Honorable Attorney General:
The Irving Police Department has received a request for information (See Exhibit A) which falls within exceptions to required disclosure under the Texas Public Information Act. The Department has withheld that information, and requests an opinion from your office holding that the information is excepted from mandatory public disclosure. The request for public information, included with this correspondence and marked as Exhibit A, was made by: Tina Foster 606 Young Street Dallas, TX 75202 A copy of this letter has been sent to the requestor. The request for public information (Exhibit A) seeks, in part, all City of Irving internal communications including emails in connection with the Ahmed Mohammed arrest and detention. The remaining portions of her request have been submitted as a separate request for opinion. The request at issue was submitted on September, 23, 2015, a date within 10 days of this request for opinion. The following exceptions apply to the information withheld: Texas Govt. Code Sections 552.101, 552.103, 552.108, 552.117 & 552.1175. Discussion and comments regarding these exceptions will follow in separate correspondence pursuant to Section 552.301, and the withheld material will be forwarded with that correspondence for your review. The City of Irving asserts that some of the records requested are protected from disclosure, and I request an opinion from your office determining that those records are excepted from disclosure under the Texas Public Information Act.
