Tasks
Working in a pair of opposing groups, select one (1) of the following well-known major
construction failure in Malaysia:
1. Highland tower apartment building collapse in Taman Hillview, Ulu Klang, Selangor on
11th December 1993.
2. Rock fall at Majestic height.
3. Landslide at Puncak Athenaeum Condominiums, Bukit Antarabangsa, Hulu Kelang,
Selangor on 15th May 1999.
4. Landslide at Taman Bukit Mewah, Bukit Antarabangsa, Hulu Kelang, Selangor on 6th
December 2008.
5. Collapse of the roof of Sultan Mizan Zainal Abidin Stadium in Kuala Terengganu
Terengganu on 2nd June 2009.
Imagining your group representing either the plaintiffs or the defendants & the other group
representing the opposing party, prepare & submit an expert-opinion report on the project
covering all of the following issues:
1. Statement of case
(i) Project background Type of development, location, commencement-completion
date, etc.
(ii) Project stakeholders Land & property owner(s), developer, consultants,
contractors, etc.
(iii) Statement of dispute Claims, counter-claims, lawsuit, plaintiffs, defendants, etc.
(iv) Legal stand Pro-plaintiffs or pro-defendants.
Investigative program
(i) Gathering of eyewitness accounts, evidential sampling & exhibits, and intuitive photo
shoots.
(ii) Collection of existing technical plans & documents, contractual document,
meteorological records, soil investigation & material testing results, construction work
records, etc.
(iii) Performance of collaborative field & laboratory testing.
Evaluation of evidential findings
(i) Design aspect For compliance to standard codes & guidelines.
(ii) Construction aspect For compliance to standard work practice & specifications.
(iii) Environment aspect For detecting peculiar environmental conditions beyond
reasonable expectation.
(iv) Economical, social and/or cultural aspect For ascertaining influence of nontechnical factors.
Synthesis/Reconstruction of scenario leading to failure At least conceive 2 hypothetical
sequences of event that led to failure.

(i) Persuasive arguments on the most likely failure scenario.

Additional Instructions
1. Form a group of not more than 5 student members. A pair of opposing groups needs
to be identified, and assigned to the imagined plaintiffs & defendants respectively
before a project title can be reserved.
The project should be taken up with strict observance to the following milestones as
highlighted in the opening lecture early in the semester:
(i) Milestone 1: Commencement of the group project.
(ii) Milestone 2: Instructors approval of the selected case for the group project.
(iii) Milestone 3: Submission of the group project.
Proper time management is of the essence.
Each group shall endeavor to obtain as genuine & realistic of information as possible for the
bulk of the report content. Where informational assumptions or fabrications were
intentionally made due to the lack of resources, such issues should be made known to the
instructor for approval, and be kept to the minimal & believable.
Report shall be submitted in hardcopy & softcopy forms. For the hardcopy, printing criteria
shall be as follows: paper size A4, font size 12, font type Arial, paragraph spacing single &
paragraph alignment justified. All appended plans bigger than A4 size shall be folded to that
size in accordance to prevailing industrial practice. For the softcopy, apart from the report
document, all associative information that have been obtained in hardcopy form & used in
the report shall be scanned & filed in high resolution picture file format e.g. jpg, bmp, etc. All
CAD & multimedia information used should also be included in their original editable form.
Failure to submit the softcopy shall be penalized with 20% mark deduction.

Tasks
Continuing from the preparation of the expert-opinion report, a mock legal proceeding in
English shall be organized to provide platform for both opposing teams to present & argue
their sides of the case, and be judged solely on the merits of their arguments to arrive at an
incontrovertible verdict. Each proceeding shall consist of the following members:
1. Panel of judges Represented by instructor(s).
2. Plaintiffs legal team Represented by a team in the pair of opposing groups.
3. Defendants legal team Represented by the other team in the pair of opposing
groups.
The panel of judges shall preside and arbitrate on contending issues raised over the course
of the proceeding. They shall not interfere & interrupt with the on-going case presentation
unless categorically requested by the lawyers. Consequently, their final judgment shall only
be based on the merits of the presented evidences.
Each member of individual legal team shall be assigned different roles and responsibilities
in the on-going proceeding:
1. Lawyer This role shall be undertaken by a team member. Its responsibilities include
giving opening (case introduction) & closing (case conclusion) addresses, conducting
examinations & cross-examinations of expert witnesses from both sides of the case
and raising objections to opposing statements that are meant to present scenario
which is unfairly biased to the side it represented. A lawyer is expected to pose at least
2 questions to each of its own expert witnesses and at least 1 question to each of the
opposing expert witnesses.
2. Expert witnesses These roles shall be undertaken by the remaining 4 team member.
Their responsibilities include answering questions posed by lawyers from both sides of
the case based on the pre-assigned area of expertise: design, construction,
environment, and economical, cultural & social aspects. No single expert witness on
the same side shall present overlapping areas of expertise. No two expert witnesses in
the opposing side having similar area of expertise shall present non-contending views.
In giving testimonies, the answer should be concise and convincing right to the kind of
question posed supported by evidential exhibits if requested so by the lawyer. Each
expert witness is expected to uphold its professional work ethics at all times, and
provides arguments that are based on pre-established facts & figures, and not be
manipulative, presumptuous, accusative or non-conjectural, regardless of its personal
leaning.
The proceeding shall commence with the reading of the case by the judges. This shall be
followed by opening address from the defendants lawyer, and then that of the plaintiffs.
Next, each expert witness on the defendant side shall be called to testify in turn, and be
subjected to alternate questioning first by the defendants lawyers, followed that of the
plaintiffs. After that, similar treatment shall be meted to the expert witnesses from the
plaintiff side with their lawyer now having the precedent in alternate questioning process.
Finally, the defendants lawyer shall give the closing address, followed by that of the
plaintiffs. The judges shall give their comments on the case & verdict shortly after. The
entire process should not take longer than 1 hours.

The presentation assessment shall be based on individual efforts throughout the


proceeding based on the following criteria:
1. Personal demeanors Attire, attendance, punctuality, in-group interaction &
cooperation, etc.
2. Preparedness Line of questionings, collection of evidences or exhibits, etc.
3. Performance of task Role-playing, commanding presence, astute, convincing, etc.
4. Communication skills Command of language, articulate, persuasive, etc.
All proceeding could be videotaped for use as future learning aids. As such, correct and
proper conduct throughout the running of the proceeding is warranted.
