Unique Program Gives Hope

to Stroke Victims
Now, stroke survivors have a place to go for help and
hope: the Heart and Stroke Foundations Living with
Stroke program. The program is designed to help stroke
survivors and their families improve their quality of life,
cope with challenges and connect with others.
Lead by trained volunteer facilitators and provided free
in Nelson, the program is comprised of eight weekly, twohour sessions. Weekly topics include: impact of stroke,
physical changes and keeping active; nutrition; dealing
with emotions and relationships and reducing future risk
for another stroke.
Helping survivors take back control of their own health!
All stroke survivors and their care partners are welcome to
join. The next Living With Stroke program will run on Friday mornings starting April 8 at the Kalein Centre, Nelson.

Kaslo And Area D
The Kaslo Housing Society envisions communities where
residents and newcomers of all ages and abilities have access
to housing that is affordable, appropriate and accessible.
According to the most recent census, almost 2/3 of tenant households in Kaslo and Area D pay more than 30%
of their income on shelter. And, while occupant owned
homes offer some of the lowest cost shelter, 20% of these
homes are going without needed major repairs.
Many landlords in Kaslo provide housing that is less
than $1000 per month in rent, yet for over one quarter of
Kaslo households, affordable shelter cost would be $400
$700 per month by income.
This year, the Kaslo Housing Society will continue work
to help protect existing affordable housing in the Village
and Area D. We will also develop a set of feasible options
that meet our core values: community resilience and a

COURT-ORDERED SUPPORT
If the court orders your ex to pay you
spousal support after your divorce, its
important you protect your rights to those
payments. You should keep your lawyer in
the loop before agreeing to any changes
and take needed action promptly or you
may lose out. A recent case decided by our
BC appeal court shows what can happen if
you dont.
Cindy and Mark (names changed) were
married for 20 years before divorcing in
1997. They had two children, both with
developmental and learning challenges.
While married, Cindy stayed home to look
after the children. When she and Mark
divorced, Mark was ordered to pay Cindy
$800 a month in spousal support going
forward indefinitely.
Mark made those payments until the start
of 2001. But after meeting with Cindy late
2000 or early 2001, he started paying her
only $200 a month, intended as support
for their children. In 2010 (some 10 years
later), Cindys lawyer sent Mark a letter
saying Mark had unilaterally decided to
cut his payments back to $200 a month. He
demanded Mark pay $70,000 (plus interest)
in arrears or back payments and also start
paying Cindy the $800 a month the court
had originally ordered. Marks lawyer wrote
back that Cindy had agreed to the $200
reduced amount.
After that, Cindy did nothing more until
2014, when she went to court. She now
claimed about $99,000 in arrears, and asked
for $800 a month (or more) in support
going forward. Mark in turn asked the court
to cancel the arrears and stop any future

support payments.
There was some dispute about what
happened at the meeting in 2000 or 2001.
But the court decided Cindy had, in fact,
agreed to a reduction of the support
payments to $200 a month at the time.
Because Cindy got nothing in return, this
wasnt a legally binding contract. Still, Cindy
had waived (given up) her legal right to
the $800 a month until she withdrew that
waiver.
Because she didnt do anything after the
2010 letter exchange between the lawyers,
she had not definitively taken back her
waiver then. She could withdraw her waiver
by giving reasonable notice but she only
did that by going to court over this in 2014.
So because shed waived her legal rights
till then, Cindys claim for $99,000 in
arrears (dating from 2001) failed. She hadnt
suffered financially, and the courts lean
against hoarding. For Mark, it would be an
unfair hardship to have to pay such a large
amount due to Cindys delay.
As to what spousal support payments, if
any, Mark should pay from 2014 on, this
needed to be dealt with under the federal
Divorce Act rules for varying (changing)
support orders. There had been a material
change in Mark and Cindys circumstances
since the original 1997 support order.
The court decided Cindy was entitled to
ongoing spousal support and awarded her
$424 a month going forward, in line with
guidelines the court found helpful here.

There are 12 nights (that began
March 10) of fantastic entertainment filling Nelsons Shambhala
Music and Performance Hall.
Mitchell Hahn is one of 20 students that will bring a wide array of
musical genres to the stage including folk, rock, jazz, funk and heavy
metal. Ive seen some really awesome electronic music with synth
medleys, guitar solos that are just
jaw dropping and some incredible
song writing, he says.
At the end of their music education, the learning and evaluation
continues through these performances where students handle every aspect of putting a
show together. From lighting and sound to their promotional poster and what they will say on stage, the musicians must consider even the little things like taking the
snare drum off the stage before a ballad so it doesnt
vibrate, explains Parenteau.
Hahn, a singer and guitar player, says skills learned in
the classroom are easy to understand in theory but putting on a professional show forces students to put it all
together and deal with any problems in a dynamic reallife scenario. Its your show and if things go wrong, its on
you, he says.
The public is welcome to attend the event at Nelsons
Shambhala Music and Performance Hall on the Tenth
Street Campus where the students traditionally play
before packed houses.

At Nelson Public Library
When photographer Louis Bockner sees an image he
wants to capture, its not always the image youd expect.
With a canny eye for the unique, Bockners lens may
settle on the landscape or on its reflection. It might
seek the star-scatter of superimposed long exposures, or
uncover the subtle planes and textures of animal bones.
Bockners photographs, now on display at the Nelson
Public Library, cast an artists eye on the world we live in.
Its a long way from Argenta to New York, but thats
where Bockner chose to study, at the New York Institute of Photography. He further honed his skills at the
Western Academy of Photography in Victoria, studying
professional photography and photojournalism, before
returning to his roots. Now back in the Kootenays, he
makes his living on portraiture and candid event coverage, including Shambhala music festival. He also teaches
beginner photography.
This work is a showcase of the other photography that
I do. The photographs where people arent at the forefront, he says. I try to do some kind of justice to the
breathtaking beauty I see every day. Some of it is a bit
dark while some it purely playful, offering a glimpse into
where I have been and what I have seen.

The third edition of the EcoSociety Winter Market

takes place on Saturday, March 19 from 10 am to 3 pm at
Hart Hall, 501 Carbonate Street in Nelson.
There will be just one more Winter Market after this one
on April 16 and then the Cottonwood Market starts up
in mid-May. All of the products that will be on offer are
handmade or locally grown so you know you are strengthening the local economy when you shop at these markets.
EcoSocietys Markets and Events director, Jesse R. Woodward, said The first and second editions of the EcoSociety
Winter Market have gone really well and I am so happy to
be able to add these events to Nelsons winter scene. He
also said that the public seem to really love supporting
local farmers, artisans and crafts people and that kind of
support really helps the local economy flourish.

Call for entry: Registrations are being accepted for
artists/venues in the Columbia Basin to participate in
the 8th annual Columbia
Basin Culture Tour (CBCT),
a celebration of culture taking place August 13 14,
2016 from 10 am to 5 pm.
The CBCT is a self-guided
tour showcasing local arts,
culture and heritage offered
at no charge to the general
public. Arts includes visual, written, performing, media
and inter-arts! Participating as a venue allows you to
really connect with locals, develop a wider audience, educate the public about what you do, market your activities
and attract visitors to your community.
The CBCT allows visitors to meet the participants
behind the scenes and allows them to: visit artists studios
that may not regularly be open to the public, purchase
works directly from the artists, visit art galleries, museums and cultural centres to view special interpretive displays, archives, demonstrations or performances. It is also
a chance for them to meet the people behind the scenes
that are such a vital part of our local culture.
