I am writing you on referral of David A. Campbell, U.S. Department of Education, Office for
Civil Rights, regarding the Bucks County Community College (BCCC). Enclosed you will find
our email communication with Mr. Campbells referral.
Recently I learned Charles W. May was not certified or licensed as a Real Estate Instructor while
teaching Real Estate at the BCCC while I was a 24 year-old student enrolled in REAL100,
Principals of Real Estate, Spring Term, Jan-22-1980 to May-20-1980, taught by Mr. May.
This information is relevant to my long-standing claim that a grade of F on my BCCC
transcript is improper because I dropped the class. BCCC claims it cannot find evidence of me
dropping the class. Charles W. May lacked authority to teach REAL100, Principals of Real
Estate, Spring Term, Jan-22-1980 to May-20-1980, at the BCCC, or to grade students or perform
other teaching duties. Therefore I contend it is irrelevant whether the BCCC can locate evidence
that I dropped the class, because the class is null and void due to Mays lack of certification or
licensure as a Real Estate Instructor. The class must be removed from my transcript immediately.
Enclosed you will find my complaint letter, and proof of delivery, to 3 Directors of the BCCC:

Carolyn Angelo, Executive Director; and Suzanne Markowicz, Administrative Assistant.
As of today none of the Directors of the BCCC have responded to my complaint. None of the
Directors of the BCCC have provided public records requested on page 2 of my letter:
Request for the personnel file of Charles W. May, and all information related to his unlicensed
teaching real estate classes at the BCCC prior to his licensure November 10, 1981.

Two weeks ago I learned Charles W. May was not certified or licensed as a Real Estate Instructor while
teaching Real Estate at the BCCC while I was a 24 year-old student, relevant to a long-standing matter,
and 35 years of deception by the BCCC.
Please see attached my letter October 22, 2015 (with 2 of 10 exhibits) to three BCCC Directors, and
Gilbert R. Griffiths, Chair, Professional Standards and Practices Commission. I am awaiting a response
to my records request to the BCCC Directors, for the personnel file of Charles W. May, and all

Dear Mr. Gillespie:
I am writing in response to your email communication dated October 14, 2015 to the Office for Civil
Rights (OCR) within the U.S. Department of Education (Department) regarding your question whether
alumni student have the right to copy their student file.
OCR enforces several Federal civil rights laws that prohibit discrimination in programs or activities
that receive Federal financial assistance from the Department. These laws prohibit discrimination on
the following bases:

Title VI of the Civil Rights Act of 1964, on the basis of race, color, and national origin;
Title IX of the Education Amendments of 1972, on the basis of sex;
Section 504 of the Rehabilitation Act of 1973, on the basis of disability; and the
Age Discrimination Act of 1975, on the basis of age.

OCR also enforces Title II of the Americans with Disabilities Act of 1990, which prohibits
discrimination on the basis of disability by public entities, whether or not they receive Federal
financial assistance.
The matter you discussed does not appear to be within OCRs jurisdictions. However, this matter may
fall within the jurisdiction of the Departments Office of Postsecondary Education (OPE).

I am contacting each of you as Directors of the Bucks County Community College (BCCC)

According to the Pennsylvania Department of State, a primary source of information for


verification of license credentials, Mr. May was licensed as a Real Estate Instructor November
10, 1981, No. RI000282A. Enclosed is copy of the Real Estate Instructor license No. RI000282A
information for Charles W. May as found on the Pennsylvania Department of State website.
(Note: Charles W. May was licensed by the Real Estate Commission as an Associate Broker
(AB) Standard, No. AB025607A, on December 18, 1972. See the enclosed search results.
The Educator Discipline Act, Dec. 12, 1973, P.L. 397, No. 141, (24 P. S. 12-125112-1268)
also known as the Teacher Certification Law, applied to Mr. May Jan-22-1980 to May-20-1980.
Section 2. Certification Requirements.--(a) No educator shall be employed by a school
entity in the Commonwealth unless he has met the certification requirements which are
applicable to the position in the institution in which he is employed as established by the

known as the Teacher Certification Law.

The professional educator may not:
(1) Accept employment, when not properly certificated, in a position for which
certification is required.

Dear Mr. Bruhn and Ms. Korn:
The attached Parchment Transcript Report obtained yesterday for me shows an incorrect
grade of F for REAL100 PRINC OF REAL ESTATE (01/22/1980 to 05/20/1980).
The grade is wrong because I did not take the class. I enrolled in the class but later
withdrew to focus on a business I recently started. Ironically I purchased real estate for
my business which I later sold for a substantial profit. (records attached). In my view an
important principal of real estate is competent economic management of real property.
In the past I unsuccessfully attempted to correct this problem by meeting with the
instructor circa 1985. Since then this transcript error has caused me numerous problems,
including the loss of scholarship funds, a lower GPA, and diminished class rank or
standing.
Now this transcript error may affect or be a factor in my pursuit of employment or
elected office. If there is a way to correct this transcript error now, please advise.
Academic Restart is described on the back of the transcript. At this time I do not plan
further traditional academic study.
If Bucks County Community College cannot or will not correct the transcript error, I
request permission to include a comment in the Comments section of my transcript. In

Dear Dr. Shanblatt:
Enclosed you will find my email correspondence June 30, 2015 with Executive Director
Tobi Bruhn about an error on my Bucks County Community College transcript. The only
response I got was an automatic notice from Nancy Korn stating On October 24, 2014 I
retired from Bucks County Community College. Please direct all email to
Robert.Maley@bucks.edu. Thanks.
Unfortunately Robert Maley did not respond to follow-up contact. Your information as
college president was not readily apparent on the BCCC website, or I would have
contacted you initially. Ultimately I found your presidents page through a subsequent
Google search.
My transcript has at least two errors. Nancy Korn retired eight months prior to her name
and signature appearing June 29, 2015 as Director of Records on the Parchment
Transcript Report.
The enclosed Parchment Transcript Report obtained June 29, 2015 shows an incorrect
grade of F for REAL100 PRINC OF REAL ESTATE (01/22/1980 to 05/20/1980).
The grade is wrong because I did not take the class. I enrolled in the class but later

Ms. Shanblatt:
As of today I do not show a response from you or anyone on your behalf to my letter to
you of July 9, 2015, which was my second contact with BCCC. This is my third letter.
What does it take to get a response from the Bucks County Community College? Are you
waiting for a bribe, or a cash payment to lubricate the gears of academic indifference and
bureaucracy? If so, put that request in writing so I may forward your demand to the
Federal Bureau of Investigation.
Forward this letter to your General Counsel. Heres a link to General Counsel on

Henceforth I demand to communicate only with legal counsel for BCCC. That can be
informal communication, or through a federal disability and section 1983 civil rights
lawsuit, with additional claims under the Higher Educational Opportunity Act, 20 U.S.C.
Ch. 28 et seq.
I view your behavior as discriminatory. Have your legal counsel forward this complaint
to the confidential complaint line department, so they can provide a mailing address and
the name of a contact person. I called the complaint line, and left a message, but I could
not find anything but a phone number online (215-504-8623). This is method is
inadequate for reporting discrimination.
On August 14, 2015 I spoke with Lisa, who unfortunately has failed to provide
information she promised, specifically,

I am writing to inform you that the college did respond, on July 17,2015, to your July 9,
2015 communication. A copy of that correspondence is attached. However, there was an
error in the address line of which we were unaware because the letter was not returned
to our office as undeliverable. I offer my sincere apologies for the error and the resulting
delay in providing a response to you.
Regarding your request of October 10, 2015, I have obtained a copy of your student
record in its entirety. We are sending it to you today via Fed Ex overnight delivery.
I apologize again for any inconvenience or misunderstanding resulting from the
erroneous address. Please contact me with any questions.

Comment: I believe the Shanblatt letter was concocted after the fact, and fake-dated July 17,
2015. For example, Ms. Fedorko failed to provide proof of mailing that I requested.

There is no record that you withdrew from the course. You were mailed a report of

your grades which included the failing grade. There is no record of your correspondence
with the college during this time frame.

In 1992 you submitted a withdrawal appeal for this course which was reviewed by the
Appeals Committee, despite the fact that the three year time period for appeal had
expired. This appeal was denied because there was no evidence in your college record
of an attempt to withdraw from the course.

We have again researched your file to locate any documentation that you withdrew from
the course and we have found nothing. Given that fact, we cannot remove the failing
grade from your official transcript. Using the Comments section of the transcript to
explain your" position regarding the failing grade is not recommended as it may be
viewed as altering the official transcript. A better step may be to attach a letter of
explanation to your transcript. We will be mailing you a new transcript which corrects
the official signature on the transcript.

Regarding the purported response letter July 17, 2015 of Stephanie Shanblatt, provide
evidence of mailing.
If and when the copy of my student record arrives as claimed, via Fed Ex overnight
delivery, I will have further comment for the BCCCs general counsel once I have had
time to read and study the copy of my student record.
For whatever reason you failed to direct this matter as requested to the general counsel
for the BCCC. Fine. I may submit a complaint to the Middle States Commission on
Higher Education.

Comment:
Ms. Fedorko failed to identify the general counsel for the BCCC.

Ms. Fedorko failed to provide proof of mailing for the purported response letter July
17, 2015 of Stephanie Shanblatt.

Comment: I found three attorneys on the Board of Directors, and have contacted each of
them herewith, and believe an initial complaint to the Professional Standards and Practices
Commission is appropriate, instead of the Middle States Commission on Higher Education.

Conclusion
Charles W. May was not certified or licensed as a Real Estate Instructor in 1980. Mr. May
therefore lacked authority to teach REAL100, Principals of Real Estate, Spring Term, Jan-221980 to May-20-1980, at the BCCC, or to grade students or perform other teaching duties.
According to the Pennsylvania Department of State, a primary source of information for
verification of license credentials, Mr. May was licensed as a Real Estate Instructor November
10, 1981, No. RI000282A. May was not certified or licensed as a Real Estate Instructor in 1980.
Because Charles W. May was not a certified Real Estate Instructor in 1980, and lacked authority
to teach REAL100, Principals of Real Estate, Spring Term, Jan-22-1980 to May-20-1980, the
class and grade of F should be removed immediately from my official BCCC transcript.
It is irrelevant whether the BCCC can locate evidence that I dropped the class, because the class
is null and void due to Mr. Mays lack of certification or licensure as a Real Estate Instructor.
The class must be removed from my transcript immediately as null and void.

The Bucks County Community College, and its administration, has concealed the fact that
Charles W. May was not in 1980 a certified Real Estate Instructor. The BCCC even refused to
acknowledge Charles W. May was my teacher. This deception by the BCCC has continued
unabated since 1980, a period of time exceeding thirty-five (35) years, against my rights under
the Constitution and laws of the United States, and the Constitution and laws of the
Commonwealth of Pennsylvania.
