JASON R RICHARD Ref: 15-41-OF (On February 1, 2015 at approximately 2135 Officer Michelle Palmeri and I (Officer Jason Richard) were dispatched to a report of an erratic operator traveling west on East State Street from the Belchertown line, Officer Eric Jorgensen took the 911 call that was transferred from Belchertown Police Department. The caller was SND and he reported that the vehicle QI) was traveling all over the road. stated that on two occasions the vehicle was completely on the wrong side of the road, I first observed the vehicle as it was passing Lyman Street. I observed the vehicles left side tires to be approximately one foot over the centerline in the roadway. I turned around to follow the vehicle as it turned left onto Taylor Street, The vehicle ‘cut the comer to short and was on the wrong side of the roadway as it traveled up the hill. The vehicle slowly ‘went into its lane right after I activated the emergency lighting in my cruiser and it stopped near 11 Taylor Street. As I got closer to the vehicle I realized it was an unmarked police cruiser. I approached the operator and recognized him to be Chief Francis Fox of the Belchertown Police Department. Chief Fox asked me “what was up?” I explained that he was called in as a erratic operator and that he was reported to be operating completely on the wrong side of the road on two occasions. Chief Fox stated “no way” and that he was fine to drive home. As I spoke with Chief Fox I observed his eyes to be extremely red, bloodshot and glossy. A strong smell of alcohol emitted from his breath as he spoke with me and he was slurring his words. Chief Fox again stated that he was fine to drive home. I explained that he was not ok to drive and that I would not allow it. Chief Fox asked me what ‘was going to happen then and I asked him to hold on a minute. ‘The callers vehicle was directly behind my cruiser and I spoke with them for a minute. QNIMMIB stated that vehicle came from nowhere off of Route 202 in Belchertown somewhere in between the Belchertown Police Station and Dunkin Donuts, almost striking their vehicle. (INN stated that they followed the vehicle as it traveled all over the road. | asked §§3INRIIB to call our station and provide his information to Officer Jorgensen. (QQ stated that he would and left the scene. returned to Chief Fox and asked him to get out of the driver’s seat and into the passenger’s seat, Chief Fox again stated that he was fine to drive and that he would not get out. I explained to Chief Fox that if he did not do so he would force me to arrest him. Chief Fox agreed to get out of the car at this point, As he got out of his vehicle I ‘observed him to be very unsteady on his feet and almost fell over. Chief Fox walked to the passenger’s side of his ‘car and stood there swaying back and forth. Chief Fox again asked me what was happening, I explained that I needed him to get in the passenger seat of his car and that I was driving him home after I parked my cruiser. Chief Fox again stated that he thought he was fine to drive. Chief Fox then asked me if I knew who he was and told me that he had been a cop for 30 years. I explained that I knew exactly who he was and that I did not appreciate the situation he was putting me in. Chief Fox told me he did not appreciate my attitude towards him. I parked my cruiser and retuned to his car and again asked him to get in the passenger seat. After he did so, I drove his car to his residence at (SRS and parked the car. Chief Fox and I had a brief conversation where he again stated that he did not appreciate my attitude towards him and he asked me who I thought I was to talk to him that way. I again explained that he put me in a very difficult position. Chief Fox then asked me if Thad never drove drunk before. explained that I had never driven after Ihad as much to drink as he had tonight. Officer Palmeri gave me a ride back to my cruiser at this point, I called Sergeant Kevin Ogrady and explained what had happened and that I used my discretion and chose not to arrest Chief Fox, however the incident would be documented.
