I have the honour to present the original Application of the Plurinational State
of Bolivia against the Republic of Chile concerning the sovereign access of Bolivia
to the sea. This original document and its Annexes, dated today, are signed by the
Minister of Foreign Affairs of the Plurinational State of Bolivia and the Extra
ordinary Ambassador with Plenipotentiary Representation of the Plurinational
State of Bolivia, AmbassadorEduardo Rodrguez Veltz as Agent named for these
proceedings, with the purpose to be filed with the Registry in accordance with
Article52, paragraph1, of the Rules of Court.
This original Application and its Annexes are accompanied by a copy that the
undersigned Agent certifies as identical to the original for purposes of communica
tion to the other Party in accordance with Article43, paragraph4, of the Statute.

DCRET PRSIDENTIEL
Considrant:
Que larticle267 de la Constitution de lEtat bolivien tablit le droit inalinable
et imprescriptible de celuici lgard du territoire qui lui donne accs locan
Pacifique et son espace maritime; que ce mme article fait par ailleurs de la pour
suite dun rglement effectif du diffrend maritime par des moyens pacifiques et du
plein exercice de sa souverainet sur ledit territoire lun des objectifs permanents et
intangibles de lEtat bolivien;
Que larticle11 de la loi 1444 du 15fvrier 1993 relative aux affaires trangres
stipule que le prsident de la Rpublique, prsent dnomm prsident de lEtat
plurinational de Bolivie, peut, en accord avec le ministre en charge des affaires
trangres et du culte, prsent dnomm ministre des affaires trangres, dsigner
tout ministre, toute personne investie dun mandat parlementaire ou tout autre
reprsentant national en tant quambassadeur extraordinaire et plnipotentiaire
aux fins de missions publiques ou confidentielles spciales et vocation temporaire;
Que, aux termes des alinase) etf) de larticle4 du dcret prsidentielno0834 du
5avril2011, les responsabilits et prrogatives du directeur gnral excutif du
bureau stratgique charg de la reconnaissance des prtentions maritimes consistent
rdiger et dposer la demande internationale de reconnaissance des prtentions
maritimes boliviennes sous rserve de lavis favorable du conseil national charg de
la reconnaissance des prtentions maritimes, reprsenter lEtat plurinational de
Bolivie devant les juridictions internationales auxquelles sera soumise la demande,
suivre la procdure et assurer, sous ses aspects techniques et juridiques, la dfense
du dossier jusqu la clture de linstance; que le dcret prsidentiel no06472 du
31octobre2011 a dsign, cet effet, le citoyen Fausto JuanLanchipa Ponce aux
fonctions de directeur gnral excutif du bureau stratgique de reconnaissance des
prtentions maritimes avec le statut dambassadeur extraordinaire et plnipoten
tiaire;
Que, aux fins de lexercice des pouvoirs confrs au directeur gnral excutif du
bureau stratgique de reconnaissance des prtentions maritimes et de lexcution
des tches qui lui sont confies, il convient de dsigner un ambassadeur extraordi
naire et plnipotentiaire pour agir en tant quagent de lEtat plurinational de Boli
vie devant lesdites juridictions internationales;
Que les points5 et8 de larticle172 de la Constitution tablissent, parmi les attri
butions du prsident de la Rpublique, la conduite de la politique extrieure et la

We, the undersigned, being duly authorized by the Government of the Plurina
tional State of Bolivia, have the honour to submit to the International Court of
Justice, in accordance with Articles36(1) and 40(1) of the Statute of the Court
and Article38 of the Rules of Court, an Application instituting proceedings against
the Republic of Chile.
I. The Dispute
1. The present Application concerns the dispute between the Plurinational State
of Bolivia (Bolivia) and the Republic of Chile (Chile) relating to Chiles obli
gation to negotiate in good faith and effectively with Bolivia in order to reach an
agreement granting Bolivia a fully sovereign access to the Pacific Ocean.
2. The subject of the dispute lies in: (a)the existence of that obligation, (b)the
noncompliance with that obligation by Chile, and (c)Chiles duty to comply with
the said obligation.
3. At present, contrary to the position that it had itself adopted, Chile rejects
and denies the existence of any obligation between the Parties concerning the sub
ject of the present Application1.
4. Bolivia asserts that Chiles denial of the obligation to enter into negotiations
regarding Bolivias fully sovereign access to the Pacific Ocean evidences a funda
mental difference in points of view. It closes any possibility of negotiating a solu
tion to this difference, and constitutes a legal dispute between the Parties, which
Bolivia hereby has the honour to submit to the Court.

Rpublique du Chili.
I. Le diffrend
1. La prsente requte porte sur le diffrend qui oppose lEtat plurinational de
Bolivie (Bolivie) et la Rpublique du Chili (Chili) concernant lobligation du
Chili de ngocier de bonne foi et de manire effective avec la Bolivie en vue de
parvenir un accord assurant celleci un accs pleinement souverain locan
Pacifique.
2.Lobjet du diffrend rside dans: a)lexistence de cette obligation, b)le
nonrespect de cette obligation par le Chili et c)le devoir du Chili de sy confor
mer.
3. Contrairement la position quil avait luimme adopte, le Chili rejette et
rcuse aujourdhui lexistence entre les Parties de toute obligation concernant lob
jet de la prsente requte1.
4. La Bolivie considre que le refus du Chili de reconnatre lexistence de lobli
gation dentamer des ngociations concernant un accs pleinement souverain de la
Bolivie locan Pacifique tmoigne dune divergence de vues fondamentale. Ce
refus exclut toute possibilit de ngocier une solution cette divergence de vues et
constitue un diffrend juridique entre les Parties, que la Bolivie a lhonneur de
soumettre la Cour par la prsente.
II. Fondement de la comptence de la Cour
et recevabilit de la requte
5. La comptence de la Cour dans cette affaire est fonde sur larticleXXXI du
trait amricain de rglement pacifique du 30avril1948 (pacte de Bogot), qui se
lit comme suit:

nationale de Justice, les Hautes Parties contractantes en ce qui concerne tout

nize, in relation to any other American State, the jurisdiction of the Court as
compulsory ipso facto, without the necessity of any special agreement so long
as the present Treaty is in force, in all disputes of a juridical nature that arise
among them concerning: (a)The interpretation of a treaty; (b)Any question
of international law; (c)The existence of any fact which, if established, would
constitute the breach of an international obligation; (d)The nature or extent
of the reparation to be made for the breach of an international obligation.
6. Both Bolivia and Chile are parties to the Pact of Bogot. Bolivia ratified it on
9June20112 and Chile on 21August19673. No pertinent reservation made by
either Party is in force at the present date.
7. The two States, Bolivia and Chile, are ipso jure parties to the Statute of the
Court by virtue of their membership to the United Nations Organization. The
conditions laid down in the Statute and Rules of Court concerning admissibility of
the present Application are satisfied.
III. Statement of Facts
8. In accordance with Article38, paragraph2, of the Rules of Court, which
requires the party making the application to provide a succinct statement of the
facts, the main relevant facts on which this claim is based are as follows.
9. On 6August1825, Bolivia achieved independence as a State with an access
tothe Pacific Ocean, with a coastline of more than four hundred kilometres long
andacoastal territory of more than one hundred and twenty thousand square kilo
metres, which bordered Peru to the north and Chile to the south beyond p
arallel25.
10. The Treaty of 10August1866 delimited the boundary between Bolivia and
Chile at parallel24, and this boundary was confirmed by the Treaty of
6August1874. Thus, Chile formally and legally recognized Bolivias sovereignty
over the coasts of the Pacific Ocean.
11. On 14February1879, Chile invaded and militarily occupied the Bolivian
port of Antofagasta, which led to the socalled War of the Pacific and deprived
Bolivia of its access to the sea. Bolivias economic and social development has suf
fered for more than a century as a result of its confinement.
12. Bolivia signed a Truce Pact on 4April18844, accepting under pressure the
continuing military occupation of its Department of Litoral by Chile.
13.Chile admitted to the overriding need to grant Bolivia a fully sovereign
access to the Pacific Ocean. In this sense, on 18May1895, Bolivia and Chile signed
various treaties in Santiago with the aim of finally resolving the pending issues
between the two States. One of them, particularly important in this regard, was the
Special Treaty on the Transfer of Territories5.

autre Etat amricain dclarent reconnatre comme obligatoire de plein droit,
et sans convention spciale tant que le prsent trait restera en vigueur, la
juridiction de la Cour sur tous les diffrends dordre juridique surgissant entre
elles et ayant pour objet: a)linterprtation dun trait; b)toute question de
droit international; c)lexistence de tout fait qui, sil tait tabli, constituerait
la violation dun engagement international; d)la nature ou ltendue de la
rparation qui dcoule de la rupture dun engagement international.
6. La Bolivie et le Chili sont tous deux parties au pacte de Bogot, la Bolivie
layant ratifi le 9juin20112 et le Chili le 21aot19673. Il nexiste aucune rserve
pertinente formule par lune ou lautre des Parties qui soit en vigueur ce jour.
7. En tant que Membres de lOrganisation des NationsUnies, les deux Etats
sont ipsojure parties au Statut de la Cour. Les conditions de recevabilit nonces
par le Statut et le Rglement sont en lespce satisfaites.

14. While the Bolivian Department of Litoral was under military occupation,
on 20October1904, Bolivia signed the Treaty of Peace and Friendship with
Chile. By this treaty, Chile imposed its rule over the occupied Bolivian territories6.
This treaty did not cancel previous Chilean declarations and commitments con
cerning Bolivias sovereign access to the sea.
15. Six years after the Treaty of 1904 had been signed, faced with the uncer
tainty of the territorial situation of the Peruvian provinces of Tacna and Arica and
aiming at finding an access to the sea for Bolivia through these territories, Bolivias
Minister of Foreign Affairs put a proposal to Chile and Peru, which was also made
known to the other countries of the continent7. This proposal reaffirmed the expec
tations which had been created by Chile and which had survived the signing of the
Treaty of 1904. Chile reaffirmed its position in a Protocol signed with Bolivia on
10January19208.
16. On the basis of these and other commitments, Bolivia and Chile entered into
negotiations regarding an agreement that is contained in the Notes exchanged on
1 and 20June1950.
17. The Bolivian Note of 1June1950, invoking the different declarations and
commitments formulated by Chile, proposed:
for the Governments of Bolivia and Chile to formally enter into a direct
negotiation to satisfy Bolivias fundamental need for obtaining an own and
sovereign access to the Pacific Ocean, thus resolving the problem of Bolivias
confinement, on the basis of mutual conveniences and the true interests of
both countries9.
18. The Chilean Note in response, dated 20June1950, states that:
my Government... it is willing to formally enter into a direct negotiation
aiming at finding the formula which would make it possible to grant Bolivia
an own and sovereign access to the Pacific Ocean and for Chile to obtain
compensations that are not of a territorial nature and that effectively take into
account its interests10.
19.The content of this agreement was reaffirmed through a Memorandum
which the Chilean Embassy forwarded to the Bolivian Ministry of Foreign Affairs
on 10July196111.
to the sea; the Treaty therefore provided (BasesI and II) that if through a plebiscite or
direct arrangements, Chile were to acquire control and permanent sovereignty over the terri
tories of Tacna and Arica, it undertakes to transfer them to the Republic of Bolivia, except
for the area from the Quebrada de Camarones to the Quebrada de Vitor which would
remain under Chilean control. The Treaty also indicated (BaseIV) that if Chile were unable
to gain such sovereignty it undertakes to transfer the Caleta de Vitor up to the Quebrada
de Camarones or any other similar area to Bolivia (Annex6).

14. Le 20octobre1904, la Bolivie, alors que son dpartement du Littoral se trou
vait toujours sous occupation militaire chilienne, conclut avec le Chili un trait de
paix et damiti6 qui, sil permit celuici dimposer sa domination sur les terri
toires boliviens occups, nen mit pas pour autant nant ses dclarations et enga
gements antrieurs concernant laccs souverain de la Bolivie la mer.
15. Six ans aprs la signature du trait de 1904, face lincertitude de la situa
tion territoriale des provinces pruviennes de Tacna et dArica et cherchant assu
rer la Bolivie un couloir daccs la mer travers ces territoires, le ministre
bolivien des affaires trangres soumit au Chili et au Prou une proposition qui fut
porte la connaissance des autres pays du continent7; celleci raffirmait les
attentes quavait fait natre le Chili et que la signature du trait de1904 navait pas
satisfaites. Le Chili ritra sa position dans le cadre dun protocole daccord sign
le 10janvier1920 avec la Bolivie8.
16. Sappuyant sur les engagements pris cette occasion et sur dautres interve
nus par la suite, la Bolivie et le Chili entamrent des ngociations en vue dun
accord dont une bauche figure dans des notes diplomatiques changes entre les
deux Etats les1eret 20juin1950.
17.Dans sa note du 1erjuin1950, le Gouvernement bolivien, invoquant les
dclarations et engagements passs du Chili, proposait que les deux gouvernements
entament officiellement des ngociations directes en vue de satisfaire ce
besoin fondamental que reprsente pour la Bolivie un accs souverain
locan Pacifique, et de rsoudre ainsi le problme de lenclavement de ce pays,
dans la perspective davantages rciproques pour les deux peuples et le respect
de leurs intrts vritables9.
18. Dans sa note adresse en rponse le 20juin1950, le Gouvernement chilien
se dclarait
dispos entamer officiellement des ngociations directes en vue de trouver
la formule qui permettrait la Bolivie de se voir accorder un accs souverain
locan Pacifique, et au Chili dobtenir des compensations de nature non
territoriale tenant pleinement compte de ses intrts10.
19.Le contenu de cet accord fut raffirm par un mmorandum du 10juil
let1961 adress au ministre bolivien des affaires trangres par lambassade du
Chili11.

ment (pointIV) que, sil ne parvient pas acqurir cette souverainet, le Chili sengage
cder la Bolivie la rgion allant de la Caleta deVtor jusqu la QuebradadeCamarones

20. On 8February1975, the Presidents of Bolivia and Chile signed the Joint
Declaration of Charana, in the fourth point of which they agreed to continue with
the dialogue, within a spirit of mutual understanding and a constructive mindset,
in order to find formulas to solve the vital issues which both countries faced, such
as the one relating to the confinement affecting Bolivia12.
21. In the course of the Charana negotiations, through a Note of 19Decem
ber1975, Chile once more declared Chile would be prepared to negotiate with
Bolivia the cession of a strip of land north of Arica up to the Lnea de la
Concordia13.
22. When the dialogue between the Parties was reestablished in 1986, Bolivia
proposed various solutions for its maritime confinement. Nevertheless, and in an
untimely manner, on 9June1987, Chile rejected Bolivias proposals for granting
an appropriate and sovereign access to the Pacific Ocean, contravening its own
prior declarations and commitments.
23. Finally, it is important to mention that the General Assembly of the Organ
ization of American States (OAS) adopted resolution426 during its ninth period
of sessions in 1979, in which, underscoring the continuing hemispheric interest in
finding an equitable solution whereby Bolivia will obtain appropriate sovereign
access to the Pacific Ocean, it resolved [t]o recommend to the States most directly
concerned with this problem that they open negotiations for the purpose of pro
viding Bolivia with a free and sovereign territorial connection with the Pacific
Ocean.14
24. The general hemispheric will expressed in resolution426 of 1979 was con
firmed in another ten subsequent resolutions during the following decade15
whereby it was determined that Bolivias maritime problem would be kept perma
nently on the agenda of the General Assembly of the Organization of American
States until being solved. In particular, resolution686 of 1983 urges Bolivia and
Chile especially to find a formula for giving Bolivia a sovereign outlet to the
Pacific Ocean, on bases that take into account mutual conveniences and the rights
and interest of all parties involved16.
25. Faced with Bolivias claims in international forums, on 22February2000,
the Ministers of Foreign Affairs of Bolivia and Chile issued a joint communiqu,
the second point of which referred to their agreement to put together a work
agenda including, without any exclusion, the essential matters of the bilateral rela
tionship. The Presidents of both countries confirmed this position on 1Septem
ber2000.

20. Le 8fvrier1975, les prsidents bolivien et chilien signrent la dclaration
commune de Charaa, au quatrime point de laquelle ils sengageaient pour
suivre le dialogue dans un esprit constructif et de comprhension mutuelle, afin
didentifier des mcanismes permettant de rsoudre les problmes vitaux auxquels
se trouvaient confronts les deux Etats, et notamment celui de lenclavement de la
Bolivie12.
21. Dans le cadre des ngociations de Charaa, le Chili, par une note en date du
19dcembre 1975, se dclara une fois encore dispos ngocier avec la Bolivie la
cession dune bande de terre situe au nord dArica et stendant jusqu la Lnea
de la Concordia13.
22. Lorsque le dialogue entre les Parties reprit en 1986, la Bolivie avana plu
sieurs solutions pour remdier son problme denclavement. Le 9juin1987, le
Chili rejeta toutefois de faon intempestive ces propositions doctroi la Bolivie
dun accs adquat et souverain locan Pacifique, allant ainsi lencontre de ses
dclarations et engagements antrieurs.
23. Enfin, il y a lieu de rappeler que, dans le cadre de sa rsolution426, adopte
en 1979 lors de sa neuvime session, lAssemble gnrale de lOrganisation des
Etats amricains, soulignant quil tait dans lintrt permanent du continent de
trouver une solution quitable qui assure la Bolivie un accs adquat et souverain
locan Pacifique, a dcid de recommander aux Etats les plus directement
concerns par le problme susvis dentamer des ngociations en vue de la conces
sion la Bolivie dun accs territorial libre et souverain locan Pacifique.14
24. Cette intention gnrale, de porte continentale, exprime dans la rsolu

qui suivit par dixautres rsolutions de lAssemble gnrale de lOrganisation des
Etats amricains15 ayant pour effet de maintenir lordre du jour de lAssemble
gnrale le problme de laccs de la Bolivie la mer aussi longtemps que celuici
naurait past rsolu. Cest ainsi, en particulier, que la rsolution686 de1983
invite la Bolivie et le Chili trouver spcialement une formule visant assurer
la Bolivie une passerelle territoriale et souveraine vers locan Pacifique, sur des
bases quitiennent compte des avantages mutuels et des droits et intrts des parties
concernes16.
25. A la suite des demandes formules par la Bolivie auprs dinstances interna
tionales, les ministres bolivien et chilien des affaires trangres ont, le 22fvrier2000,
sign un communiqu conjoint dont le deuxime point fait tat de leur accord quant
ltablissement dun ordre du jour couvrant, sans aucune exception, les principaux
aspects des relations bilatrales entre les deux Etats. Cette position commune a t
confirme le 1erseptembre2000 par les prsidents bolivien et chilien.

26. In July2006, the Governments of EvoMorales and Michelle Bachelet, Pres
idents of Bolivia and Chile, respectively, agreed on the Agenda of the 13Points,
which included the Maritime Issue in pointVI17. On the occasion of the
22ndmeeting of the BoliviaChile Bilateral Mechanism for Political Consultations
(from 12to 14July2010) both States agreed that the bilateral dialogue had to give
rise to concrete, appropriate and feasible solutions on pointVI of the Bilateral
Agenda referred to the Maritime Issue18 in the next and subsequent meetings.
For that purpose, a meeting was planned to take place in November2010, but
when the said date arrived Chile unilaterally suspended the meeting. The negotia
tions were never resumed.
27. In February2011, the President of Bolivia publicly asked the Government
of Chile to draft a written and concrete proposal to carry forward the process for
solving Bolivias confinement19. Far from responding to this invitation, Chile
stated that Bolivia lacks any legal basis to access the Pacific Ocean through
territories appertaining to Chile20.
28. Later, at the Sixty-Sixth Session of the United Nations General Assembly
on 21September2011, the President of Bolivia stated that the channels for a bilat
eral negotiation with Chile to find a solution for the Bolivian maritime issue remain
open21. The response received from the President of Chile was that there are no
pending issues between the two countries22.
29. Further, at the Sixty-SeventhSession of the United Nations General Assem
bly in September2012, the President of Bolivia once more requested that the
Government of Chile finally solve its maritime confinement, using peaceful

unilatralement ajourne par le Chili et, ce jour, les ngociations nont toujours
pas repris.
27. En fvrier 2011, le prsident de la Bolivie a formellement invit le Gouver
nement du Chili rdiger une proposition concrte en vue de la reprise du proces
sus de dsenclavement de la Bolivie19. Loin de rpondre cette demande, le Chili
a indiqu que la Bolivie ne p[ouvait] invoquer aucun fondement juridique justi
fiant un droit daccs locan Pacifique travers des territoires appartenant au
Chili20.
28.En rponse une dclaration faite par le prsident bolivien le 21sep
tembre2011 loccasion de la soixantesiximesession de lAssemble gnrale des
NationsUnies, selon laquelle les voies de la ngociation bilatrale demeuraient
ouvertes avec le Chili en vue de trouver une solution la question de laccs de la
Bolivie la mer21, le prsident chilien a indiqu quil nexistait aucune question
pendante entre les deux Etats22.
29. Lors de la vingt-septimesession de lAssemble gnrale des NationsUnies,
en septembre2012, le prsident de la Bolivie a, une fois encore, invit le Gouvernement
du Chili rgler de manire dfinitive le problme de labsence daccs [de la Bolivie]
la mer en recourant des mcanismes de rglement pacifique des diffrends23. Cette
demande sest heurte un refus catgorique du ministre chilien des affaires tran
gres, qui a soulign quil nexist[ait] aucun diffrend entre le Chili et la Bolivie24,

States and that Bolivia lacks any right to claim a sovereign access to the
sea25.
30. In these circumstances, it is clear that Chile has no intention of truly going
forward in the formal negotiation regarding the agreement to perform its obliga
tion of effectively ensuring a fully sovereign access to the sea for Bolivia. There
fore, being a peaceful State, Bolivia has decided to solve the present dispute with
Chile by means of peaceful settlement mechanisms provided for in international
law. Bolivia therefore submits the present dispute to the International Court of
Justice.
IV. The Legal Grounds on which the Claim Is Based
31. The facts provided above (SectionIII) show that, beyond its general obliga
tions under international law, Chile has committed itself, more specifically through
agreements, diplomatic practice and a series of declarations attributable to its
highestlevel representatives, to negotiate a sovereign access to the sea for Bolivia.
Chile has not complied with this obligation and, what is more, at the present date
Chile denies the very existence of its obligation.
V.Submissions
32. For the above reasons Bolivia respectfully requests the Court to adjudge
and declare that:
(a) Chile has the obligation to negotiate with Bolivia in order to reach an agree
ment granting Bolivia a fully sovereign access to the Pacific Ocean;
(b) Chile has breached the said obligation;
(c) Chile must perform the said obligation in good faith, promptly, formally,
within a reasonable time and effectively, to grant Bolivia a fully sovereign
access to the Pacific Ocean.
33. Bolivia reserves the right to supplement, modify and amplify the present
Application in the course of the proceedings.
34.Without prejudice to the jurisdiction of this Court in the present case,
Bolivia reserves the right to request that an arbitral tribunal be established in
accordance with the obligation under ArticleXII of the Treaty of Peace and
Friendship concluded with Chile on 20October1904 and the Protocol of
16April1907, in the case of any claims arising out of the said Treaty.
VI.Judge Ad Hoc
35. For the purposes of Article31(3) of the Statute of the Court and Arti
cle35(1) of the Rules of Court, Bolivia declares its intention of exercising the right
to designate a judgeadhoc.

2nd During the term of this Truce, the Republic of Chile will continue to rule,
subject to the political and administrative regime provided for in Chilean law, the
territories that lie between parallel twentythree and the mouth of the Loa River in
the Pacific, whereby the eastern boundary of the aforementioned territories is a
straight line that starts from Sapalegui, from the intersection with the demarcation
that separates them from the Republic of Argentina, up to the Llicancaur volcano.

The Republic of Chile and the Republic of Bolivia, with the purpose of strength
ening increasingly closer ties of friendship to unite the two countries, and the

Should the Republic of Chile fail to obtain definitive sovereignty over the area
in which the cities of Tacna and Arica are located, either by plebiscite or through
direct arrangements, it undertakes to transfer to Bolivia the area from the Caleta
de Vtor up to the Quebrada de Camarones or any other similar area, as well as the
amount of five million silver pesos of twenty-five grams of weight and nine-tenths
pure.

dcid de conclure un trait spcial de cession territoriale aux fins duquel elles ont

I.
Si, par leffet du rfrendum qui doit tre organis conformment au trait
dAncn ou par leffet daccords directs, la Rpublique du Chili devait acqurir la
souverainet permanente sur les territoires de Tacna et dArica, elle sengage les
cder la Rpublique de Bolivie, avec la configuration et la superficie qui taient les
leurs au moment de leur acquisition, sans prjudice des dispositions de larticleII.
A titre de compensation pour cette cession territoriale, la Rpublique de Bolivie
versera la somme de cinqmillions de pesos en argent dun poids de vingtcinq
grammes et au titre de neufdiximes. Il sera procd ce paiement par laffectation
de quarantepourcent des recettes du poste douanier dArica.
II.
En cas de ralisation de la cession envisage larticle prcdent, il est entendu
que la frontire septentrionale de la Rpublique du Chili sera dplace de Cama
rones la Quebrada de Vtor, de la cte la frontire qui spare actuellement cette
rgion de la Rpublique de Bolivie.

Chile and Peru, in accordance with the opinion of many of their distinguished
men in public positions, should no longer be neighbouring countries, establishing
the territorial sovereignty of Bolivia in an intermediate zone on the Pacific coast. It
is not necessary to demonstrate the importance of this significant fact for the poli
tics and stability of the HispanicAmerican nations.
Bolivia cannot live isolated from the sea; today and always, it will do its utmost
to the best of its ability, to come to possess at least one convenient port on the
Pacific; and it shall never succumb to inaction whenever this matter of Tacna and
Arica causes concern, which compromises the very foundations of its existence.

IV. The situation created by the Treaty of 1904, the interests located in this area
and the security of its northern boundary, impose on Chile the need to preserve the
coastline which is indispensable for the country; but with the purpose of building,
on solid foundations, the future union of both countries, Chile is willing to ensure
that Bolivia acquires its own access to the sea, by ceding an important part of that
area north of Arica and of the railway line that is located in the territories that are
