LETTER OF DISCLOSURE

I, MANUEL, E. ROMERO, of legal age, Filipino and with residence and postal address
at No. 12 Sto. Nio St., Villa Espaa Subdivision, Brgy. Tatalon, Quezon City, do hereby address
this Letter-Manifestation to MR. LUCKY MOLINA, Branch Manager of Semicon Telecom
Marketing, SM Centerpoint Branch, Sta. Mesa, Manila, this 16th day of April 2003, and hereby
declare and manifest to the veracity of the following facts and circumstances, to wit:
I bought three (3) Brand New Cellular Phone from your branch. On December 6, 2001, a
NOKIA 5110 worth P3,690.00, on June 8, 2002, a NOKIA 3310 worth P4,390.00, on July 25,
2002, a NOKIA 3330 worth P6,990.00. My newly bought 3330 unit was defective, that is why
on July 27, 2002, you replaced it with a new 3330 new stock. But just the same, the 3330 unit
replacement was also defective. That is why you replace it again with a 3330 new stock for the
second time. I was thinking already that you are selling me old stocks so I decided to return the
3330 (the second replacement) unit and buy a good quality, a NOKIA 5210 unit. I paid
P11,650.00 (under O.R. No. 300645), with a one (1) year warranty. To my dismay, during the
first day of using my new unit, power switch off and unit hangs, without any apparent reason at
all. After 2 to 3 weeks, the trouble persisted and deteriorated, so I decided to bring it to you for
repair on September 14, 2002 (Job Order #178681). Repair was completed on September 20,
2002. I was not charged a single centavo because of the one (1) year warranty.
A day after the first repair, while using my unit, the same trouble re-appeared. Power
switch off and unit hangs. After 1 to 2 weeks, the trouble again persisted and deteriorated. I
brought it again to you for second repair on October 5, 2002 (Job Order #185811). Repair was
completed on October 15, 2002. I was not charged for the second time because of the warranty I
got hold of my unit on October 16, 2002. I was elated and satisfied because after the second
repair, my unit was troubled free at last. But it did not last long because from March 15, 2003 up
to April 3, 2003, the same trouble re-appeared again. Power switch off and unit hangs. It
persisted and deteriorated again so I was forced to bring it again to you for repair (for the 3 rd
time). But this time you made me sign the Job Order #245458 with Terms and Conditions, I
cant fully understood. Since I am a regular and a good paying customer I signed the Job Order
in good faith, not thinking that the terms and conditions might incriminate me and put me at a
very disadvantageous situation, if a worst scenario crops up.
On April 12, 2003, Saturday, at 1:15 p.m., I received a telephone call from a certain
Rodel, a Semicon Technician/Employee, from your main office. He told me, MALAKI PO
ANG SIRA NG INYONG NOKIA 5210. He said I have to pay P2,400.00 for spare parts so
that repair will be completed. I told him, I dont have that money and cant afford it. Rodel
never mentioned about anything else. I asked him when I can get back my unit, and he told me, I
can get it on Tuesday, April 15, 2003 at Semicon SM Centerpoint Branch.

On April 15, 2003 at about 10:00 a.m., I received a telephone call from a certain Ms.
Lirio of Semicon SM Centerpoint Branch. She told me that the one(1) year warranty of my unit
is being declared void. Her allegation is that I have already hired a cell phone Technician to
repair my unit. She gave me another instruction, to get my unit, April 16, 2003 at 5:00 p.m. I
must bring with me an identification card to prove that I am the real owner. I also have to pay
P165.00 for Diagnostic Fee. I was mad, disgusted and frustrated the way Ms. Lirio relayed to
me the news about my 5210 unit, especially, telling me to present an I.D. (which is not a
condition in the Job Order). She is insinuating that if I cant present an I.D., somebody else own
my cell phone. Adding insult to my injury, she told me further that the damage of my cell phone
is so serious, that sooner or later it will be useless. Ms. Lirio is talking like a professional and
expert cell phone technician when she is not.
I am writing you this letter to present to you the facts and the truth, supporting my claim
that the NOKIA 5210 unit that I bought from your branch on August 1, 2002 worth P11,650,
which you advertised as brand new is actually an old defective stock or a recycled unit. PROOF.
Immediately after I bought it on August 1, 2002, during the first day of my use, Power Switch
Off and Unit Hangs. This is supported by the facts that it was a Brand New unit but repaired 2
times, September 15, 2002 and October 5, 2002, respectively, before it functioned normally.
In this regard, since I am a good regular paying customer of your branch, I demand to:
1. Restore the one (1) year warranty of my cell phone, that is, up to August 17, 2003.
2. Repair my 5210 unit free of charge.
3. Reprimand Ms. Lirio for uttering irresponsible and unverified statements damaging my
honr and reputation.
I am hoping that you will make your decision, taking into consideration the good name of
your company and the welfare of your customer. If I will not be satisfied by your decision, I will
be compelled to hire the assistance of a legal counsel to seek the truth and justice.

decision.
