ANZAC Day Commemoration Council (South Australia)

• Bill Denny AM JP (Presiding Member)

• Patrick Beale DSO MC
• Eric Ciracovitch OAM JP
• Sandra Coulson CSM
• Nichola Kapitza
• Stephen Larkins

AND TO WHOM IT MAY CONCERN

.
I understand that various ANZAC Day Commemoration Council’s may have voted
to no longer continue with the usage of “God save the Queen”.
.
I understand that ANZAC Day Commemoration Council is a statutory body with
members appointed by the Governor on the nomination of the Premier
.
As a CONSTITUTIONALIST I seek you to consider that within s.106 of the
constitution (federal) the States are created from the colonies “subject to this
constitution” and as such the States are bound by this constitution to observe and
apply all legal principles embedded in the constitution which includes that at all public
occasions the anthem “God save the Queen” is played.
.
No “ANZAC Day Commemoration Council” of whatever State/Territory has the
powers to interfere with constitutional embedded legal principles and those who prefer
to do otherwise are at liberty to move to any country where “God save the Queen” is
not constitutionally required to be played at every official occasion. I for one am not
going to beg them not to leave because those who disregard the basic of all law, the
constitution, in my view aren’t worth to have around.
.
In my view it would be unconstitutional for any “ANZAC Day Commemoration
Council” to interfere with the national anthem “God save the Queen” to be played at
every official occasion.
.
It doesn’t matter if people like to have their own kind of national Anthem being it
Walzing Matilda, some pub song or whatever when they occupy the loo but when it
comes to official ceremonies the only recognisable national anthem embedded in the
constitution is which shows due and proper respect to Her Majesty Queen Elizabeth II
who is and remains to be the true British Monarch governing the “POLITICAL
UNION” Commonwealth of Australia!
.
Hansard 2-3-1898 Constitution Convention Debates
QUOTE
Mr. SYMON ( South Australia ).-
In the preamble honorable members will find that what we desire to do is to unite in
one indissoluble Federal Commonwealth -that is the political Union-"under the
Crown of the United Kingdom of Great Britain and Ireland , and under the
Constitution hereby established." Honorable members will therefore see that the
application of the word Commonwealth is to the political Union which is sought to be
established. It is not intended there to have any relation whatever to the name of the
country or nation which we are going to create under that Union . The second part of
the preamble goes on to say that it is expedient to make provision for the admission of
other colonies into the Commonwealth. That is, for admission into this political
Union, which is not a republic, which is not to be called a dominion, kingdom, or
empire, but is to be a Union by the name of "Commonwealth," and I do not
propose to interfere with that in the slightest degree.
END QUOTE
.
It is not relevant what my personal views are as unless and until we amend the
constitution, and for so fat this is possible, as I view as a CONSTITUTIONALIST
that not even a S.128 referendum can interfere with this, the only true national anthem
is this which recognises and honour OUR British Monarch, which all Australian
soldiers serve and many have given their lives while serving the Monarch.
.
Those who have republican idea’s should understand that they are entitled to their
idea’s as long as they do not interfere with the constitutional rights of others and
hence forget about not using the national anthem “God save the Queen” and start
respecting the fallen soldiers who died in service of the British Monarch which is
constitutionally the Monarch governing all Australians, regardless if you may dislike
this or not.

HANSARD 22-4-1897 Constitution Convention Debates (Official Record of the

Debates of the National Australasian Convention)
QUOTE Mr. GLYNN:
It is felt in the forms in our courts of justice, in the language of our Statutes,
in the oath that binds the sovereign to the observance of oar liberties, in the
recognition of the Sabbath, in the rubrics of our guilds and social orders, in
the anthem through which on every public occasion we invocate a blessing
on our executive head, in our domestic observances, in the offices of
courtesy at our meetings and partings, and in the time-honored motto of the
nation.
END QUOTE
.
EITHER WE HAVE A CONSTITUTION OR WE DON’T!
.
Those who are governing are so because of the constitution and let them at least then
show honour and respect! Those who are appointed by any government likewise must
show honour and respect to the constitution as the constitution after all;

HANSARD 17-3-1898 Constitution Convention Debates

QUOTE Mr. BARTON.-
Having provided in that way for a free Constitution, we have provided for an
Executive which is charged with the duty of maintaining the provisions of that
Constitution; and, therefore, it can only act as the agents of the people.
END QUOTE
.
HANSARD 17-3-1898 Constitution Convention Debates
QUOTE Mr. BARTON.-
In doing these things, have we not provided, first, that our Constitution shall be free:
next, that its government shall be by the will of the people, which is the just result of
their freedom: thirdly, that the Constitution shall not, nor shall any of its
provisions, be twisted or perverted, inasmuch as a court appointed by their own
Executive, but acting independently, is to decide what is a perversion of its
provisions? We can have every faith in the constitution of that tribunal. It is appointed
as the arbiter of the Constitution. It is appointed not to be above the Constitution,
for no citizen is above it, but under it; but it is appointed for the purpose of
saying that those who are the instruments of the Constitution-the Government
and the Parliament of the day-shall not become the masters of those whom, as to
the Constitution, they are bound to serve. What I mean is this: That if you, after
making a Constitution of this kind, enable any Government or any Parliament to
twist or infringe its provisions, then by slow degrees you may have that
Constitution-if not altered in terms-so whittled away in operation that the
guarantees of freedom which it gives your people will not be maintained;
END QUOTE
.
I request you to ensure that the appropriate national anthem “God save the Queen” is
therefore played at each official occasion and you also pass this on to every other
State/Territorian ANZAC Day Commemoration Council as to ensure also that no
disrespect is shown to the soldiers who’s lives are remembered.
