WE seek to establish a
justice system whereby it
is the people themselves
who exercise the power to
say who must be arrested
and brought to trial and
who exercise the power to
judge if those brought to
trial are guilty or not.
The power to say who
should be tried in court
is now exercised by the
prosecutors in the Philip-
pines. So that if the one
being accused of rape,
murder or corruption is
influential, which is most
likely, the prosecutors
can easily be intimidated
or bought. BUT if we put
this power in the hands of
a Grand Jury, usually com-
posing 23 persons selected
by raffle from a voters’ list
and whose names and faces
are kept secret, we are fore-
closing any opportunity for
the influential crime doer to
use his power, money and
influence. The role of the
fiscal shall be limited to the
presentation of evidence
in court. The Grand Jury
is vested with the power
to compel intimidated or
bought witnesses to speak
up or he will be jailed un-
til they agree to speak up
by the power of contempt;
law enforcers will be com-
pelled to gather evidence or
they will be held in jail in
contempt until they agree to
work as detectives.
Now, the power to say
whether an accused is guilty
or not is exercised by one
judge in the Philippines;
may be of a regional trial
court or a municipal trial
court. As we know or hear,
the powerful and rich ac-
cused can easily influence
or buy decisions. BUT if
we place this power in the
hands of a Trial Jury, a group
of 12 ordinary persons cho-
sen at random from the vot-
ers’ list and whose faces
and names are kept secret,
we are also foreclosing any
opportunity for the decision
to be bought or influenced.
Here, ordinary persons are
tasked only to know what
is true and what is false; the
application of laws shall be
the duty of the judge who is
learned in law.
The fact that we are
foreclosing opportunities
for tampering with justice,
we are sure that the abusive
and corrupt shall learn to
toe the line and observe the
rule of law.
The vision here is we see
everybody to be
“PATAS SA BATAS.”
With jury, all laws can
now be implemented. If we
have laws against discrimi-
nation by one tribe against
another, or by Christians
against Muslims, or by the
rich against the poor, we can
say that rebellions (by NPA
and MILF) will die because
the root that is discrimina-
tion is being attacked by the
Jury System.
With all corruption
laws assured of imple-
mentation, the usually
corrupt officials will be
compelled to stop steal-
ing people’s money. The
swindlers will stop be-
cause they know the long
arm of the law will surely
reach them.
Businessmen will deal
fairly with the consum-
ers because the assurance
of implementation of the
laws keeps them at bay.

vey, Villar stayed in the No. 2
spot. However, the late surge
of Gordon vaulted the former
Olongapo mayor to shoot him
to the second place at a big
leap from virtual zero.
This Philjury survey, al-
though not scientific that con-
siders the plus and minus of
errors, is nevertheless an af-
firmation of credible surveys
conducted by the SWS, Pulse
Asia, TNS and that of 7-Elev-
en survey in all its stores na-
tionwide.

The jury justice system is
the most rigid owing to its na-
ture that it cannot be bought
or terrorized by the warlords
and the rich.
This is because the two
bodies of jury, the “fis-
cal jury” or the one called
“Grand Jury” in the United

then established quotas for al-
locating the annual common
funds of SSS, Pag-Ibig, and
GSIS based on the building

every year were for the Ca-
mella and Palmera (C & P)
company of Villar which got a
very large chunk of the funds
for their home mortgages.
Within the annual quotas
under the law, builders could
submit completed mortgages
and NHMFC would promptly
buy them at their face amounts
and pay the builder. It was the
builders who actively sold
mortgages in the malls and
everywhere else, approved
the papers, and submitted
them to NHMFC. NHMFC
only checked to see that the
amounts of mortgages sub-
mitted by the builders were
within their annual quotas be-
fore paying; it did not check
the credit-worthiness of the
borrower or even if the papers

The situation the law cre-
ated was unique in the entire
world. The pooled funds of
SSS, Pag-Ibig and GSIS were
effectively put into the hands
of developers, who built the
houses, found buyers willing
to take out mortgages, ap-
proved the mortgages, sub-
mitted them to the NHMFC,
and got the money in a few
months. In effect, the builder
controlled the credit funds
and approved the loans using
funds that were not theirs but
were funds of SSS, Pag-Ibig,
and GSIS.
This was a clear conflict of
interest, for the builder would
maximize his profits from
easy credit and would not
bear the cost of mortgage de-
faults. Naturally, lots of prob-
lems arose in just a few years
-- fake mortgages to fictitious
borrowers, nonexistent hous-
es sold to nonexistent buyers,
and the more common case:

ing a financial crisis for the
country.

The Makati regional trial
court found the case in our
favor and threw out the CRE-
BA-Villar law suit. For a long
while, we lost in the media
wars and were painted as anti-
poor bureaucrats. But the furor
eventually died down and the
reformed housing program we
fashioned has stood the test of
time. Since 1997, the repay-
ment rates of socialized and
low-cost housing mortgages
have remained high enough
to make the program sustain-
able. The looming financial
crisis was averted and we are
now in better shape than the
US, which did nothing to re-
form its own defective hous-
ing mortgage system.
Of course, the share prices
of C & P homes of Villar col-
lapsed, for everyone knew
that the company was prof-
itable only for as long as it

A Bureau of Immigration
(BI) official in the Visayas was
saved in the nick of time from
getting the axe because his un-
stoppable extortion and other
money-making acts reached the
BI Main office.
This official got a tipoff that
he would be axed. He wasted
no time in calling a friend in the
Palace, an assistant secretary in
Malacañang.
This BI official begged for
help and this assistant secretary
called up a new Secretary at
the “Malakanin,” ooops, Mala-
cañang, to spare him from the
wrath of the BI Main Office.
At the start, this very old
secretary did not agree but later
consented to save this BI offi-
cial’s neck.
I learned that this old sec-
retary was promised a “BIYA-
YA.”
Of course, this BI official
was so happy that his problem
was fixed by his assistant secre-
tary “bossing” that he will now
be safe.
If only this very old secre-
tary knew the “secret” of this BI
official, I am sure there would
be no fix.

“magic sugar” that caused can-
cer – but vendors continued to
sell “sago” and “gulaman” to
earn money for the last sur-
vival of their families.

test. While a chance exists that a guilty man or woman might go

HAT is it like
to serve on a
jury? Millions
of Americans
could answer
this question, each in a dif-
ferent way. But that each of
them has an answer — that
each of them has stepped in-
side a courtroom, witnessed
the unfolding of a trial, and
finally sat in judgment on
a fellow citizen — says a
great deal about the ideals of
openness and democracy to
which we aspire in the United
States.
The United States is not
by any means a perfect na-
tion, nor do we have anything
like a perfect legal system,
but our tradition of citizen
juries provides a remark-
able opportunity for ordinary
Americans to participate in
an intimate and challenging
way in maintaining the rule
of law and building a just so-
ciety.
We must not romanticize
this institution (it is impor-
tant to remember that the vast
majority of legal cases in the
United States are resolved
without going to a jury trial),
and there is always a danger
that excessive emphasis on
the appealingly civic char-
acter of jury justice will dis-
tract us from larger structural
and administrative features
of American legal practice
(such as plea bargaining).
Nevertheless, anyone who
wants to understand the way
the law works in the United
States must reckon with the
jury and appreciate its role
in the courts and in the lives
of Americans — both those
accused of crimes and those
called to help decide their
fate.
I am a historian, and I
teach in an American univer-
sity. My professional work
deals with the history of sci-
ence and technology from
the 17th to the 20th century,
and I have no formal legal
expertise. About 10 years
ago, however, I wrote a small
book about my experience
serving as the foreman of the
jury in a Manhattan murder
trial. This book, A Trial By
Jury, received a good deal of
attention for its depiction of
a jury’s struggles to reach a
verdict in a difficult case, and
free after a jury trial, the jury system still beats any other system.

A sketchy report gathered
by this columnist shows that

took turns raping her. When
brought back to the embas-
sy, she was already in a state
of shock. Sympathetic em-
bassy personnel brought her
to a hospital.
It was said that Nor was
able to come home but she
did not live long because she
died due to a lingering kid-

GM Wesley So, the brightest hope in Philippine chess

THEY say chess is the game of
kings. And a king is the most
important piece in the 64-
squared board which started in
India many centuries ago.
As the game progresses
into the present-day set-up, the
Philippines’ produce another
king of the sports of chess, GM
Wesley So.
GM Wesley peaked when
Asia’s first Grandmaster Eu-
genio Torre, GMs Rogelio
Antonio, Darwin Laylo, Bong
Barcenilla and the others had
seen a drop in their games,
became inactive or accepted a
coaching job overseas.
At age 16, Wesley So is not
even old enough to be issued
a non-professional driver’s
license by the Land Transpor-
tation Office (LTO). But one
thing he can do is to go toe-to-
toe and defeat even the most
revered name and brightest
chess minds twice, thrice, four
and five times his senior.
At age 14 years old, 1
month and 28 days, Wesley So
became the 7th youngest per-
son to achieve the Grandmas-
ter title in the history of chess.
In a country that goes ga-
ga over basketball and boxing,
GM So has opened up new
doors for a different breed of
Filipino athletes.

I still thought it was unlikely
I would actually end up on
a jury because every poten-
tial juror was required to go
through a process known as
voir dire, in which the law-
yers and judge ask a set of
questions to get a “feel” for
one’s suitability to serve on
the case. There are various
ways to get bumped from the
process (for instance, if you
say you are a racist or too
afraid, or if you already have
a strong opinion about the
case), and I assumed I would
be deemed unsuitable in one
way or another.
But no. Even though I
answered many questions in
an opinionated way (for in-
stance, I said that I objected
to the death penalty and that
I was not sure I could in
good conscience convict a
defendant who might be put
to death by the state), I was
kept on to serve, and indeed,
made the head of my jury of
12 very different Americans:
four men, eight women; nine
whites, two blacks, and a
Hispanic; about half under
age 30; about half profes-
sionals of one sort or another.
We would get to know each
other very well over the three
weeks that followed.
It is impossible for me
to rehearse all the twists and
turns of the testimony we
heard, or to reproduce the
intensity of the four days we
spent together in sequestered
deliberations about our ver-
dict. In serious cases such as
ours, it is not uncommon for
juries to be kept in something
like state custody as they
work to achieve consensus
about the case — and so we
were not allowed to go home
and not allowed to talk with
our families throughout the
66 hours of our final decision
making. We were escorted to
our meals by armed court of-
ficers and kept in hotels over-
night, attended by guards.
All this was much more
than a cheerful civics lesson;
it was a disorienting encoun-
ter with the power of the state
and the ugly matter at hand. In
our crucible, behind the closed
doors of the jury room, we
struggled to understand our
responsibilities and to make
sense of a vast amount of con-
flicting and complicated evi-
dence. There were tears and
fights, soulful silences, talks
about God and gays and truth
and justice. It was democratic
deliberation raised to the level
of an extreme sport.
The Verdict
Above all, we labored to
understand what it meant that
the state had to prove its case
“beyond a reasonable doubt.”
It is a very high standard.
And when a defendant claims
to have been acting in self-
defense, the burden of proof
remains on the state, which
must prove beyond a reason-
able doubt that the defendant
was not doing so.

and one comes out, claiming to
have been defending himself.
No witnesses. No evidence
of previous violent crime by
either party. Who can say “be-
yond a reasonable doubt” that
the survivor is lying?
We couldn’t. And, in the
end, we acquitted.
Not that we were happy
about it. We didn’t like the
defendant. We thought it
likely that he was lying about
the whole thing. We thought
it quite possible that he had
simply murdered Cuffee,
who may well have been his
lover. But we also realized
we hadn’t been asked what
we thought was possible or
likely. We had been asked
what had been proven be-
yond a reasonable doubt.

sion? In the United States the
answer is “a jury of peers.” It
