Leave and License Agreement

This Agreement of Leave and License is made at Pune on this


Saturday 1st of June 2013.
BETWEEN

Mr. Holi Ratnakar, Age 34 years, OccupationService, Address-Durgabari, bhatta bazaar, Purnea, Bihar-854301, his
Pan no.AIFPR80457.
Hereinafter referred to as The Licensor

As the Party of the First Part

AND

Mr. Adhish Prabhakar, Age 32 years, Occupation- Service,


Address- House No:77,Sector 3, Nanak Nagar, Jammu Tawi, Jammu &
Kashmir-180004,his PAN card no.AQJPP3970F.herein after referred to
as the Licensee which expression shall unless it be
repugnant to the context or meaning thereof shall mean and
include their legal heirs, executors, administrators and
assignees.

As the Party of the Second Part

WHEREAS

a) The Property at Flat No. 204,Wing C, Ganeesham


Phase 2, Near Govind Garden, Pimple Saudagar ,
Pune. Well sized and possessed and owned by the
Licensors hereunder written and herein after for the
sake of brevity and convenience referred to as the
said Flat / Premises.
b) As the licensor is not temporarily in need of
occupation of the said flat / premises.
c) The Licensee have approached the Licensor with a
request to allow the Licensee to temporarily occupy
and use the said flat for his personal residential
purpose,
d) The Licensor have agreed on the basis of Leave and
License to the Licensee to occupy and use the said
flat / premises only for his personal residential
purpose.

NOW IT IS AGREED BY AND BETWEEN THE PARTIES


HERETO AS FOLLOWS:

1) Description of the Property :


Flat No.204, Wing C, Ganeesham Phase 2, Near
Govind Garden, Pimple Saudagar, Pune has an
approximate area of about 63.45 Sq Mtrs (Carpet) +4.65
Sq Mtrs (Attached Terrace) with all electrical points,
fixtures and fittings , fans, boilers, taps, hot and
cold water mixers and showers, and appurtenances
there to along with electricity meter, exclusive
reserved covered car parking (2 nos). The premise
is within the jurisdiction of Pune Municipal
Corporation.

2) Terms of Payment of Agreement


The Licensee will pay to the Licensor a License Fee
of Rs.14000/- per month (Rs. Fourteen Thousand
only) inclusive of Society Maintenance, in advance
every month on or before Fifth Day of each English
Calendar Month in cash and or by local bank
cheque or demand draft or by online bank transfer.
Electrical charges, at actual will be paid by the
Licensee on due dates to MSEB and receipts given
to the Licensors for their records. The Licensors
acknowledge the receipt of the Security Deposit of
Rs.50000/- (Rs. Fifty Thousand only) paid by the
Licensee on 14-02-2012 by cash or cheque or by
online bank transfer. And hence there is no need of
separate receipt being issued. This Security Deposit
will be refunded without any interest by the
Licensors to the Licensee at the time of handing
over vacant and peaceful possession of the flat to
the licensors after deductions if any towards
damages, repairs, outstanding electricity and
maintenance bills etc.

1) The Licensor herby grant the permission to the


Licensee to occupy and use
the said flat /
premises for the purpose of his sole residence on
Leave and License basis for a period of eleven
months starting from 1st Jan 2015 to 30th
November 2015.

4) All the municipal taxes and other taxes and levies,


building
maintenance charges of the housing
society in respect of the
licensed flat / premises
will be paid by the Licensor. There will be an increase
of 10% in the monthly rent after 11 months of
successful completion of the agreement period

5) The original agreement will always remain with


the Licensor and a copy of the stamped duly
signed by both the parties shall be retained by
the Licensee.
6) The Licensed premises are given to the Licensee
for his personal residential use only and the
Licensees will not be entitled to rent, sublet or
transfer the benefit of this agreement to
anybody else or will not be entitled to allow
anybody else to occupy the premises or any
part thereof except her family members.
Nothing in this agreement shall be deemed to
grant a tenancy right and the Licensee agrees
and undertakes that Licensee shall take up no
such contention at any time.
7) The Licensee shall maintain the said flat in good
livable condition and will not cause any
damage thereto. If any damage is caused to
the licensed premises or any part thereof by the
Licensee the same shall be made good by the
Licensee by repairing, replacing, rectifying the
damage or by paying cash compensation as
may be determined by the Licensor. The
Licensor will be responsible for rectification of
major defects such as leakage, seepage or any
other major repairs of the flat.
8) The Licensee will not carry out any work of
structural nature, repairs or additions or
alterations of any kind in the licensed flat
without informing the Licensor in advance and
seeking their written permission.
9) The Licensee will not cause any nuisance or
annoyance to the people in the neighborhood or
in the housing society or store any explosives,
armaments, dangerous inflammable, hazardous
narcotic materials and equipment in the said
flat.

10)
The Licensor will have all the time
unobstructed right to inspect the flat with prior
notice and the Licensee shall not raise any
objection for it.
11)
If the Licensee commits any breach of the
terms and the conditions of this agreement the
Licensor shall be entitled and have the
rights
to terminate this agreement by giving thirty
days prior notice to the Licensee and initiate
action to protect interest of Licensor.
12)
The parties of this agreement are option
to leave the said premises and or authorized to
vacate the said premises without completing
the period of 11 months as a stated herein
before to giving one Month prior notice to that
intention to each other in advance.
13)
On the expiration of the said terms or the
period of this License the Licensee shall stop the
use of the said flat / premises and handover
vacant and peaceful possession of the licensed
premises to the Licensor without demure or
protest in the same condition in which the
Licensee had taken the possession.
14)
If the Licensees fail to vacate the licensed
flat after termination of this agreement then
the Licensor will be entitled to remove all the
belongings of the Licensee from the said
licensed flat on their own and take the
possession of the said flat by force.
15)
This agreement will always subject to the
provisions of section 24 of Maharashtra Rent
Control Act 1999 in case of default.
16)
The licensee can get, if they so desire,
the installation of cable and internet
connections at their own cost and themselves
pay the monthly subscription to the service
providers.
IN WITNESS WHEREOF THE LICENSOR AND
LICENSEE have here to put their hands and signed
on the day and date mentioned herein above.
