Fair Reflection of Presidential Preference

a.

Presidential Primary - Proportional Representation Plan (Rule 13.A, Rule 13.B

& Rule 13.D)
The Indiana presidential primary election is a binding primary.
Accordingly, delegate and alternate positions shall be allocated so as to
fairly reflect the expressed presidential (or uncommitted) preference of the
primary voters in each district. The National Convention delegates and
alternates selected at the district level shall be allocated in proportion to
the percentage of the primary vote won in that district by each preference,
except that preferences falling below a 15% threshold shall not be
awarded any delegates or alternates.

b.

Within a district, if no presidential preference reaches a 15% threshold, the

threshold shall be the percentage of the vote received in that district by the
front-runner minus 10%. (Rule 13.F)

c.

Delegates to the Indiana Democratic State Convention, June 18, 2016, will
gather in District caucuses held at the Indiana Convention Center in
Indianapolis, Indiana. (Rooms and times to be announced at the convention). No
person can participates in more than one delegate selection process. State
delegates will declare their presidential preference at the Congressional district
caucus meeting by signing a statement of support for a presidential candidate.
The state convention delegates will be given the appropriate ballot for the
selection of national delegates and candidates for alternates representing that
presidential candidate from that specific district. All candidates for district-level
delegate and alternates will be allowed to attend the congressional district

Indiana 2016 Delegate Selection Plan

by the County Chair in the county in which the state delegate is registered to
vote. Filing for state convention begins on January 6, 2016, in each county and
closes on Noon EST on February 5, 2016. A person becomes a candidate for
state convention delegate by completing the appropriate form with clerk of the
circuit court in the county of registration during this time period. Indiana state
law requires a candidate for delegate to the Democratic State Convention to be a
registered voter and have voted as a Democrat in the most recent primary
election in which the candidate has participated. This provision does not
disqualify candidates who have not previously voted in a primary election, but it
attempts to ensure that the state delegate candidates are Democrats by requiring
those Democratic candidates with no democratic voting history to get written
authorization from their county chair.
According to the Indiana Democratic Party rules and guidelines established by
Indiana state law, the delegates to the Indiana Democratic State Convention
shall be chosen from each county and apportioned by a vote of the Indiana
Democratic State Central Committee. The apportionment of delegates is from
the following formula: the average of the Democratic vote for Governor in 2012
and the Democratic vote for Secretary of State in 2014 divided by 400. The
State Chair must declare the number of delegates per county to the Election
Division of the Secretary of State by noon on November 30, 2015. A countys
delegation is further distributed between congressional districts when applicable
for the purposes of congressional district caucuses.
The Indiana State Party Chair will provide a Call to the State Convention to
the press and party officials thirty days prior to the convention, to all circuit
court clerks to be distributed to all candidates for state convention delegates and
to persons elected as state convention delegates after their election on May 3,
2016. The Call will include a special section of the delegate selection process
with the following:
1.) Announcement of the 2016 Democratic National Convention
2.) Number of delegates and alternates to be selected
3.) Apportionment of delegates
4.) Candidacy filing procedures
5.) Presidential preference of delegates and alternates
6.) Time and location of meetings
7.) Results (Official results of the district elections will be announced at
the state convention)
8.) Alternates and vacancies (All elected delegates to the State Convention who
cannot attend the convention must notify in writing their intentions to be
absent to the county chair from the county in which they reside. The
county chair will then certify and authorize the elected alternates.)
9.) Certification of state convention delegates
10.) Tie Votes (All tie votes for National Convention Delegate shall be
resolved by a coin toss)
8|Page

Indiana 2016 Delegate Selection Plan

One hour following the adjournment of the 2016 Indiana Democratic State
Convention on June 18, 2016, the 56 district-level delegates will meet at the
Indiana Convention Center, Indianapolis, Indiana. (Room to be posted and
announced at the Convention) for the purpose of selecting the remainder of the
delegation.
8.

Equal Division of District-Level Delegates and Alternates

a.

In order to ensure the district-level delegates are equally divided between men
and women, delegate positions within each district will be designated by
presidential preference beginning with the highest vote-getting presidential
preference. This assignment of delegate positions, alternating by sex as
mathematically practicable, will continue with the next highest vote-getting
preferences in descending order until the gender of each position has been
assigned. (Rule 6.C.1 & Reg. 4.8)
Indiana has fifty-six (56) district-level delegates that will be filled by twentyeight (28) men and twenty-eight (28) women. Delegate positions will be
designated by the gender of the first position to be filled by the winning
presidential candidate. The remaining delegate positions will be filled
alternating by gender to the presidential preference(s) in the order of the vote
won.

b.

9.

B.

After the delegates are selected, the alternates will be awarded, using the same
process described above.

The State Democratic Chair shall certify in writing to the Secretary of the Democratic
National Committee (DNC) the election of the states district-level delegates and
alternates to the Democratic National Convention within 10 days after their election.

at the time of a subsequent permanent replacement, replace a
delegate with a person of the opposite sex, in order to return the

(1)

A separate election shall be conducted for membership on each standing

committee.

(2)

The membership of the standing committees shall be as equally divided as

will also be published in State Party communications and on the State Partys
website. The Party organization, official, candidate, or member calling a meeting or
scheduling an event, shall effectively publicize the role that such meeting or event

plays in the selection of delegates and alternates to the Democratic National
Convention. (Rule 3.C & Rule 3.D)
2.

Newspapers, radio and television will be utilized to inform the general public how,
when and where to participate in the delegate selection process. Specifically, this
information should provide details as to how to qualify to run as a delegate candidate.
Special effort shall be directed to the major daily newspapers, radio and television
stations by the State Democratic Chair, Affirmative Action Committee members and
staff. Regular releases during the delegate selection process to all other media
sources, weekly newspapers, and wire services should complete timely coverage. See
Exhibit B. (Rule 4.B.3 & Rule 6.D)

3.

A priority effort shall be directed at publicity among the Democratic Partys

constituencies.

4.

a.

Information about the delegate selection process will be provided to minority

newspapers and radio stations, ethnic press, Native American, Asian Americans
and Pacific Islanders, Spanish-speaking and other non-English press, radio
stations and publications, and womens organizations, student newspapers,
LGBT press, disability press, and any other specialty media in the state that is
likely to reach the Democratic constituency groups set forth in the Introduction
of this Affirmative Action Plan.

b.

The State Party shall be responsible for the implementation of this publicity
effort. See Exhibit B. For purposes of providing adequate notice of the delegate
selection process, the times, dates, places and rules for the conduct of the
delegate selection process, workshops, and webinar(s), shall be effectively
publicized, multilingual where necessary, to encourage the participation of
minority groups. (Rule 6.D)

Not later than September 1, 2015, a press kit shall be made and provided to each daily
and weekly newspaper as well as to the electronic media. The press kit will include:
a.

a summary of all pertinent rules related to the states delegate selection process;

b.

a map of delegate districts and how many delegates will be elected within each
district;

c.

a summary explaining the operation and importance of the 2016 Convention;

and

d.

materials designed to encourage participation by prospective delegate

candidates.

D.

Representation Goals
1.

The State Party has determined the demographic composition of African Americans,
Hispanics, Native Americans, and Asian Americans and Pacific Islanders in the
states Democratic electorate. These constituency percentages shall help determine
the goals for representation in the states convention delegation. (Rule 6.A)

2.

The State Party has determined the demographic composition of members of the
LGBT community, people with disabilities, and youth in the states Democratic
electorate and furthermore, the State Party has used these percentages to help
determine the goals for representation in the states convention delegation.
The percentages are based upon data provided by the Democratic National
Committee, constituency exit polling, data gathered from the Center for Disease
Control, and 2012 Gallup Poll data.
Due to inefficient exit polling regarding support for Democratic candidates from
people with disabilities, the Indiana Democratic Party based its Numeric Goal on its
best educated guess by the Affirmative Action Committee.

When selecting the at-large portion of the delegation, the demographic composition
of the other delegates (district-level, pledged PLEO, and unpledged) shall be
compared with the State Partys goals in order to achieve an at-large selection process
that helps to bring about a representative balance.

4.

Use of the at-large delegation to achieve the affirmative action goals established by
this Plan does not obviate the need for the State Party to conduct outreach activities
such as recruitment, education and training. (Rule 6.A.3)

Obligations of Presidential Candidates to Maximize Participation

1.

Presidential candidates shall assist the Indiana Democratic Party in meeting the
demographic representation goals reflected in the Affirmative Action Plan. (Rule 6.H)

2.

Each presidential candidate must submit a written statement to the State Democratic
Chair by December 1, 2015, which indicates the specific steps he or she will take to
encourage full participation in Indianas delegate selection process, including, but not

limited to, procedures by which persons may file as candidates for delegate or
alternate. (Rule 6.H.1)
3.

Each presidential candidate must submit demographic information with respect to all
candidates for delegate and alternate pledged to them. Such information shall be
submitted in conjunction with the list of names approved for consideration as delegate
and alternate candidates pledged to the presidential candidate. (Rule 6.H.2)

4.

Presidential candidates (including uncommitted status) shall use their best effort to
ensure that their respective delegations within the states delegate, alternate and
standing committee delegations shall achieve the affirmative action goals reflected in
the Affirmative Action Plan and that the respective delegations of each presidential
candidate shall be equally divided between men and women. Furthermore,
presidential candidates shall use their best efforts at the district level to approve
delegate and alternate candidates who meet applicable equal division and affirmative
action considerations in order to achieve the affirmative action goals and equal
division for their respective delegations. (Rule 6.I & Reg. 4.9)

John C. Zody, Chair

Indiana Democratic Party
115 West Washington St, Suite 1165
Indianapolis, IN 46204
Chair Zody:
On behalf of Stonewall Democrats nationwide, thank you for accepting our Delegate Selection Plan public comment. This
is an exciting time and we're honored to be part of efforts to ensure 2016's delegation is the most diverse ever. To that end,
Stonewall is writing to offer technical assistance in computing the percentage of LGBTQ in Indiana's Democratic
Electorate. The task is actually quite easy when you consider a few well-sourced figures.
To determine the population of straight and LGBTQ people across America, Gallup conducted 206,186 interviews
between June 1 and Dec. 30, 2012. This is the largest single study of the distribution of the LGBTQ population on record,
and the first time a study has had large enough sample sizes to provide estimates of the LGBTQ population by state.
Within Indiana alone 4,947 people were interviewed and the the study found 91.9% of Indiana residents identified straight
and 8.1% identified LGBTQ.
A second figure to consider is the tendency of LGBTQ to vote for Democratic candidates. To identify this percentage
consider the National Election Poll (NEP) conducted by Edison Research in 2012 for ABC, CBS, CNN, Fox, NBC and the
Associated Press. The NEP was a massive effort on November 6th, 2012 that collected, though in-person and telephone
interactions, nearly 120,000 interviews within the span of 16 hours. The poll found 76% of LGBTQ voted for Barack
Obama in the General Election.
To calculate the percentage of LGBTQ in the Democratic Electorate, simply take the number of all voters (2,624,534) and
reduce it to the population of LGBTQ (8.1%), reduce again by their tendency to vote Democratic (76%) and then divide
everything by the number of Democratic voters (1,152,887). This yields 14.0% of Indiana's Democratic Electorate are
LGBTQ.

2,624,534 total votes * 8.1% population * 76% democratic performance

= 14.0%
1,152,887 Obama votes

Given these calculations and Indiana's total delegation of 97, we request you consider
a goal of 14 LGBTQ delegates. By setting representative goals in concert with the
democratic electorate, together we can build the most inclusive convention ever. We
appreciate your consideration and welcome your feedback and questions.
