as High Court Delays Overdue Constitutional Ruling

“In the wake of the resignation of former Chief Justice Ruth McGregor, ‘Pro-
Raza’ and Cheap Illegal Mexican Labor political considerations still dominate the
Arizona Supreme Court,” says the Notorious Mexican Flag Burner.

In the last few days, as we’ve watched “Pro-Raza” demonstrators waving Mexican
Flags claim that Arizona’s landmark legislation SB-1070 is “racist,” one political
activist has been conspicuously absent from the scene: Roy Warden, whose First
Amendment Rights to public speech and assembly have been suspended by a
“transparently invalid” Order of the Tucson City Court.

The issue—do Arizona Judges have the jurisdiction to suspend constitutional


rights when local government and courts object to the content of the political
message—has been waiting now for several months before the Arizona Supreme
Court.

(And if you’ve always thought the core purpose of the First Amendment was to
protect the people’s right to criticize the policies of government, you just got an
“A” in Con Law)

During the last four years Warden has been arrested 14 times consequent to his
street protests. Recently he earned a victory in a two year prosecution for Burning
the Mexican Flag at a 2008 protest in Library Park Tucson Arizona, when it was
revealed that Tucson City Attorney Michael Rankin wrote an opinion letter in
2006 which stated (correctly) Burning the Mexican Flag was a political act
protected by the First Amendment.

“The Tucson City Prosecutor knew that my political action was legally correct but
he prosecuted me anyway—just because the Mexican Government and local left
wing government officials led by Pima Legal Defender Isabel Garcia, wanted him
to,” Warden said.

For the last four years Warden had maintained that right wing business (“Cheap
Mexican Labor”) and left–wing “Pro-Raza” forces have dominated Arizona’s
political and legal institutions, reaching right up to the Arizona Supreme Court.
“Former Chief Justice of the Arizona Supreme Court Ruth McGregor, supported
by left wing bloggers including “The Feathered Bastard,” was forced to resign
when it was revealed she used her office to promulgate ‘Pro-Raza’ policy in
violation of the Canons of Judicial Conduct,” said Warden, who wrote several
articles condemning McGregor’s conduct, including one in which he took credit
for McGregor’s Judicial Demise.

“Now the Arizona Supreme Court is refusing to protect my rights; just because I
kicked McGregor in the ass, and because they can.”

In light of a recent Rasmussen Poll showing 70% of all Arizonans approve of


SB-1070, today’s Arizona Daily Star reveals the astonishing power of the Cheap
Mexican Labor and “Pro-Raza” lobby to dominate Tucson public officials, thus
establishing the primary rationale for one of the bill’s controversial provisions
which will permit local police officers, “when practical,” to make immigration
status determinations.

The Star’s Article quotes Tucson Mayor Walkup and South Tucson Police Chief
Muñoz as opposing to SB-1070; ironically giving proof for the necessity of the law
enforcement provisions of the statute.

“Of course the Good ‘Ole Boys and ‘Local Yokels’ oppose it: Pima County and
Tucson City Officials are the ones responsible for opening the borders and filling
up America with Mexican Illegal Aliens in the first place,” says Warden.

“And the Arizona Supreme Court continues to abuse its power and protect these
officials by refusing to protect my First Amendment right to publically confront
them.”
