DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE made and entered into at Davao City,
Philippines, this ________________, by and between ERWIN N. FLETE, of legal age, Filipino,
married to Geraldine V. Flete and a resident of
Block 1, Purok 3, Panacan Relocation, Davao City,
hereinafter called the VENDOR;
- and ELEODORO C. DERECHO III, of legal age,
Filipino, married to Estrellita B. Derecho and a
resident of Miranda Village, Poblacion, Sta. Cruz,
Davao del Sur, hereinafter called the VENDEE;
W I T N E S S E T H:
That the VENDOR is the owner in fee simple a parcel of land identified
to as Lot 7, Block 13, Transfer Certificate of Title No. T-146-2013001209
located at Villa Seorita, Barangay Langub, Ma-a, Davao City and containing
an area of One Hundred Twenty (120) square meters, more or less:

of Maa, City of Davao, Island of Mindanao, xxx
Consisting an area of ONE HUNDRED TWENTY (120)
Sq. M., more or less xxx.
That for and in consideration of the sum of FOUR HUNDRED
THOUSAND PESOS (P 400,000.00) ONLY, Philippine Currency, paid in hand by
the VENDEE unto the VENDOR and receipt whereof is acknowledged, the
VENDOR hereby CEDES, SELLS, TRANSFERS and CONVEYS unto the said
VENDEE, her heirs and assigns the above-described parcel of land together
with all the improvements found thereon, free from liens and encumbrances,
whatsoever.
That the above-described real property is mortgaged by the VENDOR in
favor of Metropolitan Bank and Trust Company (MBTC) by virtue of a
Metrohome Loan Agreement dated February 23, 2015.
That as part of the consideration of this sale, the VENDEE agrees to
assume as he hereby assumes all the duties and obligations of the VENDOR
imposed upon the latter on the aforementioned mortgage deed.

This instrument consists of two (2) pages including the page on which this
acknowledgment is written, and it refers to a Deed of Sale with Assumption of
Mortgage , involving one (1) parcel of land and the improvements found
therein, signed by the parties and their instrumental witnesses at the foot
thereof and on the left hand margin of the other pages and each and every
page is sealed with my notarial seal.
