Do not sign this form unless you are sure that any information you have given is
correct and you are prepared to agree to the conditions set out below. If you are
under 18 years old, you MUST have this form signed on your behalf by either your
parent or legal guardian.
1. You are over 16 years old as on February 1, 2007 and are required to produce copies of your birth certificate, passport, or such
other applicable and acceptable documentation, as we may reasonably request, confirming your identity and age.
2. You are required to have a valid passport and visa to enable you travel to and gain entry into India if selected for Theatre Round.
3. You have read and agree to abide by the rules, regulations, terms and conditions (the “Rules”) of “Indian Idol” which expression
shall include any interview, auditioning process, competition and event relating thereto (the “Programme”) as devised from time
to time by Miditech Private Limited/SET Asia (the “Producer”) as well as SET India Private Limited ( “SET”) and shall accept the
decision of the Producer as final and you hereby acknowledge that the interests of the Programme shall override those of any
applicant.
4. You have not and will not enter into any commercial or other sponsorship agreement (such as a management contract, recording
contract and/or merchandising contract) or arrangement with any person, firm or company in respect of your appearance in the
Programme.
5. You do not have any criminal record nor be an undischarged insolvent or of an unsound mind.
6. For the purposes of your appearance in the Programme, you may wear any apparel of your own choosing provided always the
Producer fully reserves all rights to disallow any apparel which the Producer deems in its absolute sole discretion to be obscene,
vulgar, lewd, defamatory, libellous, infringing or prominently bears any commercial/company logos, marks, brands, or the
name/likeness/image of a celebrity.
7. You shall not bring any weapons, alcohol or non-prescription controlled substances for any part of the Competition and you agree
irrevocably to allow SET, Producers and any of their agents to conduct a discreet inspection of your person and belongings to
ensure strict compliance of this condition.
8. You hereby agree that you have truthfully and accurately completed this application form and that the answers and information
you have supplied here is in no way misleading. You furthermore acknowledge that SET and/or the Producer reserves the right
exercisable at any time at its sole discretion to disqualify you from the competition or auditioning process should you at any stage
perform or behave in an inappropriate or obscene manner, supply untruthful, inaccurate or misleading personal details and
information, break the Rules or otherwise be in breach of the terms contained herein.
9. With full title guarantee you hereby irrevocably assign to the Producer (including present assignment of future copyright) the
entire copyright and all other rights of whatsoever nature in and to your contribution to the Programme such that the Producer
shall be entitled to use and exploit and license others to use and exploit such contribution by all means and in all media and
formats whether now known or hereafter invented throughout the Universe for the full period of copyright including any extensions
and renewals thereto and thereafter insofar as is possible in perpetuity and you furthermore irrevocably grant all consents and
waivers as required by statute to enable the Producer to make fullest use of the Programme without restriction. Furthermore you
hereby waive irrevocably in respect of your contribution any and all “moral rights” which you may have now or in the future
including but without limitation any of your rights under laws of any jurisdiction and acknowledge the Producer’s right to use your
name, likeness, voice, biographical details, photographs and recordings in advertising and publicity material.
10. Without limiting the foregoing in any way, you agree that the Producer shall be entitled to:
(a) alter, adapt or make additions to or deletions from the Programme (and your appearance thereon) at its discretion;
(b) make and exploit and to authorise the making and exploitation of any recording or fixation of your appearance
separately from or in conjunction with the Programme throughout the Universe in perpetuity in all media whether now
known or hereafter invented;
(c) dub your voice in any language; and
(d) include your name, likeness, voice, biographical details, photographs of you and recordings of interviews with you
separately from or in conjunction with the Programme in all media and formats throughout the Universe including but
not by way of limitation in advertising, publicity and exploitation material.
11. You shall not publicise or discuss with any third party without prior written consent from the Producer any information relating to
the Programme, your appearance, any of the production team or any participants in the programme nor any other information
which may come to your attention relating to the broadcaster or the Producer or otherwise connected to the Programme save for
such information which is already public knowledge. You shall further agree to keep the competition rules and the contents of
any documents in relation to the Programme strictly confidential. Should you be contacted by a member of the Press you agree to
refer them to the Producer’s publicity officer.
12. You hereby expressly acknowledge that no fees, royalties, residuals or other consideration will be payable to you in respect of
any broadcast, subsequent rebroadcast or retransmission or any other use by SET and/or the Producer (or any assignees or
licensees) of the Programme or any part thereof in any manner or media now known or hereafter invented.
13. By your participation, you agree to be bound by these rules and the decisions of the Producer, the voting audience, and the panel
of Judges, which shall be final and binding. Your presence at the audition / screening , and the presence of your friends, family
members and anyone else accompanying you, constitutes your and their consent and agreement to the recording and use of your
and their performance, appearance, name, voice, singing voice, likeness and any musical or sound effects produced by you
and/or your family members, friends for use in connection with any television program, motion picture or the Internet for all
purposes (including advertising, marketing, promotion, merchandising and the exploitation of any and all ancillary and subsidiary
rights), as the same may be edited, in all media, throughout the universe, in perpetuity for no compensation, unless otherwise
required by law. You further represent to SET, the Producers, their affiliated, related and/or associated corporations that you/your
friends/family members agree that SET and/or the Producers shall not be liable to you or your legal representative or them for

any loss or damage or injury to you, them, your property and their property caused by or suffered during or in connection with
your taking part in the Programme, including without limitation, as a result of personal injury, invasion of privacy, libel, defamation
or infringement of copyright, unless caused by the gross negligence of the Producer and recoverable on that ground following
judgement of a competent court of final judgement.
14. You are aware that the dates and locations of the Programme / auditions are subjected to change. You agree that the Producer,
SET and/or the production personnel for the Programme, participating television stations, advertising agencies or any person or
entity connected with the production, administration or judging of the audition or the program, or any of their respective parent
companies, affiliates, subsidiaries, agents or representatives are not responsible for and shall not be liable for: (i) any failure or
transpiration, bad directions, or inability for any reason to appear at an audition site or audition or appear before the judging
panels; (ii) any costs, expenses, injuries, losses or damages of any kind caused by travelling to or from the audition venues,
being present at the audition venues, participating in the auditioning process or being selected to or disqualified from continuing
in the auditioning process and/or the show; or (iii) any printing, typographical or technological errors in any materials associated
with the Programme.
15. You acknowledge that SET and/or the Producer in no way warrants, represents, guarantee or promise any rewards or prizes
other than those specifically stated to the Programme and the Producers and/or SET shall not be liable to you in the unlikely
event that the prize providers do not make good on the prizes promised by them.
16. You further represent that you are not an employee of, or live with an employee of, or are a parent, sibling or child of an employee
of, the following :
“SET, the Producer; the judges; the host(s); production team; any prize providers and any person or entity connected
with the production, administration or judging of the auditions or the Programme, including any potential affiliated
auditions or competitions held by radio stations; and the parent companies, affiliates, subsidiaries, agents or
representatives of any of the above entities”.
17. You agree that the Producer may assign your services and all other rights in your contribution to and participation in the
Programme to any of our holding, subsidiary, affiliated, related and/or associated corporations / companies or successors in title
and to any other third party at any time.
18. In the matter of interpretation of any rules and conditions of the Programme, the decision of the Producers and/or SET shall be
final and binding on you.
19. Any dispute shall be subject to the exclusive jurisdiction of the Courts in Mumbai, India.
20. You agree to the terms conditions set out above and that all the information given by you in this form may be used in the
Programme at the Producer’s sole discretion.
21. Miditech/SET Asia may make any changes or alterations to the competition without your prior consent.

TERMS AND CONDITIONS

1. I am over 16 (sixteen) years old as on February 1, 2007, a British Citizen and will produce upon request copies of
my birth certificate, passport, or such other applicable and acceptable documentation, confirming my identity and
age.

2. I understand and acknowledge that the principal nature and purpose of the Programme (which expression shall
include without limitation, the series of programmes entitled “Indian Idol”, any spin-off programme based thereon
and any recording, interview, audition, competition, event or activity relating thereto or any related
online/interactive activity) is the search for and selection of a recording artist and that by signing this agreement I
consent and agree to the recording and use of my contribution to the Programme on the terms hereafter contained.

Accordingly, I agree to make myself available to participate in the Programme at the times and locations
requested by the Producer and I will abide by the Competition Rules attached hereto and all other rules,
regulations, fire and safety regulations and security arrangements, terms and conditions relating to the Programme
as may be imposed or devised from time to time by the Producer (“the Rules”). I will further accept the decision
of the Producer on each and every aspect of the Programme as final and I hereby acknowledge that the interests of
the Programme shall override those of any auditionee or contributor.

3. I agree to inform the Producer promptly of any criminal proceedings or convictions of any kind subsisting at the
date of this agreement and shall notify the Producer immediately if there are any criminal charges brought against
me from the date hereof up to and including the date of first transmission of my final appearance on the
Programme.

4. I have not and will not enter into any commercial, contractual, sponsorship or other agreement (including but not
limited to recording or performing contracts) or arrangement with any person, firm or company (such as a contract
with a management company or an individual to act as my manager) in respect of my appearance in the
Programme.

5. I have not previously and will not from the date of this agreement until 3 (three) months from the first
transmission of the last episode of the Programme, enter into any commercial, contractual, sponsorship or other
agreement (including but not limited to recording or performing contracts) or arrangement with any person, firm
or company (such as a contract with a management company or an individual to act as my manager) other than
the Producer (or any associated company) in respect of my musical and/or performing abilities or the products
thereof or in respect of my name, likeness, image or biography. Should I have entered into such agreement or
arrangement prior to the date hereof, I hereby undertake to notify the Producer immediately and the Producer shall
be entitled to take such other action as it considers (in its absolute discretion) to be appropriate including without
limitation by disqualifying me from the competition comprised within the Programme (“Competition”).

6. I undertake to inform the Producer of any television or radio programme or recording (other than the Programme)
in which I have previously appeared or participated as an artist. I further undertake that I will not, from the date of
this agreement until the later of 6 (six) months from the date I cease to participate in the Programme or 3 (three)
months from the date of first transmission of the last episode of the Programme, appear or participate in any
television or radio programme similar to the Programme (i.e. consisting of or containing a talent contest relating
to my musical/performing abilities).

7. I agree and understand it is a condition of my participation in the Programme that should I be selected at a later
stage of the Competition to compete as one of the final 10 contestants, I am required to enter into (a) an agreement
with Sony BMG Music Entertainment (India) Pvt. Ltd. for my exclusive services as a recording artist; (b) an
exclusive management agreement for the management of my career as an artist including without limitation to
allow the use of my name likeness and biography in connection with advertisement, endorsement, merchandising
and sponsorship and; (c) a so-called "ambassador agreement" with SET India Private Limited (“SET”) SUBJECT
ALWAYS TO final agreement in this respect between the Producer and SET and which the Producer is not
obliged to provide subject always to the Producer finding a suitable candidate management company in India to
manage the winner of the Competition but which the Producer is not obligated to provide. I agree that these
agreements will only become fully effective for the individual selected as the winner of the Competition. I
understand that the record company and the management company (if any) will make a reasonable contribution to
the cost of independent legal representation in order to advise me in relation to entering into these agreements. I
hereby further warrant that as of the date of this agreement I have entered into no contract or arrangement which
might prevent me from entering into the agreement specified in sub-paragraphs (a), (b) and (c) of this Clause 7.

8. I acknowledge and agree that, should I win the Competition and subject to my availability at the time of the
Producer’s request, I shall participate in a ‘World Idol’ or a Regional equivalent programme where winners of the
Programme from every country in which the Programme has been recorded shall compete against each other. The
format of such programme shall be at the discretion of the Producer. I further acknowledge and agree, regardless
of whether I win the Competition but subject to my availability as above, to participate in any and all of the
Producer’s spin-off programme(s), including without limitation any recording, interview, audition, competition or,
event or activity relating to such spin-off programme, provided that the Producer shall notify me of such
programme or activity either within twelve (12) months of the date of first transmission of the last episode of the
Programme or thirteen (13) months from the date of acceptance by SET of the last episode of the Programme
(whichever is earlier).

9. I acknowledge and agree that, should I win the Competition, the Producer (or any associated company) shall be
entitled to produce (or license any third party to produce) and SET and/or its affiliates shall be entitled to
broadcast, whether as a stand-alone programme or as part of another programme any or all of the following career
milestones which may occur during or subsequent to the recording of the Programme: (a) the first performance of
my first recorded single and or album; (b) the first showing of the video featuring my first recorded single and or
album and/or me as a performer; and (c) my first televised interview and/or appearance on a talk show.

10. I hereby acknowledge that the Producer is not under any obligation to record my contribution to the Programme
or include me in the broadcast version thereof.

11. I hereby warrant that I have truthfully and accurately completed the application form relating to the Programme,
that I have not withheld any information requested of me and that by signing this agreement and supplying the
answers and information supplied by me on the application form, I have in no way been misleading or untruthful.
Furthermore, I acknowledge that the Producer reserves the right exercisable at any time at its sole discretion to
disqualify me from the Competition should I at any stage omit to supply any information reasonably requested of
me, supply untruthful, inaccurate or misleading personal details or information, break the Rules or otherwise be in
breach of the terms contained herein.

12. I acknowledge that my contribution to the Programme is not a professional performance and does not entitle me to
wages, salary or other compensation.

13. With full title guarantee I hereby assign irrevocably to the Producer (including present assignment of future
copyright) the entire copyright and all other rights of whatsoever nature in and to my contribution to the
Programme such that the Producer shall be entitled to use and exploit and license others to use and exploit such
contribution by all means and in all media and formats whether now known or hereafter invented throughout the
Universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is
possible in perpetuity. Furthermore I grant irrevocably all consents and waivers as required pursuant to the
Copyright Act 1957 and any amendment or re-enactment thereof (“the Copyright Law”) and under all similar
laws in any part of the world that may create rights in my appearance on the Programme to enable the Producer to
make fullest use of the Programme without restriction. I also specifically waive my rights under the Copyright Act
1957 with respect to control over distribution and broadcast of my performance.

14. I hereby waive irrevocably in respect of my contribution to the Programme any and all “moral rights” which I
may have now or in the future including but without limitation any of my rights under the Copyright Law or any
similar laws of any jurisdiction and acknowledge the Producer’s right to use my name, likeness and voice and any
biographical details, photographs and recordings of me separately from or in conjunction with the Programme or
the sponsorship thereof in all media and formats throughout the Universe including but not by way of limitation
on Programme – related websites or other online media and in advertising, publicity, sponsorship and exploitation
material.

15. The Producer shall not be liable to me or my legal representative for any loss or damage or injury to my person or
property caused by or suffered during or in connection with my taking part in the Programme unless caused by the
negligence of the Producer and recoverable on that ground following judgment of a competent court of final
judgment.

16. I undertake to inform the Producer immediately if any of the information I give becomes incorrect due to any
change of circumstances between the date hereof and the date of first transmission of the last Programme
incorporating my contribution.

17. I undertake to inform the Producer immediately if I or any member of my immediate family is employed by:
a) the Producer;
b) the prize providers of the agreements referred to in Clause 7;
c) SET; and
d) any person, or entity otherwise connected involved or participating in the Programme and its administration,
production or judging of the Programme including but not limited to any of the judges, host(s), production
team, any potential affiliated auditions or competitions held by radio stations.
18. I hereby warrant I will not in any media throughout the Universe (including without limitation on any website or
other online media) make any statement about nor actively publicise nor discuss with any third party without prior
written consent from the Producer any information relating to the Programme, my appearance in the Programme

or any of the production team or any participants in the Programme or any other information which may come to
my attention relating to the broadcaster or the Producer or the prize providers or otherwise connected to the
Programme save for such information which is already public knowledge. Should I be contacted by a member of
the Press I agree to refer them to the Producer’s publicity officer. I hereby further agree that for the period from
the date of this agreement to the date I cease finally to participate in the Programme I shall not use, publicise or
exploit my name, likeness, image, biography or musical or performing abilities in any media throughout the
Universe including without limitation on any website or online media (other than by way of my contribution to
the Programme as authorised by the Producer).

19. I agree that my contribution to the Programme shall not contain anything which is an infringement of copyright or
which is calculated to bring the Producer into disrepute or breach of contract or duty of confidence or which is
defamatory or in contempt of court or be calculated to bring any broadcaster into disrepute provided however that
the Producer shall not be entitled to bring any claim against me in any respect of defamatory material that was
included within my contribution without negligence or malice on my part.

20. The Producer may freely assign my services and all other rights in my contribution to and participation in the
Programme to any third party.

21. If any Clause or part of this Agreement shall for any reason be properly adjudged by any court or other legal and/
or competent authority to be invalid, illegal or unenforceable in any respect the legality and enforceability of the
remaining provisions contained herein shall not in any way be affected or impaired. The terms of this Agreement
shall not affect the rights granted to the Producer pursuant to any previous agreement between the parties relating
to the Programme nor entitlement of either party to make or enforce any claim arising thereunder.

22. This Agreement shall be governed by and in all respects construed in accordance with the laws of India whose
courts the parties agree to submit to the exclusive jurisdiction of the Courts in Mumbai, India in relation thereto.

RULES AND PROCEDURES GOVERNING THE COMPETITION
(THE “COMPETITION RULES”)

1. Definitions

“Competition” The competition comprised within the Programme including


without limitation the UK Auditions and each round leading up
to and including the selection of the winning Indian Idol.

“Contestant(s)” Any person who enters the Competition.

“Contributors” Any person, other than the Contestant(s), who participates,


attends and/or is present at any of the UK Auditions,
Competition, Theatre Audition Shows, the Piano Shows, the
Spectaculars and/or the Final.

“Designated Week(s)” Any of the weeks designated for the Piano Shows.

“Judges” [Anu Malik], [Alisha Chinoy] and [Udit Narayan] and such
other person(s) as the Producer may nominate from time to
time.

“Producer” Miditech Private Limited/ SET Asia

“Programme” As defined in the Release Form.

“UK Auditions” The initial auditions taking place at the NEC Birmingham on
the 30th March 2007, 31st March 2007 and 1st April 2007 or
such other place and/or location as may be designated by the
Producer.

“Release Form(s)” Any release form supplied from time to time by the Producer
and which Contestants are required to sign in connection with
the Programme.

“Spectaculars” Any of the weeks during which the Spectaculars will run.

“The Final 100 - 120” The approximate number of Contestants to be invited to


participate in the Theatre Audition Round.

“The Final 24” The number of Contestants to be invited to participate in the


Piano Shows.

The Final 10” The number of Contestants selected to participate in the
Spectaculars.

“The Finalist(s)” The two Contestants selected to participate in the Final.

“The Piano Shows” Any of the weeks as may be designated by the Producer as the
Piano Shows.
“The Wildcard Show” A Piano Show designated by the Producer as the wildcard
show comprising of any 6 Contestants as may be selected by
the judges.
“The Winner” The Contestant who wins the Final.

“Theatre Audition Round” The round following the UK Auditions, to take place in
[Mumbai] or such other place and/or location as may be
designated by the Producer.

2. Entry Procedures to the Competition

2.1 The procedures for entry and participation in the Competition are subject to the Competition Rules and
the terms and conditions of the Contestant Release Forms
2.2 The Contestants may register to participate in the UK Auditions of the Competition by completing an
application form available at the audition venues and website www.setasia.tv
2.3 The Competition is open to individuals aged between 16 and 30 on February 1, 2007 who are British
Citizens. Contestants aged 18 or under must ensure their application and any Release Form, is reviewed,
approved and signed by a parent or legal guardian.
2.4 Applications must be submitted to the Producer on the date of the UK Auditions. Unsigned applications
and late entries will not be considered for the UK Auditions. The closing date is the 20th of March 2007.
2.5 Contestants will be invited to attend at a location and time specified by the Producer.
2.6 The Producer may, at its sole discretion, choose to hold an open audition following the UK Auditions.
2.7 Notwithstanding the aforesaid, the following category of persons are not eligible to enter, take part nor
participate in the Competition: (a) full-time employee(s) of the Producer, Fremantle Media and
immediate family members of such employee(s) as may be determined by the Producer in its sole and
absolute discretion; and (b) the employee(s) of any company that are part of the production of the
Competition, including the prize providers.

3. UK Auditions

3.1 The Contestants will be invited to perform whole or part of a song in any language following which they
will be told whether they have been called back to perform in front of the Judges for next round.
Contestants should have at least two songs prepared and will be asked to sing a cappella (without music).
No musical accompaniment (whether recorded or live) will be permitted.
3.2 The Producer will notify the Contestants who have been chosen to go through to the Theatre Audition
Round of the Competition as soon as reasonably practicable after the UK Auditions. The Producer shall
not be obliged to notify unsuccessful Contestants of its decision.
3.3 All Auditions will be subject to such timing stipulations and requirements as may be determined by the
Producer and the Producer makes no representations, warranties nor provides any undertaking to any of
the Contestants that any or all of the Contestants will be able to perform or audition (whether before the
Judges or otherwise) at the time and/or place in accordance with the invitation set out in Clause 2.5
above. The Producer shall not be liable or responsible for any damages, losses, costs, expenses or
otherwise suffered by any of the Contestants in the event that the Producer is not able to permit the
Contestants to perform or audition in accordance with any of the foregoing provisions.
3.4 Notwithstanding any other provisions in this Agreement, the Producer may, at its sole and absolute
discretion, hold additional Auditions on such other dates and at such places as it may determine and the
Contestant shall adhere to and abide by any and all instructions, requirements and timing stipulations as
determined by the Producer and shall attend at any and all such additional Auditions.
3.5 The UK Final Audition
30 people will be invited to London for the final selection audition, for 2 UK Contestants to gain entry to
the Theatre Audition Round in Mumbai. The 2 successful Contestants will be required to attend further
shows in Mumbai.

4. The Theatre Audition Round

4.1 The Final 100 - 120 will be invited to participate in the next round of the Competition to be held in
[Mumbai] between [April 10 to April 15th , 2007 ]
4.2 The Contestants will be invited to perform a pre-selected song in Hindi chosen at the Producer’s
discretion and may be required to perform either individually or in a group. The make-up of each group
shall be in the Producer’s discretion. The Producer may also ask the Contestants to perform individually
the whole or part of a song in Hindi of the Contestant’s own choice.
4.3 As soon as reasonably practicable following completion of the Theatre Audition Round, the Contestants
will be notified who has been selected by the Judges to be one of the Final 24 going through to the Piano
Shows of the Competition.

5. The Piano Shows

5.1 The Final 24 will be divided at the Producer’s discretion into 2 (two) groups of 12 (twelve) Contestants.
It is anticipated that each group for the purposes of training and recording the programme “Live” will be
required to participate for one of the following Designated Weeks during [2007] between [28th May to
30th June 2007]. (“The Designated Week”)

5.2 The Judges shall at their sole and absolute discretion select any 6 Contestants (the “Wildcard
Contestant”) who have participated in the Piano Shows to perform at the Wildcard Show and it is
anticipated that the Wildcard Contestant will be required to participate in the Spectacular round.
5.3 At the end of each Designated Week the relevant Contestants will be required to perform in a programme
recorded as "Live". Following the broadcast of each recorded programme, a total of 12 (twelve)
Contestants from the Piano Shows (comprising 10 (ten) from each Designated Week and 2 (two) from
the Wildcard Show). In the wild card show one contestant will be selected by public vote and one will be
selected by judge’s consensus to go through to the Spectaculars.

6. The Spectaculars

6.1 The Final 12 will go through to the Spectaculars. It is anticipated that the Spectaculars will run over the
course of [Eleven (11)] weeks from [1st July to 15th September 2007].
6.2 Each Spectacular will culminate in the recording of a “Live” recorded programme, following which one
Contestant (per Spectacular each week) will be eliminated by public vote until only 2 (two) Contestants –
the Finalists – remain in the Competition.
6.3 At the end of the last Spectacular, the Producer will notify each Finalist of the song they will be required
to perform in the Final. The Finalists may be required to keep the choice of song confidential.

7. The Finals

7.1 It is anticipated that recording of the Finals will take place on or about [ 29th September 2007]. The
selection of the winning Indian Idol will be made by public vote following a “Live” recorded
performance.

8. General Rules of the Competition

8.1 The Producer reserves the right to change the structure of the Competition as it sees fit including without
limitation by adding auditions / rounds to the Competition or requesting additional performances from
the Contestants and / or changing the anticipated recording schedule.
8.2 It is a condition of entry and participation in the Competition that Contestants make themselves available
to participate in the Competition, agree and sign up to the Release Form and abide by terms and
conditions of such Release Form and the rules, regulations, terms and conditions as devised from time to
time by the Producer including but not by way of limitation the Competition Rules. As part of
Contestants’ contribution to the Programme, the Producer may request Contestants to participate in any
online/interactive activity relating to the Programme including without limitation recordings of web-

casts, interviews and participation in so-called ‘chat-rooms’. It is a further condition of entry and
participation in the Competition that Contestants ensure and procure from any and all Contributors their
agreement and execution of the release form as devised from time to time by the Producer.
8.3 It is a condition of entry and participation in the Competition that the Contestant has not entered into any
contractual, commercial, sponsorship agreement (including but not limited to recording, performing
and/or merchandising contracts) or other arrangement for example with a management company or an
individual to act as the Contestant’s manager in respect of his/her musical or performing abilities or the
products thereof or in respect of his/her name, likeness, image or biography which might be in breach of
the Release Form or the Competition Rules or otherwise prevent the Contestant from participating in the
Programme or the broadcast, promotion, exploitation or sponsorship thereof. Each Contestant is also
required to refrain from wearing any clothing items bearing designer or sports logos or bearing the name
or likeness of a celebrity, living or dead, during any part of the Competition.
8.4 Should any Contestant be selected to participate in the Spectaculars, it is a condition of participation in
the Spectaculars that with the benefit of independent legal advice, the Contestant enters into Prize
Agreement(s), including a recording agreement, a prize agreement provided by SET India Pvt. Ltd
(“SET”) or any such other Agreements with such other parties as may be applicable and/or designated by
the Producer as well as the Release Form for the Final 10. Should the Contestant for any reason fail to
enter into these Agreements (or any of them) prior to commencement of recording of the Spectaculars,
the Producer reserves the right to disqualify the Contestant from the Competition. The Agreement(s) will
only become fully effective for the Winner only. The Contestants acknowledges that while the
commercial benefits under this Competition Rules may be available to the Winner only, the restrictions
contained in these Competition Rules and in the Contributors Release Forms shall apply to the
Contestants also.
8.5 The Contestants must not at any stage of the Competition discuss with or take advice from any or all of
the Judges on any matters relating to their participation in the Programme including, without limitation,
their performance, appearance or choice of song.
8.6 The Producer’s and Judges’ decision (or, where appropriate, the decision of the voting public, as
recorded by the voting service provider) is final and the Contestants acknowledge that the interests of the
Programme shall override those of any Contestant and/ or contributor.
8.7 The Producer reserves the right to ask the Contestant to perform a specified song or song from a
specified genre of its own choice. At all times during the Competition the Producer reserves the right of
veto over the choice of song, even where Contestants are permitted to select the song they wish to
perform and all songs selected by any Contestant shall be subject to the prior approval of the Producer.
8.8 The Producer has the right at any time to require proof of identity and/or eligibility. Failure to provide
such proof within a reasonable time could result in disqualification from the Competition. All personal
details and information requested by and supplied to the Producer by each Contestant must be truthful,
accurate and in no way misleading. The Producer reserves the right to disqualify any Contestant from
the Competition or auditioning process in its sole discretion, should the Contestant at any stage supply
untruthful, inaccurate or misleading personal details and/or information.
8.9 The Producer will have no liability to a Contestant who is unable to attend or take part in the
Competition for whatever reason and the Producer shall be entitled to disqualify, and at the discretion of
the Producer replace, any such Contestant from the Competition at any time thereof.
8.10 The Producer reserves the right to amend the Competition Rules or terminate the Competition at any
time without any liability to any Contestant. The Producer further reserves the right to replace at its
discretion any Contestant who for any reason fails or is disqualified from or unable to participate in the
Programme and / or Competition with another replacement Contestant, notwithstanding that such
replacement Contestant may have been previously eliminated from the Competition and each Contestant
shall agree to participate in the Programme and/or Competition as and when required by the Producer to
do so.
8.11 There is no obligation on the part of the Producer to record or broadcast any Programme in which a
Contestant has appeared or any part of his / her contribution to a Programme.
8.12 The Contestant must at all times behave appropriately when taking part in the Competition and observe
the Competition Rules and any other rules or regulations in force at the studios and / or locations. The
Producer reserves the right in its absolute discretion to remove from the Competition, studio premises or
location any Contestant who breaks such rules and / or fails to behave appropriately and to disqualify
such Contestant.
8.13 In the event that as a result of the public vote in any round, two (or more) Contestants are tied, the
Producer shall be entitled to determine in its absolute discretion which Contestant is eliminated and/or
which Contestant goes through to the next round (as appropriate) and for this purpose it shall be entitled

to make such arrangements or request such further performances from the Contestants as it in its absolute
discretion deems necessary.
8.14 In the event of any dispute concerning the operation of any element of the Competition or these
Competition Rules, the decision of the Producer will be final.
8.15 These rules are additional to and do not supersede any and all release forms signed by the Contestant and
in the event of any conflict between any Release Form and these Competition Rules, the Release Form
will prevail.
8.16 The Contestant shall undertake, warrant and guarantee to the Producer that the Contestant has the full
legal capacity to participate in the Competition in accordance with these Competition Rules.
8.17 None of the Contestant shall, without the prior written approval of the Producer, speak to the press or any
other media nor give any interviews or comments relating to the Competition. The Contestant shall not
disclose any information whatsoever relating to the Producer and/or SET to any other party.
8.18 The selection and number of Judges, and the manner in which the Competition is judged, at each stage of
the Competition shall be at the Producer’s sole and absolute discretion and the Judges’ and/or Producer’s
decision (including, where appropriate, the decision of the voting public) at all stages of the Competition
is final. No enquiries, appeals, verbal or written, shall be entertained. The Contestants shall accept and
abide by any and all decisions made by the Producer and/or the Judges (including, where appropriate, the
decision of the voting public) concerning, without limitation, the rules of the participation, these
Competition Rules and any and all other rules, procedures and regulations of the Competition, each and
every stage of the Competition and any other matters relating to the Competition including the
production thereof.
8.19 The Producer, SET, the Judges, the advertising agencies and any person or entity connected with the
production (including the format owners and the broadcasters of the Programmes), administration or
judging of the auditions, the Competition or the Programme (the “Relevant Parties”) shall be under no
liability whatsoever to the Contestants or the Contributors, in respect of any loss, damage suffered by the
Contestants or Contributors arising from or pursuant to the Competition or for any and all loss, damage,
cost, expense or injury to life or property sustained by the Contestants or Contributors at any stage of the
Competition and during production thereof whether or not caused by (1) the administration (including
scheduling) of the Competition including any failure of transportation or inability for any reason to
appear before the judging panels; (2) the Contestant’s or any third party’s participation in the auditioning
process, or being selected or disqualified; (3) as a result of the decisions of the Judges, Producers or
public voting; (4) as a result of any comment, remark, judgement, view, criticism, critique, opinion
and/or observation made and/or passed by any of the Judges and/or Producers; and/or (5) any printing,
typographical or technological errors in any materials associated with the Competition. Notwithstanding
the generality of the foregoing, the Relevant Parties expressly exclude liability for all direct, indirect and
consequential loss or damage, including but not limited to loss or damage to other equipment or property
or for loss of profit, business, revenue, goodwill or anticipated savings pursuant to the Competition. In no
event will the measure of damages include, nor will the Relevant Parties be liable for, any amounts for
indirect, incidental, consequential, or punitive damages of any party, including third parties; or for
damages attributable to the Contestants; or circumstances beyond the Relevant Parties including the
Producer’s reasonable control.
8.20 These Competition Rules and the Competition shall be governed by and construed in accordance with the
laws of India and UK the Contestants submit irrevocably to the jurisdiction of the Courts in Mumbai.
8.21 If any provision of these Competition Rules is held by any court or other competent authority to be void
or unenforceable in whole or part, the other provisions of these Competition Rules and the remainder of
the affected provisions shall continue to be valid.
8.22 No weapons, alcohol or illicit substances will be permitted at any premises or during any part of the
Competition.
8.23 Each Contestant will only be given one opportunity to audition for the competition.
8.24 The Producer agrees to provide transportation and accommodation for the 2 successful Contestants from
the UK plus one guest each, once they qualify to compete in Mumbai.
8.25 All Contestants must be able to converse and sing in the Hindi language.
