SUBJECT:

Authorization to: 1. Proceed to fill certain positions that were "frozen" for the first quarter of
FY 2015-16, 2. Proceed with Capital Projects funded in the 2015- 2016 FY Budget and
scheduled for implementation post-December 2015, and 3. Proceed with the purchase
and acquisition of vehicles and equipment approved to proceed in FY 2015-2016 Budget.

RECOMMENDATION
1. Authorize the process for filling certain City employment positions currently "frozen" during the
first quarter of FY 2015-16 to be opened for recruitment and filling .
2. Authorize Capital projects funded in the 2015-2016 FY Budget and scheduled for
implementation to commence .
3. Authorize the purchase and acquisition of vehicles and equipment approved to proceed in FY
2015-2016 Budget.
SUMMARY
The Provisional Budget proposed that certain positions, Capital Projects, and vehicle/equipment
purchases be approved but "frozen" for the first half of FY 2015-16 due to uncertainty regarding the
status of the Cease and Desist Order (COO.) It had been expected that a revision to the COO would
take effect in the first half of 2016. The Provisional Budget recommended that the Council review the
status of the COO and the Budget in October to determine whether a "trigger" should be implemented
to allow recruitments, Capital Projects, and certain equipment purchases to move forward . In the case
of the employments positions, the thought was that by the time the recruitments were completed and
the positions filled , the fiscal year would be half over; thus, the October review. The "trigger" schedule
was to save money should rationing of water occur and the local hospitality industry impacted. The
industry is a significant revenue generator for the City.
The current sentiment is that the COO will not be altered during FY 2015-16 and may not be considered
for adjustment until the latter part of 2016. In addition, the proposed rationing plan prepared by
Monterey Peninsula Water District (MPWD) but not yet adopted does not, at least in the earliest stag es,
significantly impact the commercial/hospitality segments. If the proposed plan is approved and some

level of rationing is initiated, the Carmel by the Sea hospitality businesses would not be adversely
affected initially as originally envisioned at the time the Provisional Budget was prepared . The MPWMD
staff commented to me that "even the State Board (Water Resources) has encouraged not rationing at
the expense of jobs or the economy."
Thus, due to these changed circumstances, I am making the following recommendations:
1. Council authorize the positions that were approved in the budget for 2015-16 be authorized for
recruitment and filling . The positions which would be "freed" for recruitment are: Deputy City
Clerk , Finance Analyst and Community Activities Assistant (.50).
2. Council authorize the budgeted Capital Projects that per the bifurcated calendar established in
anticipation of the CDO were scheduled for implementation to begin post-December 2015 to
proceed. Those projects are: the ADA study, Mission Trail Nature Preserve Invasive Species
Removal, North Dunes Restoration Project, Facilities Safety Maintenance, Small Water
Projects, Sidewalk Repair and Maintenance, Streets and Roads, and the Ocean Avenue
medians.
3. Council authorize the purchase and acquisition the of vehicles and equipment approved in FY
2015-2016 Budget.
PRIOR CITY COUNCIL ACTION
At the time of Budget approval in June, Council authorized certain positions that had been proposed to
be "frozen" for the first half of FY 2015-16 to proceed with immediate recruitment and filling. Those
positions related to the forest and beach---Assistant City Forester/Beach Gardener and a Police Officer
position to primarily work the beach. The Assistant City Forester position has been filled ; a background
check is underway on the top candidate for Beach Gardener and for the Police Officer. (Note: there are
three Police Officer positions open for which backgrounds are underway. Two of the three positions
were previously authorized before FY 2015-16. They have become vacant due to an internal promotion
and a retirement.)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
AUTHORIZING 1. THE PROCESS TO PROCEED TO FILL CERTAIN POSITIONS THAT WERE
"FROZEN" FOR THE FIRST QUARTER OF FY 2015-16,2. CAPITAL PROJECTS FUNDED IN THE
2015-2016 FY BUDGET AND SCHEDULED FOR IMPLEMENTATION POST-DECEMBER 2015,
AND 3. THE PURCHASE AND ACQUISITION OF VEHICLES AND EQUIPMENT APPROVED TO
PROCEED IN FY 2015-2016 BUDGET.
WHEREAS, due to a Cease and Desist Order, the Budget FY 2015-2016 established certain
"triggers" before certain expenses would be incurred; and
WHEREAS, the filling of certain budgeted positions, Capital Projects, and vehicles and
equipment purchases which were to be determined by certain "trigger" dates dependent upon the
status of the Cease and Desist Order; and
WHEREAS, the current Cease and Desist order is not expected to be altered during FY 20152016 and may not be considered until the latter part of 2016; and

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF


CARMEL-BY-THE-SEA does hereby:
1. Authorize the recruitment and filling of the positions of Deputy City Clerk, Finance Analyst and
Community Activities Assistant (.50) that were approved in the budget for 2015-16.
2. Authorize the commencement of the implementation of the budgeted Capital Projects as
follows: the ADA study, Mission Trail Nature Preserve Invasive Species Removal, North
Dunes Restoration Project, Facilities Safety Maintenance, Small Water Projects, Sidewalk
Repair and Maintenance, Streets and Roads, and the Ocean Avenue medians, as approved in
the 2015-2016 FY Budget.
3. Authorize the purchase and acquisition of vehicles and equipment approved to proceed in FY
2015-2016.
