Defendantsexpense. The truth is the principal obligation
amounts to only Six Hundred Thousand Pesos(P600,000.00),
but due to unconscionable interests, excessive penalties
and othercharges,Defendantwasdeceivedintosigninga receipt
thatshowed,asDefendantmuchlateronlearned, the aggregate
amount of indebtedness to be Nine HundredThousand
Pesos(P900,000.00),inclusiveoftheunconscionable
interests,excessivepenalties,andothercharges;

4.Thecomplaintdoesnotstateacauseofactionandisa sham
pleading;
4.2DuetoacloseandlongrelationshipwithPlaintiff,Defendant
wasdeceivedintosigningareceipt which hethoughtcontained
onlyareasonablerateofinterest perDefendantsoralagreement
withPlaintiff;
4.3Uponsecuringacopyofthereceiptmuchlater,Defendant
discoveredtohisuttersurprisethattherateofinterestindicated
onthereceiptisfive(5%)percentpermonth,orsixty(60%)percent
perannum;
4.4Defendantswereperplexedthattheirindebtednesscontinuedto
increasedespitethefactthatthey had already paid Plaintiff
the following amounts: P150,000.00 on July 12, 2005 and
P250,000.00 on September 8, 2008, more than the principal
obligation of P350,000.00.

Counterclaim
5.Defendantadditionallysubmitsthatheisentitledto relief
arisingfromthefilingofthismaliciousand baselesssuit,as
follows:
5.1Moral Damages amounting to Fifty Thousand Pesos
(P50,000.00) because his name and reputation were
besmirched by this malicious and baseless suit.
5.2DespitefullpaymentbyDefendantoftheprincipalobligation,
Plaintiffhasinstitutedtheinstant malicioussuitwhich
compelledDefendanttoengagetheservicesofcounsel,inorderto
protectDefendants interests,foranagreedprofessionalfeeof
P200,000.00,plusanappearancefeeofP5,000.00perhearing.
5.3Defendantsalsoincurredotherlitigationexpensesinthesumof
P50,000.00.Forallofsaidfeesandlitigationexpenses,Plaintiff
shouldbeadjudgedliabletoDefendant.
