PETITION

COMES NOW, the petitioner, Benigno Binay and before this Reconstituting Officer thru the
Register of Deeds, respectfully states:
1. That petitioner is of legal age, single, Filipino citizen and residing at 22 Hidden Plains
Subdivision, Borbajo Street, Talamban, Cebu City, Cebu 6000;

2. That petitioner is the registered owner of a parcel of land covered by Original Certificate of
Title No. T-123456, Register of Deeds of Cebu City, free of any encumbrances;

3. That the original of the aforesaid Original Certificate of title on file with the Registry of Deeds of
Cebu was lost or destroyed due to the fire that occurred on January 5, 2016 the office of
the register of Deeds of Cebu City which burned all the Torrens Titles in said office including
O.C.T. No. T-123456 was burned;

4. That submitted herewith are the following papers in support of this position:
a. Owners Duplicate Certificate of Title and three 3 copies thereof.
b. Real estate tax receipt representing full payment or at least two years prior to the filing of
the petition;
c. Tax Declaration

PRAYER

WHEREFORE, it is respectfully prayed that the original of Original Certificate of Title No.
T-123456 lost or destroyed in the files of the Register of Deeds of Cebu City be ordered
reconstituted on the basis of the owners duplicate certificate of title and in accordance with
Republic
Act
No.6732.

Benigno Binay, Filipino, of legal age, single and a resident of 22 Hidden Plains
Subdivision, Borbajo Street, Talamban, Cebu City, province of Cebu, Philippines, after having
been duly sworn in accordance with law hereby depose and state:
1. That I am the registered owner of the parcel of land covered by Original Certificate of
Title No. O.C.T. No. T-123456; of the Registry of Deeds of Cebu City;
2. That the original copy of the aforesaid Certificate of Title on file with the Registry of
Deeds of Cebu City was lost or destroyed due to fire;
3. That no deed or other instruments affecting the property had been presented for
registration, or if there is any, the nature of hereof the date of its presentations, as well
as the names of the parties, and whether, the registration of such deed or instrument
is still pending accomplishment;
4. That the owners duplicate certificate is in due form without any apparent intentional
alterations or erasures;
5. That the Certificate of Title is not the subject of litigation or investigation,
administrative or judicial, regarding its genuine or due execution or issuance;
6. That the Certificate of Title is was in full force and effect at the time it was lost or
destroyed;
7. That the Certificate of Title is covered by a tax declaration regularly issued by the
Assessors Office; and;
8. That the Real Estate Taxes have been fully paid up to at least two (2) years prior to
the filing of the petition for reconstitution;
9. That the corresponding owners duplicate of said Original Certificate of Title No. T123456 was lost or destroyed in the possession of the Register of Deeds of Cebu City
under the following circumstances:
That a fire occurred on January 5, 2016 in the Register of Deeds of Cebu City and all
files including the Original Certificate of Title of the petitioner was lost or destroyed
10. That this owners duplicate of title is being submitted as basis for administrative
reconstitution pursuant to Republic Act No. 6732;
11. That I am executing this affidavit in connection with my petition for administrative
reconstitution of the original copy of Original Certificate of Title No. O.C.T. No. T123456;
