTION 6. SLAUGHTER FEES. For public and Home consumption on the basis of

SECTION 7. A. ANTE-MORTEM INSPECTION FEE. An Ante-Mortem inspection shall


be made of all food animals by authorized inspectors before it shall be allowed for slaughter in
which the meat or meat products are to be sold. An amount shall be collected for inspection of
all food animals to determine the presence of disease/abnormal conditions at the following fees:
Large cattle/carabao
Hogs
Goats
Sheep
Poultry
Others

SECTION 7. B. POST-MORTEM INSPECTION FEE. a) The Post-Mortem inspection


and examination of carcasses and parts thereof of all food animals for sale shall be conducted.
An amount shall be collected for the inspection of carcass and edible fats of animals, poultry
slaughtered/dressed to detect the presence of disease and abnormal condition at the following
fees:
Large Cattle/Carabao
1.25/kilo
Hogs
0.75/kilo
Goats
0.75/kilo
Sheep
0.75/kilo
Poultry
0.75/kilo
Others
0.75/kilo
SECTION 8. The carcasses and parts thereof of all such animals found clean, safe and
fit for human consumption shall be marked, stamped, and tagged or labelled by the Meat
Inspector as INSPECTED AND PASSED. All carcasses and parts thereof found to be unfit for
human consumption shall be marked INSPECTED AND CONDEMNED.
SECTION 9. WEIGHING FEE. For every use of the weighing scale at the
slaughterhouse, there shall be collected P10.00/head.

SECTION 10. CORRAL FEE. Fees at the rates, per day or fraction thereof, shall be
collected for the animals to be slaughtered which are deposited/kept in a corral owned by the
municipal government as follows:
Large Cattle/Carabao

Sheep
Fowls

SECTION 11. LIVESTOCK DEVELOPMENT FUND. In addition to the above fees, an


amount of Ten Pesos (P10.00) shall also be collected for every slaughtered food animal that is
intended for Livestock Development Fund.
SECTION 12. PLACE OF SLAUGHTER. The slaughter of any kind of animal for sale or
for any commercial purposes shall be done only in the municipal slaughterhouse. The slaughter
of animals intended for home consumption may be done elsewhere; provided that the animals
slaughtered shall not be offered for sale.
SECTION 13. DEATH OF AN ANIMAL. The slaughterhouse caretaker shall not be liable
to the food animal placed in the corral nor be responsible to the loss thereof.
SECTION 14. PERSONAL HYGIENE AND REQUIREMENTS FOR PERSONNEL
WORKING IN THE SLAUGHTERHOUSE AND MEAT HANDLERS. All butchers and/or meat
handlers shall:
a) Secure a License or Mayors Permit every year upon payment of the following fees:
i) Occupational Fee

v) Mayors Permit

vi) ID Production and Lamination

b) Undergo an orientation to be conducted by the Municipal Veterinarian of the
Municipal Agricultures Office.
c) Wear proper attire and uniform as prescribed by the Municipal Veterinarian.
d) All persons entering the slaughtering area must be in clean clothes and white rubber
boots.
e) Not have a beard or mustache, must wear short hair and must have regularly
trimmed fingernails; and
f) Not wear sleeveless, shorts, shoes and slippers.
SECTION 15. REQUIREMENTS FOR THE ISSUANCE OF PERMIT FOR THE
SLAUGHTER OF LARGE CATTLE. Upon the issuance of the permit required in Section 5,
large cattle shall be slaughtered at the Municipal Slaughterhouse. Before issuing the permit for
the slaughter of large cattle the treasurer or his representative shall require, for branded cattle,
the production of the Certificate of Transfer showing the Title in the name of the person
applying for the permit, if he is not the original owner and there is no certificate of transfer made
in his favor, one such certificate shall be issued and the corresponding fee collected therefore.
For unbranded cattle that have not yet reached the required age of branding, the treasurer or
his representative shall require such evidence as will be satisfactory to him regarding the
ownership of the animal for which permit to slaughter has been requested. For branded cattle of
the required age, the necessary owners and the transfer certificate shall also be issued and the
corresponding fees shall be collected, therefore, before the permit is granted.
SECTION 16. PROHIBITED ACTS:
a) Slaughtering of animals other than in designated areas;
b) Selling of carcass or meat of animals not slaughtered in the slaughterhouse.
c) Bringing out of carcass prior to inspection; and

d) Non-payment of fees.
SECTION 17. OTHER PROHIBITED ACTS:
a) Smoking, urinating, spitting, blowing of nose and eating inside the slaughterhouse;
b) Intoxication and/or drinking of alcoholic drinks within the slaughterhouse compound;
c) Loitering/standing by inside the slaughterhouse and/or premises;
SECTION 18. AUTHORITY OF THE SLAUGHTERHOUSE SUPERVISOR/
CARETAKER. The designated slaughterhouse supervisor/caretaker of the slaughterhouse
compound is hereby authorized to promulgate and implement additional rules and regulations
not covered by this ordinance in the operation of the Municipal Slaughterhouse as deemed
necessary.
SECTION 19. PENAL PROVISION. The following are the offenses and penalties in this
Ordinance.
a) Any person found to have violated any provision of Section 16 hereof shall be meted
penalty of:
i)
First Offense
- suspension of license for one (1) week; confiscation of
carcass in favour of the government and a fine of P1,000.00
ii)
Second Offense - revocation of license; confiscation of carcass in favor of
the government and a fine of P1,500.00
b) Any person found to have violated any provision of Section 17 (a) & (b) hereof shall
be meted penalty of:
iii)
First Offense
- suspension of license for one (1) week and a fine of
P100.00
iv)
Second Offense - suspension of license for two (2) weeks and a fine of
P200.00
SECTION 20. DISPOSAL OF CONFISCATED MEAT. All confiscated or seized
carcasses in favour of the government shall be disposed of in accordance with existing laws and
regulations.
SECTION 21. SEPARABILITY CLAUSE. If, for any reason or reasons, any part or
provisions of this Ordinance shall be held unconstitutional or invalid, other parts or provisions
hereof which are not affected thereby shall continue to be in full force and effect.
SECTION 22. REPEALING CLAUSE The provision of all laws, rules and regulations
or orders which are inconsistent with this Ordinance are hereby repealed or modified
accordingly.
SECTION 23. DATE OF EFFECTIVITY This Ordinance shall take effect fifteen (15)
days after its posting in at least three (3) conspicuous places of the municipality.
