the public officials and employees mentioned in no. 1 above in relation to their office

In case none of the accused is occupying the above positions, the original jurisdiction shall
be vested in the proper RTC or MTC, etc., as the case may be, pursuant to their respective

In case there is no specific allegation of facts showing that the offense was committed in
relation to the public office of the accused, the original jurisdiction shall also be vested in the
