passwordoranyprivateinformationofanyuse.

CignaTTKcannotanddoesnotguaranteeorwarrantthatfilesavailablefordownloadingfromtheServicearefreeofviruses,worms,Trojanhorsesorothercodethathas
contaminatingordestructiveproperties.CignaTTKdoesnotmakeanyexpressorimpliedwarranties,representationsorendorsementswhatsoever(includingwithout

CignaTTKreservesitsrighttoseekappropriatelegalremedyforanyviolationorbreachofanyintellectualpropertyrightsincludingbutnotlimitedtounauthorizeduseof
anytrademarks,logos,slogans,servicemarksandcontentsoftheService.

WebEnabledMobileorHandheldDevices
CertainwebandsmartphoneapplicationsoftheServicehavebeendesignedtorunonapersonalcomputer,standardlaptoporwebenabledmobiledevice.Ifyouview
orusetheServiceonamobileorhandhelddeviceyoumayexperiencesomedisplayandfunctionalitylimitations.Youmayexperiencevaryingwirelessnetworkcoverage
andspeed,dependingonyourgeographiclocationandtelecommunicationsprovider.TheServiceshouldnotbeusedwhileoperatinganymotorvehicle,orinanyother
mannerthatmightendangeryourselforothers.
IfyourmobiledeviceusesGlobalPositioningSystem(GPS)technology,trackers,orotherlocationtrackingtools,yourlocationinformationmaybeusedforpurposesof
determiningyourlocationwhenusingafunctionontheServicethatusessuchinformation.WhileusingtheService,ifyouallowyourlocationinformationtobeobtained,
wewillusethisinformationsolelytoreturnyourestimatedlocationandtoprovideyouwithmorepersonalizedresultsand/orservices.CignaTTKdoesnotmonitoryour
GPStrackingorlocationinformation,anddoesnotsavethisinformation.Wewillnotusethisinformationtoidentifyyouordisclosethisinformationtoanythirdparties.
ByusingtheServiceyouexpresslyagreeandacknowledgethatCignaTTKshallnotresponsibleforanyofthefollowing:(a)performancelimitationsand/orfailures
experiencedinconnectionwithanywirelessorWiFiserviceusedtoaccesstheService(b)datatransmittedthroughwirelessaccessthatmaybeinterceptedby
unauthorizedpersonsor(3)yourfailuretophysicallysecureand/ormonitoryourpersonalcomputer,laptoporwirelessdeviceortoprotectyourpasswords,resultingin
unauthorizedaccesstotheServiceand/oryourCignaTTKaccountorplaninformation.
WhileusinganywebenabledmobileorhandhelddevicetousetheService,standardmobilephonecarrieranddatausagechargeswillapply.Youexpresslyagreeand
acknowledgethattheuseofanymobileorhandhelddeviceisatyoursoleriskandshallbeinaccordancewithallapplicableIndianlaws.

Indemnification
Youshallindemnify,defendandholdharmlessCignaTTK(includingitsofficers,directors,employees,affiliates,group/promotercompanies,agents,representativesor
subcontractors)fromanyandallclaimsandlossesimposedon,incurredbyorassertedasaresultoforrelatedto:
(a)youraccessanduseofthiswebsite
(b)anynoncompliancewiththetermsandconditionshereof
(c)anythirdpartyactionsrelatedtoyourreceiptanduseoftheinformation,whetherauthorizedorunauthorized

Youshallbeliabletopayanyandallcosts,damagesandexpenses,including,butnotlimitedto,reasonableattorneys'feesandcostsawardedagainstorotherwise
incurredbyorinconnectionwithorarisingfromanysuchclaim,suit,actionorproceedingattributabletoanysuchclaim.

LimitationofLiability
YouagreebyaccessingtheServicethatundernocircumstancesoranytheoriesofliabilityunderinternationalorcivil,commonorstatutorylawincludingbutnotlimitedto
strictliability,negligenceorothertorttheoriesorcontract,patentorcopyrightlaws,willCignaTTKoritsemployeesanddirectors,itssuppliersanditsinsuranceagentsbe
liablefordamagesofanykindoccurringfromtheuseoftheServiceoranyinformation,goodsorservicesobtainedontheServiceincludingdirect,indirect,consequential,
incidental,special,exemplaryorpunitivedamages(evenifCignaTTKhasbeenadvisedofthepossibilityofsuchdamages),tothefullestextentpermittedbylaw.Some
jurisdictionsdonotallowtheexclusionorlimitationofcertaindamagessosomeoftheselimitationsmaynotapplytoyou.

NoticesundertheseTermsmaybegivenbyCignaTTKandthepolicyholdersofCignaTTKinwritingbydeliveringthembyhandorbysendingthembyposttothelast
addressgivenbythepolicyholderandinthecaseofCignaTTKtotheaddressmentionedontheWebSite.
Inaddition,CignaTTKmayalsopublishnoticesofgeneralnature,whichareapplicabletothepersonsusingtheServiceorpolicyholdersofCignaTTKinanewspaperor
onitsWebSite.SuchnoticeswillhavethesameeffectasanoticeservedindividuallytoeachpersonusingtheServiceorpolicyholder.
Inthecaseofhanddelivery,cable,telex,facsimilenoticesorelectroniccommunicationnoticesorinstructionswillbedeemedserved7daysafterpostingoruponreceipt
asthecasemaybe.Documents,whichmaybesentbyelectroniccommunicationbetweentheparties,maybeintheformofanelectronicmail,anelectronicmail

suchdocumentissentviaelectronicdelivery.Anyinstructionsreceivedfromthepolicyholder/anypersonusingtheServicebymeansofelectronicdeliveryorbyfacsimile
wouldbedeemedtohavebeensentonpaper.

ChangesandApplicableLaw
WereservetherighttomakechangestotheServiceandourterms&conditions.WeencourageyoutoreviewtheServiceandthesetermsperiodicallyforanyupdatesor
changes.YourcontinuedaccessoruseoftheServiceshallbedeemedyouracceptanceoftheseterms&conditionsandanychangesandthereasonablenessofthese
standardsfornoticeofchanges.UseoftheServiceandpurchasesofproductsfromtheServicewillbegovernedbyandconstruedinaccordancewiththelawsofIndia,
withoutgivingeffecttoitsconflictoflawprovisions.Ifanyprovisionofthisagreementshallbeunlawful,void,orforanyreasonunenforceable,thenthatprovisionshallbe
deemedseverablefromthisagreementandshallnotaffectthevalidityandenforceabilityofanyremainingprovisions.

Jurisdiction
ThisAgreementissubjecttothelawsofRepublicofIndia,andinrespectofanymatterarisingherein,thecourtsatMumbaishallhaveexclusivejurisdiction.CignaTTK
acceptsnoliabilitywhatsoever,directorindirectfornoncompliancewiththelawsofanycountryotherthanthatofIndia.ThemerefactthattheServicecanbeaccessed
byanypersonincludingpolicyholdersinacountryotherthanIndiawouldnotmeanthatthelawsofthesaidcountrywouldgoverntheseTermsand/ortheService
operationsofthepolicyholderand/ortheuseoftheServicebytheanypersonincludingpolicyholders.
CignaTTKoffersPoliciesstrictlyinaccordancewiththeIRDAregulations,asmaybeamendedfromtimetotimebyIRDA.BeforeavailingofanyservicesorPolicies,it
shallbethesoleresponsibilityofforeignresidentsincludingNRIsinforeignjurisdictionstoascertain/verifyfromCignaTTK,whethertheservicesavailableontheService
canbeaccessedandutilisedintheirrespectivejurisdictions.

Miscellaneous
Youagreethatnojointventure,partnership,employment,oragencyrelationshipexistsbetweenusasaresultoftheseTermsandConditionsoruseofthe
Service.
CignaTTK'sperformanceunderthisagreementissubjecttoexistinglawsandlegalprocess,governmental,courtandlawenforcementrequests.
YouacknowledgethatanyrightsnotexpresslygrantedhereinarereservedsolelywithCignaTTK.
TheseTermsandConditionsconstitutetheentireagreementbetweenuswithrespecttotheServiceanditsupersedesallpriororcontemporaneous
communicationsandproposals,whetherelectronic,oralorwritten,betweenuswithrespecttotheService.
TheclauseheadingsintheseTermsandConditionsareforonlyforconvenienceanddonotaffectthemeaningoftherelativeterm.
CignaTTKmaysubcontractandemployinsuranceagentstocarryoutanyofitsobligationsundertheseTermsandConditions.
CignaTTKshalltryandensurethatallinformationthatisprovidedontheServicewithrespecttopolicies/productsareaccurateinallrespectsandarekeptup
todate.However,CignaTTKdoesnotguaranteethetimeliness,accuracy,completeness,reliabilityorcontentoftheinformationandanychangesthatare
madewithrespecttothesameandanypersonaccessingtheServiceincludingthepolicyholdersarerequiredtochecktheaccuracyofthesamewiththeoffice
ofCignaTTK.
Alltransactions,whichcannotbecarriedoutinstantaneously,wouldbecarriedoutduringworkinghourseitheronthesamedayoronthenextworkingdayor
suchfurtherperiodasmaybedeterminedand/orspecifiedbyCignaTTKdependinguponthetimeofloggingofthetransaction.
AlltransactionsthatarecarriedoutbythepolicyholderattheWebSiteormobileapplications,shallbesubjecttoGovernmentnotifications,therules,
regulationsandguidelinesissuedbytheInsuranceRegulatoryandDevelopmentAuthority,theSecuritiesandExchangeBoardofIndia,theReserveBankof
India,andthoseofotherregulatorybodiesdefiningrules/regulationsgoverningtheofferofanyserviceontheWebSiteormobileapplications.
