LA CONVENZIONE DI ROMA
16*. Convenzione internazionale relativa allaprotezione degli artisti interpreti o
esecutori, dei produttori di fonogrammi e degli organismi di radiodiffusione,
firmata a Roma il 26 ottobre 1961.
Storia: questa convenzione stata firmata a Roma il 26 ottobre 1961, stata
ratificata dallItalia in base alla legge 22 novembre 1973 n. 866, entrata in
vigore in Italia l8 aprile 1975 (comunicato 16 dicembre 1975), e vi ancora
in vigore.

Convenzione internazionale relativa alla protezione degli artisti, interpreti o
esecutori, dei produttori di fonogrammi e degli organismi di radiodiffusione,
firmata a Roma il 26 ottobre 1961.
Gli Stati contraenti,
animati dal desiderio di proteggere i diritti degli artisti interpreti o esecutori, dei
produttori di fonogrammi e degli organismi di radiodiffusione,
hanno convenuto quanto segue:
1. La protezione prevista dalla presente convenzione lascia intatta la protezione
del diritto di autore sulle opere letterarie ed artistiche e non influisce in alcun modo su di
essa. Di conseguenza, nessuna disposizione della presente convenzione potr essere
interpretata come lesiva di tale protezione.
2. 1. Ai fini della presente convenzione, si intende per trattamento nazionale il
trattamento che lo Stato contraente, nel territorio del quale la protezione richiesta,
accorda, a norma della legislazione nazionale:
a) agli artisti interpreti o esecutori, che siano suoi cittadini, per le esecuzioni
realizzate, fissate per la prima volta o radiodiffuse nel suo territorio;
b) ai produttori di fonogrammi, che siano suoi cittadini, per i fonogrammi per la
prima volta pubblicati o fissati nel suo territorio;
c) agli organismi di radiodiffusione aventi la loro sede sociale nel suo territorio,
per le emissioni radiodiffuse da stazioni emittenti situate in tale territorio.

18. Ogni Stato che abbia fatto una delle dichiarazioni previste all'articolo 5
paragrafo 3, all'articolo 6 paragrafo 2, all'articolo 16 paragrafo 1, o all'articolo 17, pu,
mediante una nuova notificazione indirizzata al Segretario generale delle Nazioni Unite,
ridurne la portata o ritirarla.
19. Nonostante ogni altra disposizione della presente convenzione, l'articolo 7
cesser di essere applicabile ogni qualvolta un artista interprete o esecutore abbia dato il
suo consenso all'inclusione della sua esecuzione in una fissazione di immagini o di
immagini e di suoni.
20. 1. La presente convenzione non lede i diritti acquisiti in uno qualunque
degli Stati contraenti anteriormente alla data dell'entrata in vigore della convenzione per
tale Stato.
2. Nessuno Stato contraente sar tenuto ad applicare le disposizioni della
presente convenzione alle esecuzioni o alle emissioni di radiodiffusione effettuate, ovvero
ai fonogrammi registrati, anteriormente alla data di entrata in vigore della convenzione
per tale Stato.
21. La protezione prevista nella presente convenzione non potr inficiare quella
della quale possano altrimenti beneficiare gli artisti interpreti o esecutori, i produttori di
fonogrammi e gli organismi di radiodiffusione
22. Gli Stati contraenti si riservano il diritto di concludere tra di loro accordi
particolari, purch tali accordi conferiscano agli artisti interpreti o esecutori, ai produttori
di fonogrammi o agli organismi di radiodiffusione diritti pi estesi di quelli accordati dalla
presente convenzione ovvero contengano altre disposizioni non contrarie a detta
convenzione.
23. La presente convenzione sar depositata presso il Segretario generale
dell'Organizzazione delle Nazioni Unite. Essa rimarr aperta, fino alla data del 30 giugno
1962, alla firma degli Stati invitati alla Conferenza diplomatica sulla protezione
internazionale degli artisti interpreti o esecutori, dei produttori di fonogrammi e degli
organismi di radiodiffusione, che partecipano alla Convenzione universale sul diritto di
autore o sono membri dell'Unione internazionale per la protezione delle opere letterarie
ed artistiche.
24. 1. La presente convenzione sar sottoposta a ratifica o accettazione degli
Stati firmatari.
2. La presente convenzione sar aperta all'adesione degli Stati invitati alla
Conferenza indicata nell'articolo 23, nonch all'adesione di qualunque Stato membro
dell'Organizzazione delle Nazioni Unite, a condizione che lo Stato aderente partecipi alla
convenzione universale sul diritto di autore ovvero sia membro dell'Unione
internazionale per la protezione delle opere letterarie ed artistiche.
3. La ratifica, l'accettazione o l'adesione avverr mediante il deposito di apposito
strumento presso il Segretario generale dell'Organizzazione delle Nazioni Unite.
25. 1. La presente convenzione entrer in vigore tre mesi dopo la data di
deposito del sesto strumento di ratifica, di accettazione o di adesione.
2. In seguito, la convenzione entrer in vigore, per ogni altro Stato, tre mesi
dopo la data di deposito del proprio strumento di ratifica, di accettazione o di adesione.
26. 1. Ciascuno degli Stati contraenti s'impegna ad adottare, in conformit delle
disposizioni della propria Costituzione, le misure necessarie per assicurare l'applicazione
della presente convenzione.
2. All'atto del deposito del proprio strumento di ratifica, d'accettazione o di
adesione, ciascuno Stato dovr essere in grado, in conformit della propria legislazione
nazionale, di applicare le disposizioni della presente convenzione.
27. 1. Ciascuno Stato potr, all'atto della ratifica, dell'accettazione o
dell'adesione, o in qualsiasi altro ulteriore momento, dichiarare, mediante notifica
indirizzata al Segretario generale dell'Organizzazione delle Nazioni Unite, che la presente
convenzione si estender a tutti o ad uno qualsiasi dei territori di cui esso curi le relazioni
internazionali, a condizione che la convenzione universale sul diritto d'autore o la
convenzione internazionale per la protezione delle opere letterarie ed artistiche sia
applicabile a tali territori. Tale notifica produrr effetto tre mesi dopo la data del suo
ricevimento.

numero degli Stati contraenti da tredici a diciotto, e di dodici se il numero degli Stati
contraenti supera i diciotto.
3. Il Comitato sar costituito dodici mesi dopo l'entrata in vigore della
convenzione, in seguito ad uno scrutinio organizzato tra gli Stati contraenti - i quali
disporranno ciascuno di un voto - dal Direttore generale dell'Ufficio internazionale del
lavoro, dal Direttore generale dell'Organizzazione delle Nazioni Unite per l'educazione,
la scienza e la cultura, e dal Direttore dell'Ufficio dell'Unione internazionale per la
protezione delle opere letterarie ed artistiche, conformemente alle norme che saranno
state previamente approvate dalla maggioranza assoluta degli Stati contraenti.
4. Il Comitato elegger il suo presidente e il suo ufficio. Esso stabilir un
regolamento interno concernente in particolare il suo futuro funzionamento e il suo
modo di rinnovamento; detto regolamento dovr soprattutto assicurare l'avvicendamento
tra i diversi Stati contraenti.
5. Il segretario del Comitato sar composto di funzionari dell'Ufficio
internazionale del lavoro, dell'Organizzazione delle Nazioni Unite per l'educazione, la
scienza e la cultura e dell'Ufficio dell'Unione internazionale per la protezione delle opere
letterarie e artistiche designati rispettivamente dai Direttori generali e dal Direttore delle
tre istituzioni interessate.
6. Le riunioni del Comitato, che sar convocato ogni qualvolta la maggioranza
dei suoi membri lo riterr utile, saranno tenute successivamente presso le sedi rispettive
dell'Ufficio internazionale del lavoro, dell'Organizzazione delle Nazioni Unite per
l'educazione, la scienza e la cultura e dell'Ufficio dell'Unione internazionale per la
protezione delle opere letterarie ed artistiche.
7. Le spese dei membri del Comitato saranno a carico dei rispettivi Governi.
33. 1. La presente convenzione redatta in lingua francese, inglese e spagnola,
i tre testi facenti ugualmente fede.
2. Saranno inoltre redatti i testi ufficiali della presente convenzione in lingua
tedesca, italiana e portoghese.
34. 1. Il Segretario generale dell'Organizzazione delle Nazioni Unite informer
gli Stati invitati alla Conferenza indicata all'articolo 23 e ciascuno degli Stati membri
dell'Organizzazione delle Nazioni Unite nonch il Direttore generale dell'Ufficio
internazionale del lavoro, il Direttore generale dell'Organizzazione delle Nazioni Unite
per l'educazione, la scienza e la cultura e il Direttore dell'Ufficio dell'Unione
internazionale per la protezione delle opere letterarie ed artistiche:
a) del deposito di ogni strumento di ratifica, di accettazione o di adesione;
b) della data di entrata in vigore della convenzione;
c) delle notifiche, delle dichiarazioni e di ogni altra comunicazione prevista nella
presente convenzione;
d) di ogni caso in cui si verificasse una delle situazioni prevista ai paragrafi 4 e 5
dell'articolo 28.
2. Il Segretario generale dell'Organizzazione delle Nazioni Unite informer del
pari il Direttore generale dell'Ufficio internazionale del lavoro, il Direttore generale
dell'Organizzazione delle Nazioni Unite per l'educazione, la scienza e la cultura e il
Direttore dell'Ufficio dell'Unione internazionale per la protezione delle opere letterarie ed
artistiche delle domande che gli verranno notificate ai termini dell'articolo 29, come pure
di qualsiasi altra comunicazione pervenuta dagli Stati contraenti in merito alla revisione
della presente convenzione.
In fede di che i sottoscritti, debitamente autorizzati a tale effetto, hanno firmato
la presente convenzione.
Fatto a Roma, il 26 ottobre 1961, in un solo esemplare in francese, in inglese e
in spagnolo. Copie conformi saranno inviate a cura del Segretario generale
dell'Organizzazione delle Nazioni Unite a tutti gli Stati inviati alla Conferenza indicata
all'articolo 23 e ad ogni Stato membro dell'Organizzazione delle Nazioni Unite, come
pure al Direttore generale dell'Ufficio internazionale del lavoro, al Direttore generale
dell'Organizzazione delle Nazioni Unite per l'educazione, la scienza e la cultura e al
Direttore dell'Ufficio dell'Unione internazionale per la protezione delle opere letterarie ed
artistiche.

Convention internationale du 26 octobre 1961 sur la protection des artistes
interprtes ou excutants des producteurs de phonogrammes et des organismes de
radiodiffusion.
Les Etats contractants,
anims du dsir de protger les droits des artistes interprtes ou excutants, des
producteurs de phonogrammes et des organismes de radiodiffusion,
sont convenus de ce qui suit:
1. La protection prvue par la prsente Convention laisse intacte et n'affecte en
aucune faon la protection du droit d'auteur sur les uvre littraires et artistiques. En
consquence, aucune disposition de la prsente Convention ne pourra tre interprte
comme portant atteinte cette protection
2. 1. Aux fins de la prsente Convention, on entend, par traitement national, le
traitement que l'Etat contractant sur le territoire duquel la protection est demande
accorde, en vertu de sa lgislation nationale:
a) aux artistes interprtes ou excutants, qui sont ses ressortissants, pour les
excutions qui ont lieu, sont fixes pour la premire fois, ou sont radio-diffuses, sur son
territoire;
b) aux producteurs de phonogrammes qui sont ses ressortissants, pour les
phonogrammes qui sont, pour la premire fois, publis ou fixs sur son territoire;
c) aux organismes de radiodiffusion ayant leur sige social sur son territoire,
pour les missions radiodiffuses par des metteurs situs sur ce territoire.
2. Le traitement national sera accord, compte tenu de la protection
expressment garantie et des limitations expressment prvues dans la prsente
Convention.
3. Aux fins de la prsente Convention, on entend par:
a) artistes interprtes ou excutants, les acteurs, chanteurs, musiciens,
danseurs et autres personnes qui reprsentent, chantent, rcitent, dclament, jouent ou
excutent de toute autre manire des uvre littraires ou artistiques;
b) phonogramme, toute fixation exclusivement sonore des sons provenant
d'une excution ou d'autres sons;
c) producteur de phonogrammes, la personne physique ou morale qui, la
premire, fixe les sons provenant d'une excution ou d'autres sons;
d) publication, la mise la disposition du public d'exemplaires d'un
phonogramme en quantit suffisante;
e) reproduction, la ralisation d'un exemplaire ou de plusieurs exemplaires
d'une fixation;
f) mission de radiodiffusion, la diffusion de sons ou d'images et de sons par
le moyen des ondes radiolectriques, aux fins de rception par le public;
g) rmission, l'mission simultane par un organisme de radiodiffusion d'une
mission d'un autre organisme de radiodiffusion.
4. Chaque Etat contractant accordera le traitement national aux artistes
interprtes ou excutants toutes les fois que l'une des conditions suivantes se trouvera
remplie:
a) l'excution a lieu dans un autre Etat contractant;
b) l'excution est enregistre sur un phonogramme protg en vertu de l'article 5
cidessous;
c) l'excution non fixe sur phonogramme est diffuse par une mission
protge en vertu de l'article 6.
5. 1. Chaque Etat contractant accordera le traitement national aux producteurs
de phonogrammes toutes les fois que l'une des conditions suivantes se trouvera remplie:
a) le producteur de phonogrammes est le ressortissant d'un autre Etat
contractant (critre de la nationalit);
b) la premire fixation du son a t ralise dans un autre Etat contractant
(critre de la fixation);
c) le phonogramme a t publi pour la premire fois dans un autre Etat
contractant (critre de la publication).
2. Lorsque la premire publication a eu lieu dans un Etat non contractant mais
que le phonogramme a galement t publi, dans les trente jours suivant la premire
publication, dans un Etat contractant (publication simultane), ce phonogramme sera
considr comme ayant t publi pour la premire fois dans l'Etat contractant.

3. Tout Etat contractant peut, par une notification dpose auprs du Secrtaire
gnral de l'Organisation des Nations Unies, dclarer qu'il n'appliquera pas, soit le critre
de la publication, soit le critre de la fixation. Cette notification peut tre dpose au
moment de la ratification, de l'acceptation ou de l'adhsion, ou tout autre moment; dans
ce dernier cas, elle ne prendra effet que six mois aprs son dpt.
6. 1. Chaque Etat contractant accordera le traitement national aux organismes
de radiodiffusion toutes les fois que l'une des conditions suivantes se trouvera remplie:
a) le sige social de l'organisme de radiodiffusion est situ dans un autre Etat
contractant,
b) l'mission a t diffuse par un metteur situ sur le territoire d'un autre Etat
contractant.
2. Tout Etat contractant peut, par une notification dpose auprs du Secrtaire
gnral de l'Organisation des Nations Unies, dclarer qu'il n'accordera de protection
des missions que si le sige social de l'organisme de radiodiffusion est situ dans un
autre Etat contractant et si l'mission a t diffuse par un metteur situ sur le territoire
du mme Etat contractant. Cette notification peut tre faite au moment de la ratification,
de l'acceptation ou de l'adhsion, ou tout autre moment; dans ce dernier cas, elle ne
prendra effet que six mois aprs son dpt.
7. 1. La protection prvue par la prsente Convention en faveur des artistes
interprtes ou excutants devra permettre de mettre obstacle:
a) la radiodiffusion et la communication au public de leur excution sans leur
consentement, sauf lorsque l'excution utilise pour la radiodiffusion ou la
communication au public est ellemme dj une excution radiodiffuse ou est faite
partir d'une fixation;
b) la fixation sans leur consentement sur un support matriel de leur excution
non fixe;
c) la reproduction sans leur consentement d'une fixation de leur excution:
i) lorsque la premire fixation a ellemme t faite sans leur consentement;
ii) lorsque la reproduction est faite des fins autres que celles pour lesquelles ils
ont donn leur consentement;
iii) lorsque la premire fixation a t faite en vertu des dispositions de l'article 15
et a t reproduite des fins autres que celles vises par ces dispositions.
2. 1) Il appartient la lgislation nationale de l'Etat contractant sur le territoire
duquel la protection est demande de pourvoir la protection contre la rmission, la
fixation aux fins de radiodiffusion et la reproduction d'une telle fixation aux fins de
radiodiffusion, lorsque l'artiste interprte ou excutant a consenti la radiodiffusion.
2) Les modalits d'utilisation par les organismes de radiodiffusion des fixations
faites aux fins d'missions radiodiffuses seront rgles selon la lgislation nationale de
l'Etat contractant sur le territoire duquel la protection est demande.
3) Toutefois, la lgislation nationale, dans les cas viss aux alinas (1) et (2) du
prsent paragraphe, ne saurait avoir pour effet de priver les artistes interprtes ou
excutants de la capacit de rgler, par voie contractuelle, leurs relations avec les
organismes de radiodiffusion.
8. Tout Etat contractant peut, par sa lgislation nationale, dterminer les
modalits suivant lesquelles les artistes interprtes ou excutants seront reprsents, en
ce qui concerne l'exercice de leurs droits, lorsque plusieurs d'entre eux participent une
mme excution.
9. Tout Etat contractant peut, par sa lgislation nationale, tendre la protection
prvue par la prsente Convention des artistes qui n'excutent pas des uvre littraires
ou artistiques
10. Les producteurs de phonogrammes jouissent du droit d'autoriser ou
d'interdire la reproduction directe ou indirecte de leurs phonogrammes
11. Lorsqu'un Etat contractant exige, en vertu de sa lgislation nationale,
l'accomplissement de formalits, titre de condition de la protection, en matire de
phonogrammes, des droits soit des producteurs de phonogrammes, soit des artistes
interprtes ou excutants, soit des uns et des autres, ces exigences seront considres
comme satisfaites si tous les exemplaires dans le commerce du phonogramme publi, ou
l'tui le contenant, portent une mention constitue par le symbole (P) accompagn de
l'indication de l'anne de la premire publication, appose d'une manire montrant de
faon nette que la protection est rserve. De plus, si les exemplaires ou leur tui ne
permettent pas d'identifier le producteur du phonogramme ou le titulaire de la licence

2. Par la suite, la Convention entrera en vigueur, pour chaque Etat, trois mois
aprs la date du dpt de son instrument de ratification, d'acceptation ou d'adhsion
26. 1. Tout Etat contractant s'engage prendre, conformment aux dispositions
de sa constitution, les mesures ncessaires pour assurer l'application de la prsente
Convention.
2. Au moment du dpt de son instrument de ratification, d'acceptation ou
d'adhsion, tout Etat doit tre en mesure, conformment sa lgislation nationale,
d'appliquer les dispositions de la prsente Convention.
27. 1. Tout Etat pourra, au moment de la ratification, de l'acceptation ou de
l'adhsion, ou tout moment ultrieur, dclarer par une notification adresse au
Secrtaire gnral de l'Organisation des Nations Unies, que la prsente Convention
s'tendra l'ensemble ou l'un quelconque des territoires dont il assure les relations
internationales, condition que la Convention universelle sur le droit d'auteur ou la
Convention internationale pour la protection des uvre littraires et artistiques soit
applicable aux territoires dont il s'agit. Cette notification prendra effet trois mois aprs la
date de sa rception.
2. Les dclarations et notifications vises l'article 5, paragraphe 3, l'article 6,
paragraphe 2, l'article 16, paragraphe 1, l'article 17 ou l'article 18, peuvent tre
tendues l'ensemble ou l'un quelconque des territoires viss au paragraphe qui
prcde.
28. 1. Tout Etat contractant aura la facult de dnoncer la prsente Convention,
soit en son nom propre, soit au nom de l'un quelconque ou de l'ensemble des territoires
viss l'article 27.
2. La dnonciation sera faite par une notification adresse au Secrtaire gnral
de l'Organisation des Nations Unies et prendra effet douze mois aprs la date laquelle la
notification aura t reue.
3. La facult de dnonciation prvue au prsent article ne pourra tre exerce
par un Etat contractant avant l'expiration d'une priode de cinq ans compter de la date
partir de laquelle la Convention est entre en vigueur l'gard dudit Etat.
4. Tout Etat contractant cesse d'tre partie la prsente Convention ds le
moment o il ne serait plus ni partie la Convention universelle sur le droit d'auteur ni
membre de l'Union internationale pour la protection des uvre littraires et artistiques.
5. La prsente Convention cesse d'tre applicable tout territoire vis l'article
27, ds le moment o ni la Convention universelle sur le droit d'auteur ni la Convention
internationale pour la protection des uvre littraires et artistiques ne s'appliquerait plus
ce territoire.
29. 1. Aprs que la prsente Convention aura t en vigueur pendant cinq ans,
tout Etat contractant pourra, par une notification adresse au Secrtaire gnral de
l'Organisation des Nations Unies, demander la convocation d'une confrence l'effet de
reviser la Convention. Le Secrtaire gnral notifiera cette demande tous les Etats
contractants. Si, dans un dlai de six mois dater de la notification adresse par le
Secrtaire gnral de l'Organisation des Nations Unies, la moiti au moins des Etats
contractants lui signifient leur assentiment cette demande, le Secrtaire gnral en
informera le Directeur gnral du Bureau international du Travail, le Directeur gnral de
l'Organisation des Nations Unies pour l'ducation, la science et la culture et le Directeur
du Bureau de l'Union internationale pour la protection des uvre littraires et artistiques,
qui convoqueront une confrence de rvision en collaboration avec le Comit
intergouvernemental prvu l'article 32.
2. Toute rvision de la prsente Convention devra tre adopte la majorit des
deux tiers des Etats prsents la Confrence de rvision condition que cette majorit
comprenne les deux tiers des Etats qui, la date de la Confrence de rvision, sont
parties la Convention.
3. Au cas o une nouvelle Convention portant rvision totale ou partielle de la
prsente Convention serait adopte, et moins que la nouvelle Convention ne dispose
autrement:
a) la prsente Convention cessera d'tre ouverte la ratification, l'acceptation
ou l'adhsion partir de la date d'entre en vigueur de la nouvelle Convention portant
rvision;

Rome convention, 1961 international convention for the protection of performers,
producers of phonograms and broadcasting organisations. Done at Rome on
October 26, 1961.
Articles have been given titles to facilitate their identification. There are no titles
in the signed text.
The Contracting States, moved by the desire to protect the rights of performers,
producers of phonograms, and broadcasting organisations,
Have agreed as follows:
1. Protection granted under this Convention shall leave intact and shall in no
way affect the protection of copyright in literary and artistic works. Consequently, no
provision of this Convention may be interpreted as prejudicing such protection.
2. (1) For the purposes of this Convention, national treatment shall mean the
treatment accorded by the domestic law of the Contracting State in which protection is
claimed:
(a) to performers who are its nationals, as regards performances taking place,
broadcast, or first fixed, on its territory;
(b) to producers of phonograms who are its nationals, as regards phonograms
first fixed or first published on its territory;
(c) to broadcasting organisations which have their headquarters on its territory,
as regards broadcasts transmitted from transmitters situated on its territory.
(2) National treatment shall be subject to the protection specifically guaranteed,
and the limitations specifically provided for, in this Convention.
3. For the purposes of this Convention:
(a)"performers" means actors, singers, musicians, dancers, and other persons
who act, sing, deliver, declaim, play in, or otherwise perform literary or artistic works;
(b) "phonogram" means any exclusively aural fixation of sounds of a
performance or of other sounds;
(c) "producer of phonograms" means the person who, or the legal entity which,
first fixes the sounds of a performance or other sounds;
(d) "publication" means the offering of copies of a phonogram to the public in
reasonable quantity;
(e) "reproduction" means the making of a copy or copies of a fixation;
(f) "broadcasting" means the transmission by wireless means for public
reception of sounds or of images and sounds;
(g) "rebroadcasting" means the simultaneous broadcasting by one broadcasting
organisation of the broadcast of another broadcasting organisation.
4. Each Contracting State shall grant national treatment to performers if any of
the following conditions is met:
(a) the performance takes place in another Contracting State;
(b) the performance is incorporated in a phonogram which is protected under
Article 5 of this Convention;
(c) the performance, not being fixed on a phonogram, is carried by a broadcast
which is protected by Article 6 of this Convention.
5. (1) Each Contracting State shall grant national treatment to producers of
phonograms if any of the following conditions is met:
(a) the producer of the phonogram is a national of another Contracting State
(criterion of nationality);
(b) the first fixation of the sound was made in another Contracting State
(criterion of fixation);
(c) the phonogram was first published in another Contracting State (criterion of
publication).
(2) If a phonogram was first published in a non-contracting State but if it was
also published, within thirty days of its first publication, in a Contracting State
(simultaneous publication), it shall be considered as first published in the Contracting
State.
(3) By means of a notification deposited with the Secretary-General of the
United Nations, any Contracting State may declare that it will not apply the criterion of
publication or, alternatively, the criterion of fixation. Such notification may be deposited
at the time of ratification, acceptance or accession, or at any time thereafter; in the last
case, it shall become effective six months after it has been deposited.

agreement between these parties, lay down the conditions as to the sharing of this
remuneration.
13. Broadcasting organisations shall enjoy the right to authorise or prohibit:
(a) the rebroadcasting of their broadcasts;
(b) the fixation of their broadcasts;
(c) the reproduction:
(i) of fixations, made without their consent, of their broadcasts;
(ii) of fixations, made in accordance with the provisions of Article 15, of their
broadcasts, if the reproduction is made for purposes different from those referred to in
those provisions;
(d) the communication to the public of their television broadcasts if such
communication is made in places accessible to the public against payment of an entrance
fee; it shall be a matter for the domestic law of the State where protection of this right is
claimed to determine the conditions under which it may be exercised.
14. The term of protection to be granted under this Convention shall last at least
until the end of a period of twenty years computed from the end of the year in which:
(a) the fixation was made-for phonograms and for performances incorporated
therein;
(b) the performance took place-for performances not incorporated in
phonograms;
(c) the broadcast took place-for broadcasts.
15. (1) Any Contracting State may, in its domestic laws and regulations, provide
for exceptions to the protection guaranteed by this Convention as regards:
(a) private use;
(b) use of short excerpts in connection with the reporting of current events;
(c) ephemeral fixation by a broadcasting organisation by means of its own
facilities and for its own broadcasts;
(d) use solely for the purposes of teaching or scientific research.
(2) Irrespective of paragraph 1 of this Article, any Contracting State may, in its
domestic laws and regulations, provide for the same kinds of limitations with regard to
the protection of performers, producers of phonograms and broadcasting organisations,
as it provides for, in its domestic laws and regulations, in connection with the protection
of copyright in literary and artistic works. However, compulsory licences may be
provided for only to the extent to which they are compatible with this Convention.
16. (1) Any State, upon becoming party to this Convention, shall be bound by
all the obligations and shall enjoy all the benefits thereof. However, a State may at any
time, in a notification deposited with the Secretary-General of the United Nations,
declare that:
(a) as regards Article 12:
(i) it will not apply the provisions of that Article;
(ii) it will not apply the provisions of that Article in respect of certain uses;
(iii) as regards phonograms the producer of which is not a national of another
Contracting State, it will not apply that Article;
(iv) as regards phonograms the producer of which is a national of another
Contracting State, it will limit the protection provided for by that Article to the extent to
which, and to the term for which, the latter State grants protection to phonograms first
fixed by a national of the State making the declaration; however, the fact that the
Contracting State of which the producer is a national does not grant the protection to the
same beneficiary or beneficiaries as the State making the declaration shall not be
considered as a difference in the extent of the protection;
(b) as regards Article 13, it will not apply item 13(d); if a Contracting State
makes such a declaration, the other Contracting States shall not be obliged to grant the
right referred to in Article 13(d), to broadcasting organisations whose headquarters are
in that State.
(2) If the notification referred to in paragraph 1 of this Article is made after the
date of the deposit of the instrument of ratification, acceptance or accession, the
declaration will become effective six months after it has been deposited.
17. Any State which, on October 26, 1961, grants protection to producers of
phonograms solely on the basis of the criterion of fixation may, by a notification
deposited with the Secretary-General of the United Nations at the time of ratification,
acceptance or accession, declare that it will apply, for the purposes of Article 5, the

criterion of fixation alone and, for the purposes of paragraph 16.1(a)(iii) and 16.1(a)(iv),
the criterion of fixation instead of the criterion of nationality.
18. Any State which has deposited a notification under Article 5.3, Article 6.2,
Article 16.1 or Article 17, may, by a further notification deposited with the SecretaryGeneral of the United Nations, reduce its scope or withdraw it.
19. Notwithstanding anything in this Convention, once a performer has
consented to the incorporation of his performance in a visual or audio-visual fixation,
Article 7 shall have no further application.
20. (1) This Convention shall not prejudice rights acquired in any Contracting
State before the date of coming into force of this Convention for that State.
(2) No Contracting State shall be bound to apply the provisions of this
Convention to performances or broadcasts which took place, or to phonograms which
were fixed, before the date of coming into force of this Convention for that State.
21. The protection provided for in this Convention shall not prejudice any
protection otherwise secured to performers, producers of phonograms and broadcasting
organisations.
22. Contracting States reserve the right to enter into special agreements among
themselves in so far as such agreements grant to performers, producers of phonograms
or broadcasting organisations more extensive rights than those granted by this
Convention or contain other provisions not contrary to this Convention.
23. This Convention shall be deposited with the Secretary-General of the United
Nations. It shall be open until June 30, 1962, for signature by any State invited to the
Diplomatic Conference on the International Protection of Performers, Producers of
Phonograms and Broadcasting Organisations which is a party to the Universal Copyright
Convention or a member of the International Union for the Protection of Literary and
Artistic Works.
24. (1) This Convention shall be subject to ratification or acceptance by the
signatory States.
(2) This Convention shall be open for accession by any State invited to the
Conference referred to in Article 23, and by any State Member of the United Nations,
provided that in either case such State is a party to the Universal Copyright Convention
or a member of the International Union for the Protection of Literary and Artistic Works.
(3) Ratification, acceptance or accession shall be effected by the deposit of an
instrument to that effect with the Secretary-General of the United Nations.
25. (1) This Convention shall come into force three months after the date of
deposit of the sixth instrument of ratification, acceptance or accession.
(2) Subsequently, this Convention shall come into force in respect of each State
three months after the date of deposit of its instrument of ratification, acceptance or
accession.
26. (1) Each Contracting State undertakes to adopt, in accordance with its
Constitution, the measures necessary to ensure the application of this Convention.
(2) At the time of deposit of its instrument of ratification, acceptance or
accession, each State must be in a position under its domestic law to give effect to the
terms of this Convention.
27. (1) Any State may, at the time of ratification, acceptance or accession, or at
any time thereafter, declare by notification addressed to the Secretary-General of the
United Nations that this Convention shall extend to all or any of the territories for whose
international relations it is responsible, provided that the Universal Copyright Convention
or the International Convention for the Protection of Literary and Artistic Works applies
to the territory or territories concerned. This notification shall take effect three months
after the date of its receipt.
(2) The notifications referred to in Article 5.3, Article 6.2, Article 16.1 and
Articles 17 and 18, may be extended to cover all or any of the territories referred to in
paragraph 1 of this Article.
28. (1) Any Contracting State may denounce this Convention, on its own behalf
or on behalf of all or any of the territories referred to in Article 27.
(2) The denunciation shall be effected by a notification addressed to the
Secretary-General of the United Nations and shall take effect twelve months after the
date of receipt of the notification.

(5) Officials of the International Labour Office, the United Nations Educational,
Scientific and Cultural Organization and the Bureau of the International Union for the
Protection of Literary and Artistic Works, designated by the Directors-General and the
Director thereof, shall constitute the Secretariat of the Committee.
(6) Meetings of the Committee, which shall be convened whenever a majority of
its members deems it necessary, shall be held successively at the headquarters of the
International Labour Office, the United Nations Educational, Scientific and Cultural
Organization and the Bureau of the International Union for the Protection of Literary
and Artistic Works.
(7) Expenses of members of the Committee shall be borne by their respective
Governments.
33. (1) The present Convention is drawn up in English, French and Spanish, the
three texts being equally authentic.
(2) In addition, official texts of the present Convention shall be drawn up in
German, Italian and Portuguese.
34. (1) The Secretary-General of the United Nations shall notify the States
invited to the Conference referred to in Article 23 and every State Member of the United
Nations, as well as the Director-General of the International Labour Office, the DirectorGeneral of the United Nations Educational, Scientific and Cultural Organization and the
Director of the Bureau of the International Union for the Protection of Literary and
Artistic Works:
(a) of the deposit of each instrument of ratification, acceptance or accession;
(b) of the date of entry into force of the Convention;
(c) of all notifications, declarations or communications provided for in this
Convention;
(d) if any of the situations referred to in paragraphs 28.4 and 28.5 arise.
(2) The Secretary-General of the United Nations shall also notify the DirectorGeneral of the International Labour Office, the Director-General of the United Nations
Educational, Scientific and Cultural Organization and the Director of the Bureau of the
International Union for the Protection of Literary and Artistic Works of the requests
communicated to him in accordance with Article 29, as well as of any communication
received from the Contracting States concerning the revision of the Convention.

Los Estados Contratantes, animados del deseo de asegurar la proteccin de los
derechos de los artistas intrpretes o ejecutantes, de los productores de fonogramas y de
los organismos de radiodifusin,
Han convenido:
1. Se han agregado ttulos a los artculos con el fin de facilitar su identificacin.
El texto firmado no lleva ttulos.
La proteccin prevista en la presente Convencin dejar intacta y no afectar en
modo alguno a la proteccin del derecho de autor sobre las obras literarias y artsticas.
Por lo tanto, ninguna de las disposiciones de la presente Convencin podr interpretarse
en menoscabo de esa proteccin.
2. 1. A los efectos de la presente Convencin se entender por "mismo trato
que a los nacionales" el que conceda el Estado Contratante en que se pida la proteccin,
en virtud de su derecho interno:
a) a los artistas intrpretes o ejecutantes que sean nacionales de dicho Estado,
conrespecto a las interpretaciones o ejecuciones realizadas, fijadas por primera vez
oradiodifundidas en su territorio;
b) a los productores de fonogramas que sean nacionales de dicho Estado, con
respecto a los fonogramas publicados o fijados por primera vez en su territorio;
c) a los organismos de radiodifusin que tengan su domicilio legal en el
territorio de dicho Estado, con respecto a las emisiones difundidas desde emisoras
situadas en su territorio.
2. El "mismo trato que a los nacionales" estar sujeto a la proteccin
expresamente concedida y a las limitaciones concretamente previstas en la presente
Convencin.
3. A los efectos de la presente Convencin, se entender por:
a) "artista intrprete o ejecutante", todo actor, cantante, msico, bailarn u otra
persona que represente un papel, cante, recite, declame, interprete o ejecute en cualquier
forma una obra literaria o artstica;
b)"fonograma", toda fijacin exclusivamente sonora de los sonidos de una
ejecucin o de otros sonidos;
c) "productor de fonogramas", la persona natural o jurdica que fija por primera
vez los sonidos de una ejecucin u otros sonidos;
d) "publicacin", el hecho de poner a disposicin del pblico, en cantidad
suficiente, ejemplares de un fonograma;
e) "reproduccin", la realizacin de uno o ms ejemplares de una fijacin;
f)"emisin", la difusin inalmbrica de sonidos o de imgenes y sonidos para su
recepcin por el pblico;
g) "retransmisin", la emisin simultnea por un organismo de radiodifusin de
una emisin de otro organismo de radiodifusin.
4. Cada uno de los Estados Contratantes otorgar a los artistas intrpretes o
ejecutantes el mismo trato que a sus nacionales siempre que se produzca una de las
siguientes condiciones:
a) que la ejecucin se realice en otro Estado Contratante;
b) que se haya fijado la ejecucin o interpretacin sobre un fonograma
protegido envirtud del artculo 5;
c) que la ejecucin o interpretacin no fijada en un fonograma sea
radiodifundida en unaemisin protegida en virtud del artculo 6.
5. 1. Cada uno de los Estados Contratantes conceder el mismo trato que a los
nacionales a los productores de fonogramas siempre que se produzca cualquiera de las
condiciones siguientes:
a) que el productor del fonograma sea nacional de otro Estado Contratante
(criterio de la nacionalidad);
b) que la primera fijacin sonora se hubiere efectuado en otro Estado
Contratante (criterio de la fijacin);
c) que el fonograma se hubiere publicado por primera vez en otro Estado
Contratante (criterio de la publicacin).
