SANDIGANBAYAN
I. Original Jurisdiction
A. Exclusive :

Violations of RA 3019, as amended, otherwise known as the Anti-Graft and Corrupt


Practices Act; RA 1379; and Chapter II, Sec. 2, Title VII, Book II of the RPC (Bribery),
where one of the accused are officials occupying the following positions in the government,
whether in a permanent, acting or interim capacity, at the time of the commission of offense:
a. Officials of the executive branch occupying the positions of regional director and higher,
otherwise classified as Grade 27 and higher, of the Compensation and Position Classification Act of 1989 (RA 6758), specifically including:
i. Provincial governors, vice-governors, members of the sangguniang panlalawigan and
provincial treasurers,a ssessors, engineers and other provincial department heads
ii. City mayors, vice-mayors, members of the sangguniang panlunsod, city treasurers,
assessors, engineers and other city department heads
iii. Officials of the diplomatic service occupying the position of consul and higher
iv. Philippine army and air force colonels, naval captains, and all officers of higher rank
v. Officers of the PNP while occupying the position of provincial cirector and those
holding the rank of senior superintendent or higher
vi. Presidents, directors or trustees, or managers of government-owned or controlled
corporations, state universities or educational institutions or foundations
b. Members of Congress and officials thereof classified as Gr. 27 and up under RA 6758
c. Members of the Judiciary without prejudice to the provisions of the Constitution
d. Chairmen and Members of Constitutional Commissions, without prejudice to the
provisions of the Constitution
e. All other national and local officials classified as Grade 27 and higher under RA 6758

Other offenses or felonies whether simple or complexed with other crimes committed by
the public officials and employees mentioned in no. 1 above in relation to their office

Civil and criminal cases filed pursuant to and in connection with Executive Order Nos. 1,
2, 14, 14-A (Sequestration Cases) - RA 7975, Sec. 2 as amended by RA 8249
In case none of the accused is occupying the above positions, the original jurisdiction shall
be vested in the proper RTC or MTC, etc., as the case may be, pursuant to their respective
jurisdiction as provided in BP 129, as amended - RA 7975, Sec. 2 as amended by RA 8249
In case there is no specific allegation of facts showing that the offense was committed in
relation to the public office of the accused, the original jurisdiction shall also be vested in the
proper RTC or MTC, etc., as the case may be - Lacson v. Executive Secretary, GR No.
128096, January 20, 1999

Violation of RA 9160 (Anti-Money Laundering Act of 2001) as amended by RA 9194,


when committed by public officers and private persons who are in conspiracy with such public
officers
