AFFIDAVIT OF WITNESS
I, ZENNY G. AGUIRRE, Filipino, of legal age, and a resident of
812 Diamond Building, Lacson St., Sampaloc, Manila,
Philippines, after having been duly sworn in accordance with
law do hereby depose and say that:
1. I
work as an account officer of Bayan Development
Corporation or BDC since 1995;
2. On July 25, 2014, Ma. Teresa Lacsamana and five others,
obtained a loan from BDC, evidenced by a promissory
note, the chattel mortgage and the Kasunduan;
3. After the loan was granted to Ms. Lacsamana, we released
the tricycle to her, and that was the time I met the
accused Romulo Takad because he came with her to get
the tricycle;
4. By reason of Ms. Lacsamanas failure to pay the loan, BDC
pulled out the tricycle from her;
5. Under the Kasunduan, if the borrower was unable to pay,
the tricycle would be pulled out from her;
6. Thereafter, we gave the tricycle to the treasurer of the
group, Mr. Ricardo Marasigan, for him to manage and it
remained in his possession for more or less 15 days;
7. I agreed with Ms. Lacsamana to give her an extension of
time within which to redeem the tricycle and if not, we will
permanently repossess the vehicle;
8. Ms. Lacsamana failed to comply with her undertaking, we
got the tricycle from the treasurer of their group;
9. Afterwards, Ms. Lacsamana and Mr. Takad went to our
office and wanted to pay the outstanding balance of her
loan so we could release the tricycle but we did not allow
them;
10.Takad said, Huwag na huwag kong makikita ang tricycle
sa Maynila;

11.We kept the tricycle for a while and gave it to Carlos

Parlade, the new assignee on September 1, 2015;
12.We do not have documents showing this assignment
because before we could drew up one, on September 10,
2015, Mr. Parlade told me that the tricycle was missing, he
called the office;
13.I went to Mr. Parlade and asked him for details regarding
how the tricycle was lost and he told me that he saw the
tricycle being driven away by someone;
14.He described the man as small, with short hair, and with a
face towel on his shoulder referring to the accused;
15.On September 10, 2015 at 1:00 oclock in the afternoon,
together with Mr. Parlade, we reported the incident before the
Manila Police District Headquarters Anti-Carnapping Unit.
