In view of the fact that the terms and conditions of the above-mentioned
instruments have been violated by the BORROWERS/ MORTGAGORS by their
failure to pay in full their above-mentioned indebtedness when the same became
due and payable, despite demands for payment made upon them, APPLICANT
hereby requests this Honorable Office, to take immediate steps for the sale of the

mortgaged properties above-mentioned at public auction for cash to the highest

bidder and in accordance with the provisions of Act 3135 as amended.

As of _______ 2011, the unpaid indebtedness of the

MORTGAGORS to the APPLICANT which is to be satisfied out of the proceeds of

the foreclosure sale is PHILIPPINE PESO: ________________ (PhP___________ ) as
shown in the Demand Letter dated __________ 2011 sent by the APPLICANT to the
BORROWERS/MORTGAGORS3 plus interest and penalty charges thereon to date,
cost of publications of the notice sale, expenses of the foreclosure proceedings,
such additional sums as are due from the BORROWERS/MORTGAGORS under the
aforesaid instruments, and other expenses allowed by law.

The legal fees and other expenses incident to the foreclosure proceedings will
be paid upon receipt of advice of the amount thereof.

WHEREFORE, in view of the foregoing, APPLICANT respectfully prays that a

public auction for the parcel of land together with all the buildings and
improvements existing thereon, if any, described in and covered by the TCT No.
________ of the Registry of Deeds for the Province of __________ be forthwith
scheduled by this Honorable Office.
