History
TheRoyalCommissionontheSuperiorCivilServicesinIndiaundertheChairmanshipofLordLee,
whichsubmitteditsReportin1924,recommendedthesettingupofthePublicServiceCommission.
ThisledtotheestablishmentofthefirstPublicServiceCommissionon1October1926underthe
ChairmanshipofSirRossBarker.ThelimitedadvisoryfunctionaccordedtothePublicService
Commissionandthecontinuedstressonthisaspectbytheleadersofourfreedommovementresultedin

thesettingupofaFederalPublicServiceCommissionundertheGovernmentofIndiaAct,1935.The
FederalPublicServiceCommissionbecametheUnionPublicServiceCommissionafterIndependence
anditwasgivenaConstitutionalstatuswithpromulgationofConstitutionofIndiaon26January1950.

AdministrationandControl
TheCommissionconsistsofaChairmanandtenMembers.Thetermsandconditionsofserviceof
ChairmanandMembersoftheCommissionaregovernedbytheUnionPublicServiceCommission
(Members)Regulations,1969.TheChairmanandothermembersoftheUPSC(UnionPublicService
Commission)areappointedbythePresidentofIndia.AtleasthalfofthemembersoftheCommission
areCivilServants(workingorretired)withminimumtenyearsofexperienceeitherinCentralorState
service.
TheCommissionisservicedbyaSecretariatheadedbyaSecretarywithtwoAdditionalSecretaries,a
numberofJointSecretaries,DeputySecretariesandothersupportingstaff.
Everymemberholdsofficeforatermofsixyearsoruntilheattainstheageofsixtyfiveyears,
whicheverisearlier.
HecansubmithisresignationatanytimetothePresidentofIndia.Hemayberemovedfromhisoffice
bythePresidentofIndiaonthegroundofmisbehaviour(onlyifaninquiryofsuchmisbehaviouris
madeandupheldbySupremeCourt)orifheisadjudgedinsolvent,orengagesduringhistermofoffice
inanypaidemploymentoutsidethedutiesofhisoffice,orintheopinionofthePresidentunfitto
continueinofficebyreasonofinfirmityofmindorbody.
UPSCisamongstthefewinstitutionswhichfunctionwithbothautonomyandfreedomalongwiththe
countryshigherjudiciaryandlatelytheElectionCommission.[2]

arerequiredtobeframedinConsultationwiththeCommission.ConsultationwiththeCommissionis
alsonecessaryforframing/amendingRecruitmentRulesforcertaincategoriesofpostsunderthe
EmployeesStateInsuranceCorporation,TheDelhiMunicipalCorporation,TheNewDelhiMunicipal
Coil,EmployeesProvid.VariousexaminationsareconductedbyUPSC

Genderissueinapplicationform
WhilethenotificationofUPSCclaims"Governmentstrivestohaveaworkforcewhichreflectsgender
balanceandwomencandidatesareencouragedtoapply",[8]theapplicationformavailableonlinedoesn't
havetheoptionfor"others"underthecategoryofsex.ThiswashighlightedthroughanRTIappealfiled
byaMaduraibased23yeartransgender,Swapna.[9]
TransgenderSwapnaandgenderactivistGopiShankarfromSrishtiMadurai[10]stagedtheprotestin
Maduraicollectorateon7thOctober2013demandingreservationandtopermitalternategendersto
appearforexaminationsconductedbyTNPSC,UPSC,SSCandBankExams.LaterSwapnawas
incidentally,hadsuccessfullymovedtheMadrasHighCourtin2013seekingpermissiontowritethe
TNPSCGroupIIexamasawomancandidate.[11]

Reports
TheUPSCannuallysubmitsareportofitsworktothePresidentofIndia.Furtheritissenttoeachhouse
ofParliamentfordiscussion.Thecommissionsubmitsanannualreportontheworkdonebyittothe
president.Thepresidentplacesthereportofthecommissionbeforetheparliamentalongwitha
memorandumwithregardtothecaseswheretheadviceofthecommissionwasnotacceptedandthe
reasonsforsuchnonacceptance.
