OFFICE MEMORANDUM Sub Constitution of an Inter-Ministerial Group (IMG) to consider and recommend proposals for amendment to immoral Traffic Prevention Act (ITPA), 1956. ‘The Government of India has ratified United Nations Convention against Transnational Organised Crime (UNCTOC) and the three Protocols supplementing the Convention which includes the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children. The Convention along with the Protocols came into force in India with effect from 4th June 2011. The Protocol also casts an obligation on the State Parties to undertake measures for prevention of trafficking in persons as also for providing physical, psychological and social recovery of victims of ttafficking in persons. The premier legislation for combating trafficking for commercial sexuat exploitation is the Immoral Traffic Prevention Act (ITPA), 1956, and a duty is cast on the Government to examine the provisions of IPTA, 1956 to make the legislation suitably strengthened and compatible with the commitment inherent in the UN Protocols. 2. Ithas been decided in the Ministry of Women and Child Development (MWCD) to constitute an Inter-Ministerial Group (IMG) to consider and recommend proposals for amendment to Immoral Traffic Prevention Act {ITPA), 1956, The IMG will comprise the following i. The Terms of Reference (ToR) of the IMG are as under: {i) The IMG will review the Principal Act, the obligations cast on the Government in terms of the UN protocols, and consider the suggestions/recommendations on ITPA amendments that are available ‘on record and those that might be received further either by post or e-mail, till the IMG finalizes its recommendations. {ii) The IMG will have the power to co-opt representatives of any other Ministry/Department or outside experts in case it is required.
