TOM REED OPPOSES CLEAN WATER ACT AND SAFE
DRINKING WATER ACT FOR HYDROFRACKING
This morning an critically important article appeared in
the Elmira Star Gazette from Tom Reed’s visit to Washington
DC to meet with the “National Republican Congressional
Committee, conservative think tanks and political action
committees to discuss how they can help his campaign.”
In this article, Mr. Reed took a stunning position by
opposing the application of the Clean Water Act and the Safe
Drinking Water Act to the process of Hydrofracking.
Reed further explained that he thinks the Federal
Government should have absolutely no role in making sure our
water is kept safe from the carcinogenic and toxic chemicals
used in hydrofracking - Rather he thinks we should just rely
on Albany to deal with it.
His decision to oppose any federal legislation to address
hydrofracking also comes just nine days after he posted this
youtube video outlining federal legislation he would support to
deal with hydrofracking. Note: in his video, the amount of
legislation he would support is more than none.

Legislation will increase competition,
increase consumer choice, eliminate price
fixing and lower costs
Washington, D.C. - Today, Rep.
Eric Massa voted for H.R. 4626, the

antitrust exemption.
Two years ago, New York State Attorney General Andrew
Cuomo opened an investigation into reported collusion by
health insurers, acting through a billing data clearinghouse
owned by one of them, to artificially depress the level of
“reasonable and customary” charges they would reimburse to
health care providers, which shifted additional costs onto
policyholders. Facing imminent court action, the clearinghouse
agreed to disband, and the insurance companies agreed to pay
sizable sums to resolve the charges.
Because the immediate targets of this price-fixing
conspiracy were the third-party providers, not the
policyholders, under the case law the conspiracy would likely
be deemed outside the “business of insurance” and therefore
subject to antitrust enforcement. But if the insurance
companies had simply targeted the policyholders instead, with
a conspiracy to impose the higher co-pay or percentage on
them directly, McCarran-Ferguson would have completely
shielded them from legal accountability under the antitrust
laws.
This case starkly demonstrates how powerful the
temptation to collude can be, and why the antitrust laws are so
& important as a protection and deterrent.
Leading consumer groups and senior groups, State
attorneys general, the American Bar Association, and others,
c have supported repealing this antitrust exemption for decades.
The bipartisan Antitrust Modernization Commission,
established by Congress and President Bush in 2002, echoed
tfc this call in its 2007 report.
No other industry in America enjoys this kind of blanket
exemption from the antitrust laws. (Major League baseball,
sometimes cited as the other such “industry,” pales in
importance to the pocketbooks of every American family.)
The bill makes absolutely no change in the State-based
c
system for regulating insurance. The part of the McCarran-
Ferguson Act that reaffirms State regulatory and taxing
authority is unchanged. Only the blanket antitrust exemption
c is removed, and only for health insurance.
Nor does the bill interfere in any way with the legitimate
collective gathering and distribution of statistical information
that the insurance industry uses in assessing risks for policies.
This kind of information sharing has long been established in
& antitrust law as legitimate - as distinct from the collusive
sharing of future pricing plans in order to fix prices at inflated
c
levels to gouge consumers. fb

an excellent tureen dinner with 41 members and five guests
attending, Kelly Clark won the 50-50 drawing and Becky Cady

Avon Crist introduced Lois Dungan from Arkport N.Y. and
Judy from the same area. Lois and husband Bruce went to
c Jamaica for two years to help with ministries for the deaf and
stayed 17 years, serving as directors of Caribbean Centers for
the Deaf. She lost her husband in 1998 and Lois continues to
carry on the program while serving on the board. The school
has grown from 30 to over 250 per year.
Judy is hearing impaired and works at Odisagah, a Bible
Camp at Lime Lake. Many young people and adults call it
summer fun including me!

right around this time in 2009, it had already received
approximately 56 million individual tax returns, which
constituted a moderate increase over the previous year. Many
media outlets are already reporting that, largely due to the
prolonged recession, more people than ever will be filing, or
have filed, their taxes early in the hopes of getting a refund
& sooner and avoiding the inevitable last minute rush in the lead
c up to April 15.
If you are one of the millions of New Yorkers who has already
filed their taxes in anticipation of getting a timely state
refund, get ready for some potentially frustrating news. You
might be waiting awhile for that check because Governor
David Paterson is actually considering a delay in sending out
&
taxpayer refunds due to the state’s ongoing cash crunch.
c Yes, you read that correctly. Your state government is
actually contemplating a policy where it would hang onto your
money longer than necessary because it has been unwilling
and unable to get its financial house in order.
& Have you had enough yet?
c THE “NICKEL AND DIMING” OF NEW YORKERS
State government’s inexplicable decision to even entertain
the ridiculous notion of withholding taxpayer refunds - also
known as your money - will only cause more financial pain to
individuals and small businesses who were counting on getting
their money back. It is the latest infuriating case of what I call
& the perpetual “nickel and diming” of New Yorkers and it needs
c to stop.
Over the past few weeks, I have told you all about the over
$1 billion in new taxes, fees and surcharges within the
Governor’s 2010-11 Executive Budget. This would be $1 billion
& on top of the $8.2 billion in taxes and fees imposed by last
c year’s budget. I also wrote about how the Governor’s current

spending plan would cost the typical New York family of four
more than $1,800 annually through higher taxes on everything
from soda and sports drinks to health care.
Now, piled on top of all these crushing costs, is state
government’s consideration of a plan to delay rightful tax
refunds, money that belongs to taxpayers in the first place!
STATE GOVERNMENT MUST STOP PENALIZING
NEW YORKERS WHO DO THE RIGHT THING
People who submitted their tax returns in advance should
have a reasonable expectation of receiving a timely refund.
However, instead of getting your money back, state
government is hatching a scheme to hold onto it until April -
and possibly longer. Taxpayers who played by the rules should
not be penalized because for decades state government failed
to manage its finances and cash flow. Bottom line? State
government has to stop penalizing New Yorkers who do the
right thing.
Governor Paterson needs to put an immediate stop to any
consideration of such absurd public policy and ensure New
York taxpayers do not have to wait to get their money back.
TELL GOVERNOR PATERSON:
DON’T DELAY OUR REFUNDS!
Folks, a tax refund is your money, plain and simple. State
government should not be allowed to simply sit on it for
months because it is unable to make tough decisions and
balance the budget. I don’t want you to get mad - I want you to
give those in state government responsible for considering this
absurdity a piece of your mind!
Accordingly, if you already filed your taxes and are expecting
a refund, contact Governor David Paterson and let him know
it’s your money - not state government’s - and that you want it

government is a waste of time, think again - your phone calls
and e-mails have a profound impact on the policy process. I
have said it before and I will say it again: when the people
speak loudly, Albany listens closely.

According to a report issued by the USPS Office of Inspector
General in January 2010, the OIG estimates that the Postal
Service has been overcharged by approximately $75 billion in
excessive payments to the Civil Service Retirement System
Fund. Under the 2006 Postal Reform law, the Postal Service is
saddled with payments to the Treasury for future Postal
Service retiree health costs of over $5 billion per year. The
necessity for the Postal Service to accrue a liability for these
payments has resulted in postal rate payers paying higher
rates than would be required if the Postal Service was only
paying the costs fairly associated with its operations.
For postal rate payers and major mailers, it is like paying a
7.3% hidden stamp tax to the federal treasury.
The OIG Report provides hard hitting evidence of something
SMC has said for years. The US Treasury and Congress has
played a bit of shell game with the Postal Service as part of the
unified federal budget. This has resulted in decades of shifting
costs to postal rate payers.
This stuff is complicated. Other studies and independent
reports from the PRC and the Hay Group have also shown that
the crippling debt the Postal Service is required to pay to the
Treasury each year is unnecessary and excessive.
Publisher’s Note: This overpayment started in 1973. If you
think the price of a stamp went up, you can imagine the
postage costs we, (our advertisers) have overpaid. Since I
bought this business in 1981, we have paid over $3 1/2 million
in postage. If the overpayment was only 7.3% (I’m sure it was
more because standard business mail was always charged
much more than the cost to deliver it, especially the local
regional delivery of the Moneysaver) we overpaid $255,500.00.
The Postal Service would break even without this rip off. The
multi-billion dollar losses are from this theft and loss of
business from rates that are too high.
