PLAINTIFFS RESPONSE TO THIS COURTS ORDER TO SHOW CAUSE
Malibu Media, LLC, (Plaintiff), by and through undersigned counsel, hereby responds
to Your Honors Order to Show Cause [CM/ECF 26], and states:
Undersigned sincerely apologizes for Plaintiffs failure to inform the Court that the
parties conferred on and finalized the Case Management Report.
Report, and on October 1, 2015, Plaintiffs attorney instructed a paralegal to file same.
However, the paralegal inadvertently failed to do so. Plaintiff assures Your Honor that this
mistake was unintentional and not made for the purpose of delay. Indeed, not realizing that the
paralegal did not file the Case Management Report, on September 12, 2015, Plaintiffs counsel
proceeded with the case by serving Plaintiffs initial disclosures and discovery requests on
Defendant.
Today, Plaintiff filed the Case Management Report. Plaintiff apologizes for this mistake
and respectfully requests that the Court not dismiss the case. Dismissal would not be in the
interest of either party because dismissal would cause both parties to spend additional time and
money. Plaintiff would incur the time and expense of refiling the same case, and re-serving its
discovery. Defendant would also incur the time and expense of refiling an answer. Further, the
extreme sanction of dismissal with prejudice is not warranted because Plaintiff has not
engaged in a clear pattern of delay or willful contempt (contumacious conduct)[.] Betty K
Agencies, Ltd. v. M/V MONADA, 432 F.3d 1333, 1338 (11th Cir. 2005). Rather, here, the
conduct involves an inadvertent error in filing the Case Management Report. Plaintiff has since
conferred with opposing counsel and completed the Case Management Report, which was
already filed. And, Plaintiff advanced this case by serving its initial disclosures and written
discovery on Defendant. Accordingly, Plaintiff respectfully requests this Court not dismiss the
complaint pursuant to Local Rule 3.10 for lack of prosecution.
