PART C : TERMS AND CONDITIONS

Building on Bonking Frog Wines desire to create a sustainable future we are proud to announce the 2016 Upcycled Garden Art Competition.
The Competition explores the creative potential of recycling, repurposing, and upcycling materials into useful and decorative outdoor pieces.
CATEGORIES
OPEN CATEGORY
Winner $1,200
The competition winner will receive a $1,200
cash prize provided by Bonking Frog Wines.
PEOPLES CHOICE AWARD
Winner $500
Open to all entrants who are selected for the
exhibition. Audiences will have the opportunity
to vote for their favourite artwork in the
exhibition. The Peoples Choice Winner will
receive $150 plus 12 bottles of Bonking Frog
Wine. Total value $500.
VIEWERS PRIZE
Winner $350
One person who votes for their favourite
artwork at Bonking Frog Wines 7 Dardanup
West Road North Boyanup Western Australia
during the exhibition will win the Viewers Prize
and will receive 12 bottles of Bonking Frog
Wine and a copy of Retrash (as featured in the
New York Times) total value $350.
ARTWORKS CONSIDERED FOR THE EXHIBITION
CAN BE THE FOLLOWING
A sculpture, assemblage or collage created
from reuse or recycled materials.

Was not submitted as part of Upcycle 2014
ARTWORK ENTRY CRITERIA
All art pieces will be displayed outside and
submitted work must be suitable for this
purpose.
Artists may modify, add to, or remove
elements from the materials (e.g. machinery,
tools, and furniture or home wares) in the
process of creating their competition entry.
The artworks must demonstrate the core
intention of upcycling of second hand
materials; if newly purchased materials are
used they must form only a minor part of the
artwork.
ELIGIBILITY
The competition is open to artists and members of
the community aged 18 and over.
GENERAL ENTRY CRITERIA
Entrants should note that all work will be
displayed outside and submitted work must be
suitable for this purpose.
If we have reason to believe the submitted
work does not meet the principle of Upcycling,
then it will judged not to meet the competition
criteria and as such will not be eligible for the
open category prize.
If we have reason to believe your entry is not
your own work or otherwise breaches
copyright with then we may not consider it.
APPLICATIONS
Entry forms can be downloaded from the either the
Bonking Frog Wines website
(https://www.bonkingfrog.com.au) or Facebook
page (https://www.facebook.com/BonkingFrog).
There is a submission limit of two (2) pieces of
artwork per artist.
Entry is by submission of an application form. Each
work submitted requires a high resolution JPEG
image max. of 3MB or high quality photograph.

EXHIBITION
Selected finalists must be willing and able to
display their entry at Bonking Frog Wines cellar
door located at 7 Dardanup West Road, North
Boyanup. Cellar door opening hours throughout
the exhibition are daily from 11.00am to 5.00pm
Saturday, 30th April until Sunday, 8th May 2016.
The Upcycled Garden Art Competition will form
part of the satellite program for the 2016 Dardanup
Art Trail which will be running concurrently.
SELECTING AND JUDGING
Artworks for the exhibition will be selected by the
judging panel. Bonking Frog Wines reserves the
right to change the judges without notification to
the artists. One overall winning entry from all the
Competition entries will be chosen by a panel of
judges.
When choosing the winner, the judges will be
looking for the most creative, inventive and
effective use of upcycling.
The judges decision on the winning entry in the
open category will be announced on Sunday, 1st
May 2016. The judges decision is final and no
correspondence will be entered into.
PEOPLES CHOICE AWARD
The winner of this award will be decided by the
artwork with the highest number of votes cast by
the public. The winner will be announced on the
Bonking Frog Wines Facebook page on Tuesday
10th May 2016.
DELIVERY/INSTALLATION OF ARTWORKS
Selected artworks must be delivered to Bonking
Frog Wines cellar door at 7 Dardanup West Road,
North Boyanup on either Saturday 23rd or Sunday
24th April 2016 between the hours of 11.00am
4.00pm.

DE-INSTALLATION
Artworks selected for the exhibition must be
collected in person between Saturday 14th and
Sunday 15th May 2016 between the hours of
11.00am 4.00pm. Alternative times and day for
pick up can be arranged with prior notice and at
the discretion on Bonking Frog Wines. A photo ID
and receipt of entry or sale will be required as
proof of identity at time of collection.
COPYRIGHT AND PHOTOGRAPHS
Artists own the copyright of their work and license
Bonking Frog Wines to use the submitted images
and to take photographs that can be used for the
exhibition catalogue, publicity, press releases and
other promotion in print and on the Bonking Frog
website and the Bonking Frog Facebook page. By
submitting an entry to the Competition, artists give
Bonking Frog Wines, the right to use their name
and town or city of residence for the sole purpose
of identifying them as the author of the entry.
INTERPRETATION OF TERMS AND CONDITIONS
In the event of a dispute regarding the
interpretation of these terms and conditions, the
decision of Bonking Frog Wines shall be binding on
all parties.
SIGNING OF THE DECLARATION
In signing the Declaration on the Entry Form, the
artist acknowledges they have read, understood
and accepted all the terms and conditions of this
agreement.
CURATORIAL PANEL
A Panel of three independent and qualified judges
will oversee the competition. Details of the judges
to be announced on Bonking Frog Wines Facebook
page at https://www.facebook.com/BonkingFrog.

There will be a 20% commission fee applied by

Bonking Frog Wines on sale of the artwork.

FORCE MAJEURE
If for any reason this competition is not capable of
running as planned (including due to infection by
computer virus, bugs, tampering, unauthorised
intervention, fraud, technical failures or any other
causes beyond the control of the Promoter Bonking
Frog Wines), which corrupts or affect the
administration, security, fairness, integrity or
proper conduct of this competition, the Promoter
reserves the right, in its sole discretion, to take any
action that may be available, and to cancel,
terminate, modify or suspend the competition. The
Promoter reserves the right in its sole discretion to
disqualify all entries from any individual who
tampers with, or benefits from tampering with, the
entry process which as a result corrupts or affects
the administration, security, fairness, integrity or
proper conduct of the competition.

If an artist is registered for GST, the price must

include the GST amount. Hobbyist practitioners
should supply organisers with a Statement by a
Supplier in order to avoid having ABN registered
organisers withhold 48.5% in Pay As You Go (PAYG)
tax for each sale of their work.

Works of art that contain 2 to 4 separate elements

must be accompanied by instructions/diagrams for
display. The placement of the artworks within the
exhibition is at the discretion of Bonking Frog
Wines.
TRANSPORTATION
Artists are responsible for the transportation of
their works to and from the cellar door at Bonking
Frog Wines, 7 Dardanup West Road, North
Boyanup (15 minutes from Bunbury).
SALE OF ARTWORK
All works will be for sale unless marked Not for Sale
(NFS).

SECURITY, LIABILITY AND INSURANCE

Artists exhibit at their own risk. Insurance for the
submitted work is the artists responsibility.
Bonking Frog Wines will exercise reasonable care
for the works selected for the exhibition, but will
not be responsible for loss or damage to the work
while in their custody, during transit or on
exhibition.

The open winner will be announced at the official opening of the Exhibition at 4.00pm on Sunday, 1st May 2016 at
Bonking Frog Wines Cellar Door - 7 Dardanup West Road, North Boyanup. All submitting artists are invited to attend
this function.
ANNOUNCEMENT OF PEOPLES CHOICE WINNER
The Peoples Choice Winner will be announced on the Bonking Frog Wines Facebook page on Tuesday 9th May 2016.
